Sofia Golovkina died in 2004 aged 88. In this photograph Golovkina appears about 60 to 70 years old, making this photo likely to have been taken within the last 40 years. The photographer is declared as unknown so no valid rationale for the licence has been provided and unless a source or better provenance can be given, this fails to meet the requirement of Commons:Licensing. For example, Alan Light is present on many of his photos, but the authorship was never questioned.--Carniolus (talk) 14:42, 25 March 2014 (UTC)

- (I must say I'm a little surprised that a representative of a publicity firm would think it's okay to take a photo from Getty Images and claim to have created that photo personally.) What's required is that you obtain permission from the legitimate copyright holder to publish the photo under a copyright license that allows anyone to use the photo in modified or unmodified form for any purpose, including commercial purposes. You then need to send in evidence of that permission to our permission archive. The copyright holder is normally the author, which means the photographer, rather than you or the subject of the photo. Only the legitimate copyright holder can issue a valid copyright license. —LX (talk, contribs) 22:21, 25 March 2014 (UTC)

Freedom of Panorama in the US does not apply to sculptures. Sculptures are the subject of the photo and not de minimis. Going by quality, appears to be taken from a photocopy. User's only other upload was of (PD) AIGA symbols- also apparently from a photocopy- claimed as "own work". That wasn't, and this probably isn't either, except that in this case the icons *don't* clearly come from a set in the public domain. These may be flat, but they still required artistic input and skill to create, so I don't think they can be claimed as free on the "simple shapes" basis either. [edit]The photo File:Josue Sanchez Chongos Altos.jpg is an interior shot taken inside the church at Chongos Altos in 1970.
The other four files are photos of paintings that I purchased from Sanchez in the 1970's and are currently hanging on the wall in my study in the USA.

- Yes, you bought the paintings, but you didn't buy the copyright. The images have to be deleted if you cannot provide a written permission by the artist (or his heirs in case an artist should not be alive anymore) to license them with a free license. --AndreasPraefcke (talk) 17:56, 25 March 2014 (UTC)
I'm not going to contact Sanchez after 45 years.
[edit]When he sees they are missing from his wikipedia article, he can upload photos of his paintings to Wikimedia himself if he wants them on Wikipedia.
Best Regards,
Hugh Pickens

{{PD-old-50}}-fail as this photo (taken in 1944) is most likely a Brazilian work (which has 70 pma). Most likely a private photo which - configured alternatively with {{PD-Brazil-media}} (+70 +1 years disclosure) - would be copyrighted at least till the end of 2014 (+COM:URAA-problem). Eventual also {{PD-BrazilGov}} ("published or commissioned by a Brazilian government (...) prior to 1983") but no evidence available to support this claim. Source is a random blog. Original disclosure date is unknown. Gunnex (talk) 07:27, 25 March 2014 (UTC)
- Unfortunate, but I agree - Delete and Undelete in January per {{PD-Brazil-media}}. Photo was made on April 28th 1944, disclosure can probably be assumed to be during 1944. It would be nice if we could find that it was an official war photographer's photograph, and {{PD-BrazilGov}} might apply, but I can't find any evidence of that, or even who the photographer was. no permission. Author: ca:Oleguer Junyent i Sans (1876 – 1956). 91.64.240.231 08:07, 25 March 2014 (UTC)
- Comment I've tagged the image as {{PD-Art|PD-1923}} as it was published in 1917 - so it's PD in the US, but it seems not PD in country of origin (Spain).
Unfortunately, looks like {{Vd}} and Undelete in 2027.Storkk (talk) 10:35, 2 April 2014 (UTC)Switching to {{Vk}}- apparently there is an exception to the rules that images must be free in both the US and the country of origin: Commons:Policy_on_photographs_of_old_pictures#Other_countries. Storkk (talk) 10:44, 2 April 2014 (UTC) - Comment In fact the policy refers to "faithful reproductions of two-dimensional public domain works (...) considering that "a mere mechanical reproduction of some other image, such as an unmodified photocopy or scan of a drawing, cannot attract additional copyright protection over and above that of the original, as it lacks originality: it is a bare copy, no more." The original is not yet in public domain in it's source country and appears to be still copyrighted (70 pma) till the end of 2026. Gunnex (talk) 08:05, 5 April 2014 (UTC)
- I think I have to agree, having read it for the fifth time. I was misled by the summary: "Nevertheless, under Commons rules the {{PD-Art}} tag can be used for "faithful reproduction" photographs of 2D public domain works of art even where copyright might be asserted under local law in the source country." In my view, that is not the most accurate representation. Storkk (talk) 16:00, 7 April 2014 (UTC)

Commons:Freedom_of_panorama#United_Kingdom does not apply to two-dimensional artwork, unfortunately. Storkk (talk) 18:40, 25 March 2014 (UTC)
Keep This is a three-dimensional work. It is not a painting; the paste is built-up from the paper surface.Wmpearl (talk) 06:14, 29 March 2014 (UTC)
- Question It would be good if we could get some guidance on how three-dimensional a three-dimensional work has to be to be covered by FOP in the UK. For example, a glued collage of photos would seem "more three-dimensional" than this looks - would that be covered by FOP UK? Most oil paintings would also fall into that category, it seems to me. - It's a little unfortunate that you didn't seem to look at Commons:Image_casebook#Costumes_and_cosplay. That would seem to save File:Darth Vader wearing traditional ukrainian clothes.jpg at least... AnonMoos (talk) 09:59, 10 March 2015 (UTC)
- No, I looked at it. I understand your comment, but the point here is that, although the overall "costume" in the Ukrainian case can be regarded as a "modified or original representation of a character" the issue here is in the Darth Vader mask. It's copyrighted, it's covered by COM:TOYS and cannot be regarded as a de minimis element within the picture. On the contrary. The picture is of course a modified representation, but keeps unmodified prominent elements of the original copyrighted element. I do acknowledge it's a border case, but not unfounded at all. --Discasto talk | contr. | es.wiki analysis 16:24, 12 March 2015 (UTC)
- If it's being actively worn by a person in a manner like an article of clothing, then: 1) It's a little dubious whether it can be called a "toy" in the most useful meaning of the word. 2) Its "utilitarian" function is specifically not copyrightable under United States law. The image may end up needing to be deleted in the end, but I wish you would stop throwing the word "toy" around, because I don't think that it clarifies any issues in this case. AnonMoos (talk) 00:53, 13 March 2015 (UTC)
- Good point, but don't blame on me but on COM:TOYS. It explicitly mentions the Darth Vader example. If the Darth Vader mask is a "utilitarian" object, then it should be discussed there and not here, I guess. --Discasto talk | contr. | es.wiki analysis 08:44, 13 March 2015 (UTC)
- Delete all. According to [1], Stormtrooper helmets are copyrighted artworks in the United States (but ineligible for copyright as utilitarian objects in the United Kingdom). As the helmets are unfree in the United States, we can't host any pictures of them. --Stefan4 (talk) 11:55, 13 March 2015 (UTC)

- The diagram on Derivative works explains that a picture taken in country where the freedom of panaorama is allowed can be uploaded under a free licence. - According to Christian Ferrer (an administrator), "FoP could apply if it was the first publication/creation, however the person who made the graffiti made a DW of a copyrighted character, the owner of the former character still have rights on it" from Com:Deletion_requests/File:Mazinger_Z_Sabadell.jpg. Therefore, these are files to deletion as COM:DW of copyrighted characters. --Yuraily Lic (talk) 03:08, 16 September 2019 (UTC)
- Yes because the graffiti is a DW, but for example, the picture File:Gateway to space 2016, Budapest, Darth Vader.jpg was taken during a Star Wars exhibition. So the Darth Vader costume here is not a DW, it is an original copyrighted costume and mask, so it is a 3D artwork, like a statue. So the FoP must be applied here. --Cody escadron delta (d) 12:35, 16 September 2019 (UTC)

- Thanks for the copy/paste answer, it's always a pleasure to speak with a robot! Anyway "mass deletion request" are meaningless, most of these pictures, 24 exactly are in the same case than the spiderman costume : Commons:Deletion requests/Images of costumes tagged as copyvios by AnimeFan/Mike Godwin mail. The answer of the lawyer Mike Godwin is clear : "Suppose someone dresses up as, say, Spider-Man, and has a photo taken. The photo is neither a copyright violation nor a trademark violation.", if we change spider-man by darth vader, we got the same case. Please make individual request and be sure you are not in a FoP or Spider-man case.

- Spider-man mask is copyrighted too and according to the wikimedia fondation's lawyer "the photo is neither a copyright violation nor a trademark violation". It seems the pictures deleted by Ellin Beltz showed toys and not a person "dresses up as" Darth Vader. Do not forget that an administrator can be wrong, they are not all-knowing. --Cody escadron delta (d) 05:47, 24 September 2019 (UTC)

- Here another mail by Mike Godwin about costume :
- “I do not see a legal justification for removing the images we are discussing here. It is common for photographers to take pictures of people in costumes of copyrighted and/or trademarked characters. In general, such photographs are understood as lawful.
- I believe the deletion of the photographs you were talking about was unnecessary, and that this represents a too-conservative worldview with regard to the applicability of copyright and other intellectual property theory.
- Feel free to reproduce this e-mail on-wiki.”
- The mail can be found here : Commons:Deletion requests/Images of costumes tagged as copyvios by AnimeFan#Comment by Mike Godwin.
- So every pictures that are showing a costume, or somebody wearing a costume, should not be deleted because it is not a copyright violation. It is a different case for pictures that are showing statues or toys.
