No details of what page this shot was used on at Luke Ford provided. Luke Ford had a lot of shots located on his site, not just his own. The permission statement we have only covers the shots he himself took, and to my knowledge all the valid shots which were covered by the permission statement have already been scrapped and uploaded to Commons (either by myself or by Gohe007). Tabercil (talk) 23:35, 9 January 2014 (UTC)
- Nevermind, I did some further digging into the archives and found the page which details who took the shot here. You scroll down and it says the shot was taken by Mike South, so we can't use it. Tabercil (talk) 23:40, 9 January 2014 (UTC)

This is a modern sculpture, not permanently fixed (I saw this first in the UK during a temporary exhibition) and would not be covered by FOP in Denmark which is limited to buildings.
Please consider File:Ronmueck boy.jpg in addition to this file. Fæ (talk) 13:35, 9 January 2014 (UTC)
- The sculpture was shown 2000 at Millennium Dome London, Biennale 2001 and was purchased by Arhus museum 2002, http://en.aros.dk/the-collection/boy/--Oursana (talk) 13:45, 9 January 2014 (UTC)
- It's a great artefact, I have some of my own photos taken of it at the Dome but I doubt Mueck will give us a free release for his work. I note that File:Ron_Mueck_head.jpg uses Fair Use to retain an illustrative image of his work on en.wp. I see there are other Mueck works we have photos of, if you are spotting these, can you add them as a list on this DR? --Fæ (talk) 13:52, 9 January 2014 (UTC)

- Keep:
- «Low quality, motion blur.» Yes, but we don’t have a better pic of this notable person.
- «Unrecognizable main subject.» Oh, it’s all there, don’t worry. (We rely on metadata to enhance images’ identification all the time.)
- «without permission». Not needed, this is a public event. (All this guys does, shows up in public events and waves to cameras behind celebs.)

No source given for the borders, perhaps derived from a copyrighted work. And for the coats of arms and flags, I'm not sure they're all own work or even in the public domain. Eleassar (t/p) 19:33, 16 October 2012 (UTC)
- Greetings. I just added the source for the border, emblems and flags.--MirkoS18 (talk) 14:47, 20 October 2012 (UTC)
- Thanks for having done so. Unfortunately, I don't find any information stating that [2] is a free work. It seems that a copyrighted map was used, which makes this work a derivative of a copyrighted work and therefore ineligible for Commons. --Eleassar (t/p) 16:00, 20 October 2012 (UTC)
- I didnt take map from there, I just use their map as a source for borders on my map.--MirkoS18 (talk) 18:10, 18 November 2012 (UTC)

The International Sava River Basin Commission does not stand behind this photo and therefore requests its removal. VaKol (talk) 13:47, 9 January 2014 (UTC)
- Keep This project is not property of the commission; the map is educational and well-sourced. --Eleassar (t/p) 21:46, 9 January 2014 (UTC)
- Comment Nowhere is it claimed that Commission stand behind this photo. Frankly, I also think it is not the best map but I make it as useful tool (in accordance with my ability) and should be keep unless someone from Commission or some more experienced user with better equipment make a better map.--MirkoS18 (talk) 23:58, 11 January 2014 (UTC)
Kept: I'm not going to delete a file which is widely used because someone doesn't like it and per Eleassar. Natuur12 (talk) 18:23, 16 January 2014 (UTC)
The picture is not geographically correct, including both country names and borders. Description of the picture in summary is also not correct since not all the countries are the "members" of the Sava Commission. The .pdf file in the description does not contain this picture and yet it says it is the "map source". The Sava Comission would upload a proper map showing the basin overview but would still request deletion of this picture. Unfortunately, being easily available, this picture had been used in projects causing complaints to the Sava Commission. VaKol (talk) 12:10, 4 February 2014 (UTC) (original edit)
- Keep until we get a better map (preferably in the svg format). Though it may be incorrect at some places it is still better than no map at all. --Eleassar (t/p) 16:13, 4 February 2014 (UTC) (original edit)
- Comment Nomination and initial comment by Eleassar moved here from malformed nomination at Commons:Deletion requests/Commons:Deletion requests/File:Sava River Basin.png. Links to original diffs are provided. Эlcobbola talk 20:35, 4 February 2014 (UTC)
Kept. This map is widely used. It is Commons policy that maps that are in use may not be deleted for any reason other than copyright violation. The creator does not say that the image came from the cited PDF -- he says that the map was his own work (except for the COAs) and that he used the PDF as a source of information. The Sava Commission does not own the information in its PDF -- the copyright covers only the words used to express that information, not the information itself -- so the the Commission has no right to complain.
This is the second DR posted by User:VaKol on this file with no different reason from the first. Please do not post a third DR or take any other action with respect to this file. Once is OK, twice is a nuisance, and three times would be vandalism. . Jim . . . . This image is clearly of the sculptural and architectural elements of the memorial (this is the Arras Royal Flying Corps Memorial, with the surrounding elements part of the Arras Memorial), so if French lack of freedom of panorama is enforced strictly, then this is a good example of an image that needs to go. I am still of the opinion that enforcing lack of FoP for long-dead architects and sculptors is needlessly cautious. In cases where the existing owners of any remaining copyright protection (be they the heirs of the original artists or the current owners of the site) are actively enforcing said copyright, then that should be respected, but I see no evidence that this is being done for Commonwealth War Graves Commission memorials in France. Would it help to directly ask the CWGC what the copyright situation is, and if there are any restrictions on photographing their memorial sites in France, or would the questions need to be more explicit? Derivative work: photograph of contemporary (2002) medal Эlcobbola talk 22:23, 9 January 2014 (UTC)
- What's the problem please? This is a scan of a medal that is in my personal collection. If you found it somewhere else, check the name of the person who uploaded it in the OMSA database or in the GMIC personal galeries, you will see it was also me as I own the copyright and can upload it where I like. Fdutil (talk) 23:19, 9 January 2014 (UTC)
- See COM:DW. There are two copyrights: 1) the medal and 2) the photo of the medal. You may have taken the photo, and you may own the medal (mere physical property rights), but the medal's creator retains the intellectual property rights and thus his/her permission would be required to license this image freely. Эlcobbola talk 23:28, 9 January 2014 (UTC)
- OK... I'll take it you're new at this. Been down this road before, unfortunately. Are you saying that every single photo of a contemporary medal on Wiki that isn't accompanied by a letter of permission from it's original creator/designer is to be deleted? If that is the case, you're looking at thousands of deletions from thousands of articles, just in phaleristics. If this is to be the case, please let me know, so many friends think me completely daft for spending so many countless hours contributing to Wiki in hundreds of articles vice publishing my own books... I'm simply tired of these arbitrary actions... Think I'll just stop coming here. Cheers! Fdutil (talk) 23:50, 9 January 2014 (UTC)

Well?
[edit]So what is it going to be? Are you going to keep sporadically and completely arbitrarily doing this? If your argument is valid, then hundreds of thousands of photos on Wikipedia MUST be deleted post haste. In Phaleristics alone (look it up), on English Wiki alone, you're easily looking at 20,000+ photos to be deleted. Once you've done that, what's next? Toasters? Blenders? Tractors? Toilet plungers? Do you have any idea of how tiring and frustrating it is for people who donate thousands of hours of their time to Wiki and material from their personal property to have to go through this a few times a year... Fdutil (talk) 16:33, 11 January 2014 (UTC)
- The latter is false; copyright law does not protect utilitarian or functional designs like that (they save those for patents). Medals are considered to be three-dimensional artwork, please read COM:DW. ViperSnake151 (talk) 01:08, 13 January 2014 (UTC)

- On second thoughts Delete. The uploader says "These are pictures of my grandpa and we have the pictures at home but they are on the internet as well so I don't really know who took the picture." Since they are on the internet, this means could mean that someone else took this picture originally and the uploader has a paper copy of it at home. Since they don't know who took the picture, the real photographer could surface and claim a copyright violation too. Regards, --Leoboudv (talk) 08:48, 21 January 2014 (UTC)

Derivative work; photograph of stuffed animals (see COM:TOYS, etc.) Эlcobbola talk 22:27, 9 January 2014 (UTC)
- Keep For me, Wikipedia logo is de minimis and is not the main subject of the photo. Plus, these plushes has to be considered as convenience goods as they are not a derivative work of famous work of art like Star Wars or Astérix as mentionned in COM:TOYS. Happily, everything is not a work of art that shouldn't be freely shared. Obviously, these RfD is an abusive one. Pymouss Let’s talk - 12:53, 10 January 2014 (UTC)
- "Copyright protection subsists [...] in original works of authorship fixed in any tangible medium of expression" (17 USC § 102). Stuffed animals/dolls/etc. are original works, have authors, and are fixed in fabric. Indeed, they are considered "soft sculptures" and are unambiguously copyrighted. Certain relevant court cases are:
- Superior Form Builders, Inc. v. Dan Chase Taxidermy Supply Co., 74 F.3d 488 (1995)
- Gay Toys, Inc. v. Buddy L Corp., 703 F.2d 970 (6th Cir. 1983)

- R. Dakin & Co. v. A & L Novelty Co., Inc. 444 F.Supp. 1080 (E.D.N.Y 1978)
- The notion, further, that copyright only applies to "famous work [sic] of art like Star Wars or Astérix" is ridiculous and unintelligent. If true, it would deny copyright protection to all but large international corporations. Being "famous" is not a criterion in any copyright law and is contrary to common sense. This debate has been had before with ref to plaques in Coventry. Do look back through the archives as this is a precedent. This image shows a wreath at the base of the Arras Royal Flying Corps Memorial, with some of the name panels visible. The background shows some of the archways of the Arras Memorial, with the memorial/cemetery's Cross of Sacrifice visible at the far end. Some architectural elements are visible, but is this enough to trigger French lack of freedom of panorama here? The Crosses of Sacrifice were designed by another architect, Reginald Blomfield (1856-1942), so I believe images focusing on the Crosses of Sacrifice are OK. As I've stated on other nominations, I am still of the opinion that enforcing lack of FoP for long-dead architects and sculptors is needlessly cautious. The composition of this image was intended to show the full extent and size of the Arras Memorial and the war graves in the Fauberg-D'Amiens Cemetery (not all the graves are shown and the memorial itself extends some more off to the right). Clearly, the architectural elements of the memorial are enough to trigger French lack of freedom of panorama, but it is still galling that this is being enforced so strictly. These images were taken in September 2010, over three years ago. Has Commons always been this strict about things like this? I still find it very hard to believe that the original sculptors and architects, and their heirs, would be raising any objections to photographs being taken of war memorials such as these. The cemetery contains over 2,650 CWGC burials, the memorial inscriptions list 34,785 names of the missing, and the Arras Royal Flying Corps Memorial has nearly 1000 names. As I've stated on other nominations, I am still of the opinion that enforcing lack of FoP for long-dead architects and sculptors is needlessly cautious. In cases where the existing owners of any remaining copyright protection (be they the heirs of the original artists or the current owners of the site) are actively enforcing said copyright, then that should be respected, but I see no evidence that this is being done for Commonwealth War Graves Commission memorials in France. - Keep - was missing the obvious here. The architectural elements of the memorial are public domain since it is more than 70 years since the architect (Lutyens) died. The sculptural elements by Dick were for the Arras Royal Flying Corps Memorial (which is de minimis here). Carcharoth (Commons) (talk) 01:03, 16 January 2014 (UTC)

The composition of this image focuses on the Arras Royal Flying Corps Memorial (with sculpture by William Reid Dick). The surrounding architectural elements of the Arras Memorial were to a design by Edwin Lutyens, so as far as I'm aware the elements of that are OK under the rule of the 70-year term. But as the sculptor Dick died later, images focusing on the Arras Royal Flying Corps Memorial may be a problem. The Stone of Remembrance (in the foreground) was to a design by Lutyens, so that is OK I think. Clearly, the architectural elements of this image and the dates of the sculptor are enough to trigger French lack of freedom of panorama. It does seem a touch ironic that the Stone of Remembrance states "Their Name Liveth For Evemore", but later developments in French copyright laws means that rights to distribution and use of photography of the site are restricted until 70 years after the death of the artists - I'm still not convinced that those drafting such French laws intended them to apply in situations such as this. And as I've stated on other nominations, I am still of the opinion that enforcing lack of FoP for long-dead architects and sculptors is needlessly cautious. In cases where the existing owners of any remaining copyright protection (be they the heirs of the original artists or the current owners of the site) are actively enforcing said copyright, then that should be respected, but I see no evidence that this is being done for Commonwealth War Graves Commission memorials in France. - Keep. This is the English-language version of the inscription panel for the Arras Memorial and the Arras Royal Flying Corps Memorial. As far as I am aware, there are no restrictions on the memorial or its inscriptions. The architectural elements (minimal in any case) are by Lutyens and are now public domain. There are no sculptural elements by Dick in this image (he worked on the Arras Royal Flying Corps Memorial, a separate structure). The text of the inscription would have been provided by the IWGC (as it then was) and its literary advisor Rudyard Kipling (1865-1936). The memorial itself was unveiled in 1932, so that may count as a publication date for this text. Carcharoth (Commons) (talk) 01:32, 16 January 2014 (UTC)
