- I don't get the "no person of public interest" part either as long as there are articles on her, but the copyright situation seems unclear to me. I don't know what the OTRS ticket says, but who is it that really has the copyright? According to this website, it's the Deutsches Aktieninstitut. Keep if the OTRS ticket is in order (could an OTRS agent please check?). de:Christine Bortenlänger used this photo until recently when it was removed from the article only because it was nominated for deletion here. While OTRS #2013041310011781 does cover this image, it comes from a hotmail account, which makes it suspicious, and does not give a general license, merely saying " I own the copyright to the above image to be uploaded onto my wiki page". It is clearly neither "own work" of our uploader. nor is Tricia Walsh-Smith the author as claimed. - So far we have a license at OTRS #2013041310011781 that covers use only on Wikipedia and comes from a hot-mail account. As I said at my talk page (and, in summary, above):
- "The fact that it appears in several places on the Web does not mean that Tricia Walsh-Smith owns the rights to license the image freely and, in fact, she has not done so. Commons gets about 8,000 new images every day. About 2,000 of those must be deleted, for various reasons, including lack of a license from the copyright owner. 75% of that work is done by 10 Administrators. We have procedures in place to try to deal with the great volume of work in an orderly fashion. As it says at the Deletion Request, the problem with this image can be solved only if we get a license from the actual photographer using the procedure at Commons:OTRS." . Jim . . . . - Again, the license (such as it is) from Studio Venus in OTRS ticket 2013041310011781 says "to produce the enclosed images in any format." It does not say anything about your ability to license the images generally, nor does it say anything about commercial use or derivative works. As described at COM:OTRS, the photographer must provide a standard license such as CC-BY, not a vague statement. It must include a license for general use, not just "the above image to be uploaded onto my wiki page" as you said in the e-mail. All of this must be from verifiable sources, not hotmail. The use of an e-mail address at hotmail when Tricia Walsh Smith owns the domain triciawalshsmith.com strongly suggests that the e-mail is not valid, which is why I started this DR. Please understand that we get a lot of fans who try to convince us that they are the famous person and, while you may actually be TWS, so far this has all the earmarks of a fake, including refusal to follow our standard process, conflicting claims of authorship, and OTRS e-mails from hotmail, not the famous person's own domain. . The Wisconsin state senate is not part of the US federal government, so {{PD-USGov}} does not apply. There is no explanation as to why the uploader thinks the photo is "not copyrighted that we know of" (whoever "we" are) or what the supposed "explicit permission" covers. The OTRS permission is nonsense. It comes from a g-mail account and says that the sender is the son of Bourke-White and that the photograph was taken by his father. It seems unlikely that Bourke-White's son does not know that his famous photographer parent was his mother, not his father.
However, the lack of knowledge displayed by her "son" is not surprising. Bourke-White did not have any children.
More to the point, according to this site, which Yann found above, the photograph was taken while on assignment for Life Magazine and therefore the family does not own the copyright. Since Time Inc. is presumably getting a royalty for its sale as a poster, it seems unlikely that we could get permission. Jim . . . . Jameslwoodward (talk to me) 23:41, 9 March 2012 (UTC)

- The source site has an explicit copyright notice (which may, of course, be copyfraud if the image is actually PD).
- The description given on the image is quoted from the source site and is clearly a copyvio, which suggests that our uploader does not understand copyright.
- Given the internal evidence that it was taken after 1942 it is still under copyright and will be until URAA runs out.

- Delete The page doesn't tell where the image comes from. For example, it might previously have been published in a book or a newspaper with a photo credit. For that reason, we can't tell whether it is anonymous or not, and we don't know whether the photographer died before 1943 or not. Some might be old enough to be in the public domain, but since they show very famous people we'd probably already have high-resolution versions of those images. Then there are some book covers and other random stuff grabbed from the web.
