Hi, I just uploaded this myself, but now I am aseriosuly doubting that it was me who took this picture. (We all took similar pictures at the time the chimpanzee did this, but this particular picture is very likely not by me). So; I am very sorry, but could this please be deleted quickly? Many thanks! - In den meisten Fällen können Screenshots von Computer-Software(Programme, Videospiele, Betriebssysteme) nicht auf Commons hochgeladen werden, es sei denn die Software steht unter einer freien Software-Lizenz ... oder es gibt eine formale Genehmigung.
- In der englischen Wikipedia ist das anders, da werden screenshotsmit der en:Template:Non-free video game screenshot und en:Template:Non-free use rationale lizenziert - sihe en:File:Rise of Nations scene.jpg. Derivative work (retouched version) of File:Geneve.jpg which was deleted in 2012 per Commons:Deletion requests/File:Geneve.jpg on grounds of doubting "own work" (uploader stated picture was taken in 1992, but the Libyan flag in the picture was not used from 1970 to 2011). In addition to what was said there, the original uploader of Geneve.jpg also uploaded a self-portrait dated 2003 where he looks too young to be able to have taken this picture in the 1960's. - Speedy keep. As admin NordNordWest states "An inappropriate name of a file is no reason for deletion.". This map is currently used by the main Israel map template at en.wiki and that template can only be edited by admins. User Greyshark09 is trying to delete the map on en.wiki though the current RFC is not going his way so he came here to try to supercede en.wiki by deleting it here. If the rules of commons demands a name change, I don't know commons rules, then please let me know before hand so I can notify an admin and perhaps we could duplicate the map for a day then delete this one so that we do not have template problems on en.wiki as it takes time to update. - Color of Huleh valley and southern Tiberias should be changed to white - Syria has very little claim there; the colors of annexed areas (EJ and Western Golan) should be hatched or colored differently to represent Israeli annexation, which is not recognized by UN; Judea and Samaria Area (area C of the West Bank) should be also decided whether to color it - it is under semi-military Israeli rule since 1982 (Israeli military occupation was abolished in 1982 as a result of Egypt peace accords); inclusion of Gaza Strip and whole West Bank under Israel at same color should not be presented, but anyway that wasn't the original situation at File:Location map Israel.svg.Greyshark09 (talk) 16:18, 13 May 2014 (UTC)

- Ah, I see -- there are multiple possible meanings of "proper." Perhaps you are thinking of a different meaning. See wiktionary:en:proper#adjective. The way I read this, the word would indicate this is the "correct" border of Israel, which -- per Denniss' nomination -- is not a good way to name a file. Where a border is in dispute, or has changed over time, it's better to name it in a way which reflects what point of view it represents, rather than indicating it is the "neutral" or "proper" or "correct" point of view. -Pete F (talk) 02:15, 13 May 2014 (UTC)

- Speedy Keep as per Vanjagenije. The original map File:Israel location map.svg was used for locations outside Israel, and colouring distinguished areas extraterritorial to Israel, but occupied by Israel, differently from the other neighbouring countries in the region. In that sense the original map was not only Israel, but Israel/Areas Occupied by Israel. Sepsis rightly corrected that. If one challenge the 'neutral' description, you must likewise challenge the File:Israel location map.svg title or colour-shading which very subtly insinuates that Israel and its Occupied Territores are qualitatively offset from neighbouring countries. A POV-map, in short, generated a counter POV-map and we question the neutrality of the latter endeavour to fix the mess, without addressing the primary issue, which is the first map. Greyshark himself admits that “there is no such a thing as "neutral" map” , and this applies to the original map Sepsis tried to correct. - Comment - Why in Sepsis II's map the Syrian occupation of Huleh valley and southern part of Tiberias Lake (1948-1967) is shown as not part of Israel, even though Syria has very dim claim to this area (Syrian claim to this area is no different than Israeli claim to Western Golan - both originated in occupation). Sepsis II's map represents 1949 borders - one of the possible versions for Israeli borders and unsurprisingly the mainstream position of the Arab League; As far as i know Huleh valley and southern Tiberias are included as part of Israel (or hatched) in other maps; while Golan and East Jerusalem are added to Israel in others - the areas are not under military occupation since 1982, but rather annexed (recognition is another matter); Some maps which represent Israeli views are including also the West Bank in same color, but that one can be dismissed as more radical representation together with the 1949 version of Sepsis II. The problem is however mainly that there was no discussion on what is the neutral map - Sepsis II decided this himself by changing the location map template, later suspiciously protected for editors (system gaming?) and for some reason Sepsis II is demanding his rights even though he violated WP:BRD and WP:CIVIL on the way. - Good grief, if that is the state of your knowledge, perhaps you'd better take a stroll down the central souq in East Jerusalem and ask yourself, as Palestinians do, what on earth all of those young girls in military fatigues and touting Uzis are doing patrolling that area. Or ask Christians why Israel imposes so many restrictions on them at Easter at the Church of the Holy Sepulchre, or Muslims why none of their children can go with them to say prayers on the Dome of the Rock (because the occupying authority refuses them that right, even though they are 'annexed Jerusalemites', a right given to every Jewish child in the world to visit unhampered the Western Wall nearby. 'Annexation' in one party's POV, Greyshark, does not cancel the fact that those areas are, under international law, 'occupied', and if you cannot understand that, then charging that Sepsis is a POV-pusher is rather comical. All photos except "Lincoln Court exterior" (which I photographed myself and Photoshopped it to age it) and the Biograph map (made myself in Photoshop and collected over years from FBI documents) have been in my collection for over 25 years. The photos are all at least 81 years old. Many of them are from defunct newspapers. I believe all the photographs can be found in a matter of seconds with a quick Google search. They're everywhere already. They are not rare or one-of-a-kind. They're very common photos. People already can easily download them. Wouldn't it be better to have the photos put in historical context? I believe so. Thank you.

The author is described as unknown but in fact the author is given at the Library of Congress catalog or the author is identifiable via other libraries (even online). Files from the Rehse-Archiv für Zeitgeschichte und Publizistik form a part of Category:World War I posters in the Library of Congress, those files (see list below) originate from Germany and Austria. In many cases the author is not dead >70 years, the files therefore fail Commons:Licensing. I hope the list is complete, the bot operator did not stop the upload after notification nor does he offer a satisfying sollution now to correct this failed batch upload [8].

[edit]- Comment The nomination appears an unnecessarily pointy representation of events. The images were uploaded between 12th to the 20th April, and Martin raised no issue with me until 20th April, when most of these uploads had been available for several days. As can be seen on my talk page archive, I responded to questions the same day, despite this being raised on an Easter weekend and paused the project the same day, as I confirmed by saying "In the meantime I'll pause this work until after investigation." I am hardly a rogue bot operator and I do not appreciate being unfairly characterized as such. In addition, I made the effort to create this list of potential matches as a backlog to check. I have never claimed to be an expert in World War I, nor German poster artists who were contracted to the government to produce propaganda at that time, hence I was the one that proposed creating this DR to facilitate wider views and discussion.
- All of the photographs are offered as public domain by the Library of Congress and have been made on commission to the German war-time government up until 1919.
- Taking a random sample, LCCN2004665803 is by the war time artist Lucian Bernhard. Bernhard died in 1972. There is another of his wartime posters (sourced to the Library of Congress) at File:So hilft dein Geld.jpg where it is a Featured Picture and was a Picture of the Day last year. With this precedent, it would be reasonable to host any contested file on the English Wikipedia as public domain there, if it was felt there was sufficient doubt to not host them on Commons. --Fæ (talk) 06:57, 8 May 2014 (UTC)
- I have added artist names to the list of files. The files have been initially sorted in the table by upload date/time. Where no artist is known, these are public domain under the 70 year default. Where artists are confirmed to have been dead for more than 70 years, these are also public domain by default.
- Faebot has been asked to populate author fields for the entire WWI collection of posters in addition to those listed here, based on which artists are shown as known in the Library of Congress catalogue. - I am bound to be partial, as the uploader, however I don't think it is much of a stretch. We should be looking for "significant doubt" rather than "hypothetical doubt" and in the absence of the estate of any artist pursuing copyright on government commissioned WWI propaganda in the past 100 years, any doubt looks to be easily within the "non-significant" end of things. There will never be no doubt, even after 170 years. I doubt many people are going to chip in on this page, perhaps as this is a topic that could do with a more definitive consensus, should we take this DR as an example to start a thread on the copyright noticeboard for a wider community view? --Fæ (talk) 13:37, 22 May 2014 (UTC)

The situation is absolutely clear, the law gives copyright protection to this files. The argumentation above is against Commons:Project scope/Precautionary principle, hypothetically emphasizing that a poster artist who created propaganda will unlikely enforce theire rights (although some of this isn’t propaganda but announcements for charity organizations or private organizations in the post-war time or advertisements for private banks in the wartime). That doesnt matter. A poster artists works has the same rights like any other painter or more known artist whose work isn’t public domain yet and not accepted on Commons. These may or may not fail PRP on Commons depending on whether you believe this hypothetical interpretation of 100 year old government commissioned works is "significant doubt" or not, given the complete absence of any legal cases or case law in the past 100 years.

- You will not find case law for other works by Max Pechstein because germany is not a common law country... or maybe im wrong with this and you will indeed find cases where the artists of a work not died >70 years ago and heirs claim copyright. - Yes. An example legal case where the estate of an artist commissioned by the government during WWI, has made a claim of copyright to an artwork under that commission. Other circumstances, such as works "re-used" by the German government, or works under other or no commission, have parallel cases of a similar date that could be quoted as a rationale for deletion (I do not have these to hand, but I have little doubt that an IP lawyer in Germany could produce such a rationale). In the UK, "case law" is simply the distinction that a judge has made a ruling that sets an intentional precedent for future cases in an area that statuary law may not be sufficiently specific by itself. - There is no copyright transfer in Germany, therefore I fail to see any reason why you argue in this direction. Judges only interpret and apply the existing law to the facts before them, thats something you can do too, the burdon of proof that the law is wrong or not applicable in this cases is with you, the uploader. The court LG München I mentioned in ER I Gs 558/09 that the copyright in articles in government magazines would be still intact if the publication wasnt anonymous. Copyright infringement however is an Antragsdelikt in criminal law and public law decission are rarely published if a court is even involved, cases will likely end in settlement. So ignoring the law and strictly demanding court decisions in a non-case-law country is absurd.
- Second, you are quick in concluding that this are government commissioned works. Although it doesnt matter for copyright - no transfer as said before - I would be interested in hering of some sources for your information. I worked some time now with this files and a lot of them is obviously not related to the government and not published by government bodies.
- Third you conclude that the posters are PD in the UK, you base this assumption on their status as government comissioned works in WWI and therefore seized enemy property. Thats not true for some files: some are not from the government, some are from the post-WWI time (labled at the LoC as such, but this information got lost in this LoC fork).

- I do not understand your point about Germany not having case law. Could you provide a link to somewhere that explains this, I have difficulty believing that all interpretations of the German legislative corpus require an act to recognize them?
- As for your other points, (a) surely there is copyright/IP transfer in Germany as in any EU country, otherwise the music and film industries would break down (b) I have made a point about Government commissioned works, some are, and some are not (c) if the LoC are mis-identifying material then we need to have volunteers do a bit of "triage" this end to establish their status, this need not happen in a DR considering the age of the material and a lack of any current claim of copyright or challenge over the past 100 years.

- I don't think the LoC had mis-identified these. But the LoC only cares about the copyright status in the U.S., where these, having been published prior to 1923, are indeed PD. The Commons, however, cares about the copyright status in the U.S. and in the source country, and as far as I know, in the source country these are not PD. So, whenever you take a non-US work from the LoC, you have to question any statements the LoC may make about copyright and evaluate the copyright status in the source country yourself. - It also doesn't matter whether these were commissioned or not. Copyright in Germany and Austria (and the EU in general) runs for a term based on the death year of the artist(s), even if the economic rights had been "transferred" or exclusively licensed to a third party. The initial copyright holder is the physical person creating the artwork, even if the work is created as part of a contract (such as commission or employment) and the economic rights are then immediately signed over to the commissioning body/employer. There is no special term for "works made for hire"; in fact, this concept is unknown in continental European copyright laws. There is no "transfer" of copyright; continental European droits d'auteur differ from U.S. copyright. - I wrote "continental European copyright" because I'm not sure about the UK. For a source, see e.g. [32]. You cannot transfer the "copyright" ("Urheberrecht") except by inheritance; you can only license exploitation rights ("Nutzungsrechte"). See also UrhG §28ff: "Das Urheberrecht ist vererblich." (§28), "Das Urheberrecht ist nicht übertragbar, ..." (§29, except in things dealing with inheritance), "Der Urheber kann einem anderen das Recht einräumen, das Werk auf einzelne oder alle Nutzungsarten zu nutzen (Nutzungsrecht)" (§31, licensing exploitation rights). - If it is irrelevant, I am unclear why you raised it. What we see is that in Germany, based on the law you have referenced above, an artist can licence all economic rights but normally retains a right of attribution. This is very similar to the Open Government Licence which licences material for free reuse but requires attribution with no expectation of economic rights.
- Nobody has found a source that clarifies the IP status of WWI works commissioned by the German government (such as war loan posters). An example contract would be nice to find, there probably are examples in historic war archives.
- Again, I have not said that all of these should not be deleted from Commons, on the basis that we cannot dot the i's or cross the t's to satisfy every possible hypothetical scenario, which is how PRP seems to be interpreted for 100 year old posters right now. However, if these are removed, they should all be transferred on the English Wikipedia as public domain. - The source that clarifies the IP status of WWI works commissioned by the German government is the law, there is no easy to find source that disproves your idea because the idea simply not exists. If the government gets a license from the author then this means the government can use the work. It does not mean that you can do something with the work or anyone else who is not a license party. But the basic concept of Commons is that content is free for use by anyone.
- Making a transfer to wp cant be seen as conditional for the closure of this request. The material is still availiable at LoC, Commons is not the primary source of publication, so with deleting here nothing is lost. - I already referred to the sources you quoted, I just read the text of the legislation as written, the summaries are quite short and simple. If you wish to compare to {{OGL}}, the links are in the template.
- Just to clarify the parallel, it seems obvious to me but I have worked with military material for a while. Crown Copyright has been moving over to Open Government Licences as part of Open Government initiatives. OGL was specially introduced as a means for the Government, its departments and agents, to release material produced for the public benefit without the complexity of Crown Copyright which may not be free to reuse. The artists retain moral rights in the work and attribution may be specified explicitly on release. In all other regards the material is public domain. The parallel for DE Government material from WWI is that the government would have commissioned the works with full rights to the state, though from the descriptions in the Civil Code, it seems that moral rights would have invariably stayed with the artist (unless anonymous). We are in the situation where DE Gov rights have long since expired (100 years having passed) and we can presume all financial claims along with them. The estates of any artists that died less than 70 years ago might pursue the moral right of attribution, but it seems highly unlikely that any case could be made to pursue financial rights (for example against the Library of Congress or institutions that republish that material). Where Commons gives an attribution to the Artist, we can demonstrate we have made reasonable effort to comply with moral rights claims, and there is nothing else we need to do to avoid the significant doubt that PRP is there to address. --Fæ (talk) 14:53, 6 June 2014 (UTC)

- That's an important distinction to make here; one that may not be clear to people more accustomed to the different copyright tradition of the UK or the USA: According to German law, there is no such thing as copyright transfer except through inheritance. The "Urheberrecht" (which is not exactly the same thing as "copyright", though often translated as such) always remains with the creator or their heirs, and its duration is always determined by the creator's year of death. Even if a work is committed by the state and the state gets an exclusive licence, the work is still protected for 70 years after the death of the creator. - That said, I don't know whether the KUG of 1907 may be still of some relevance for older works. In the source country (Germany/Austria) the first group is copyrighted, plain and simple; and those of the second group (unknown death year of artist) should go per COM:PCP. I indented this 9 files. The 2nd nomination also includes 5 files where I already found authors or hints to the author in other online archives. One of that 9 files from not yet researched artists is File:Die Kriegsgefangenen kommen! ... Lassen wir sie nicht im Stich! LCCN2004666182.jpg which might be ineligible for copyright. I indented this 9 files. The 2nd nomination also includes 5 files where I already found authors or hints to the author in other online archives. Regretably I have no access to offline / print collections of this posters although such collections exist. And I have not much literature about propaganda in WWI, Novemberrevolution or local elections 1918/1919 and the propaganda of the various lobbies involved there - parties and organizations such as the Antibolschewistische Liga. --Martin H. LCCN2004665995.jpg (and its TIFF) with {{PD-US-1923-abroad-delete}}. Let's see whether User:Commons fair use upload bot is still active, and what exactly it does with these two files...
