Ich habe das noch einmal nachrechiert: Es ist das richtige Gebäude. Es war etwas verwirrend, denn die Adresse lautet Kunihohstraße 19, das Gebäude steht aber in der Kohlbrennerstraße 19. The first version of the image must be deleted because it shows the car license plate number. For security reason and to prevent the possibility that the image is used by criminal organizations against the people in the image or against the institution. - Delete: The straightforward way this could be out of copyright in 2012 is if the author died before 1942, or the logo was created before 1942 and the author was anonymous/pseudonymous. But, in this case, en:Coleman Milne says (without citation) that CM was founded in 1953. Even if the logo was published in the first year, and the author remains anonymous/pseudonymous, the work would still remain in copyright until 1953 + 70 years, so the end of 2023. Sending to en.wiki with {{PD-ineligible-USonly}} makes the point moot, but a better version of the logo there would be preferred; this version has JPEG artifacts even thought it was converted to PNG. --Closeapple (talk) 16:42, 6 September 2012 (UTC)

- Crop or Move to English Wikipedia: There is a strong chance that copyright has expired on the "Watsonian" part of this logo. Anonymous/psuedonymous creation before 1942 (or death of a known author before 1942) would mean that copyright expired by 2012 in the most straightforward cases (per Commons:Licensing#Ordinary copyright). watsonian-1914-21.jpg via [1] shows what appears to be a pre-1930s copy of the logo, but it doesn't say so explicitly. But by 1936 different logos were in use instead: see [2] for instance. There are other examples of the logo not being used in the 1930s to 1950s, but I'll save it for a later nomination discussion. Suffice to say that there is a good chance that the "Watsonian" part of the image is pre-1936. The combination of "Watsonian" and "Squire" is almost certainly 1988 or later, though, so the solution here is either to crop it so that only "Watsonian" exists, or move it to en.wiki where {{PD-ineligible-USonly}} makes the point moot. --Closeapple (talk) 16:17, 6 September 2012 (UTC)

Our teacher, who took the photography, gave the negative to my parents when she retired. So, it is clear, for me, that she implicitly abandonned her rights to the photography to my father and mother, who gave it to me. I have no intention to delete this image. But there seems to be something fishy here. The image was uploaded first to :de by :de:Benutzer:FluestererMD who was active only for 2 days in March 2010. The image was obviously correctly sourced to the German website fluesterer.com, which is owned by Mathias Sichting. However, I can't see any evidence for a permission from the website or Mathias Sichting. In addition, in the EXIF "Lars Frohmueller" is named as the photographer, whereas the image description provides "Mathias Sichting" as the author. -- Túrelio (talk) 07:48, 6 September 2012 (UTC)

Empty category: The church's common name is in German, not in English, therefore it's sensible to call the category "St.-Bonifatius-Kirche (Lingen)", not "Saint Boniface Church (Lingen)" as done till now. I take charge for the digital communications at Dixy and since this is the company page we thought it would be inappropriate to keep the old store picture. Dixy respositioned themselves several years ago and Dixy stores look very different from the one in the picture now. We at Dixy really want to get away from the old image associated with the soft discounter format (you know cheap stores). So could you please delete the current picture - the stores really have a very different look now.

- The National Portrait Gallery presumably claims copyright for scanning the image. Commons doesn't recognise such claims. The photographer died in 1933, so this image is in the public domain in the United Kingdom (as {{PD-old-70}}). However, there is another problem: Commons images also have to be free in the United States. Given that the photo is a photo of two princesses, it is quite possible that the image is a work of the British government, and in that case it is indeed free in the United States (as {{PD-UKGov}}). However, if it is not a work of the British Governmnent, it is copyrighted in the United States for 95 years since the first publication of the photo, and thus still copyrighted in the United States. Without more information about the photographer's employer, I think that we will have to Delete this image as unfree in the United States. --Stefan4 (talk) 19:19, 6 September 2012 (UTC)

Relaying a request from the cheesemaker on the French-speaking Wikipedia, where the picture is used:
I can only find that everyone publishes pictures and products as they see fit, without asking the shepherds (i.e. me in this case) anything. Please remove this picture as well as the article pertaining to Mr Guillaume Acquaviva's cheese. At the very least, we should have been asked. Thanks in advance.
The picture represents a locally-made and locally-sold Corsican cheese. It's used on the article about the village where the cheese is produced; the cheese probably has no notability outside of this specific area. Several issues here:
- the drawing on the label is probably copyrighted;
- the label mentions a name, address, and telephone number — while there is no privacy issue as this is a product label, I think it's fair to say the cheesemaker doesn't expect the information to be published in the whole world;
- apparently the cheesemaker complains on personality rights/trademark grounds — I'm not sure this holds much water.

Incomplete image of a building (cinema?) in Edinburgh, focused on the copyrighted film poster (and/or film characters) of en:Brave (2012 film). IMHO, not a COM:DM-case. Per file name "'Brave' cinema advert, Edinburgh 2012.JPG" and intention of photographer, adding the image 4 min. after upload to the article about the film, I would consider, citing COM:DM: "It may be relevant how the image is described or classified: it will be difficult to argue de minimis if the photograph is described as illustrating "an advertising poster"". I'm quite surprised that anyone would find this photograph controversial in terms of a possible breach of copyright. I have photographed a cinema building displaying an advertisement, something that has been done countless times in the history of cinema since about the year 1890. I would argue that this is an accepted practice. Think of the historical images you have seen of posters on cinemas showing "The Jazz Singer", "Gone With The Wind" etc. (In fact, numerous examples are currently on public display in an exhibition on Scottish cinema being held in the National Library of Scotland in Edinburgh.) Such photographs are historical documentation and the copyright is held by the photographer e.g. a newspaper. I honestly don't believe I'm breaching the copyright of the film-makers or poster designer. The subject of the photograph is not solely the advert; it shows the film's prominence, almost as an 'event', and how the ad has been displayed. My motives were 1. to record the showing of that particular film in Scotland, and 2. to enliven the Wikipedia page visually. Many other films can be seen advertised within the image and I thought to myself as I uploaded it, "This is a really valuable source for showing what films were on in cinemas in Sept. 2012." Image is sourced to something called "spankingart.org," which appears to be a wiki on spanking (and not the child-rearing kind). I don't think that website is trustworthy enough to rely on their copyright release verification procedures. I'll grant you that those are copyvios, but it's not as if they're passed off as self-made. The architect is living. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). - That is correct, there is no FOP in Greece and on uploading this photograph I made no claim under Freedom of Panorama.
- This example of graffiti is not a community mural but a criminal act, defacing a government building on the main square in Sami. If the creator of this graffiti were to attempt a claim of copyright, they would in the process publish their legal identity and expose themselves to prosecution by the Greek government. I believe this scenario creates an exception under Greek law, as a claim of copyright cannot be made where this would result in direct benefit from a criminal act. Consequently there can be no claim of copyright for this graffiti as a creative work. The only tangible or realistic copyright here is my photograph which has been released on the license stated and there is not that "significant doubt" that would be needed under the precautionary principle to justify deletion due to concern for the potential copyright of the original

- The consideration should be under Greek law, however there are no prior cases in that country that one would refer to (of a graffiti artist claiming the benefit of copyright for their works when created illegally), as far as I am aware. Commons:Image_casebook#Graffiti (which I didn't think to check - I suggested renaming that page because I'm sure the name contributes to me forgetting about it...) suggests any copyright on illegal graffiti may be hard to enforce, even if the law recognises it in principle. And the law isn't necessarily clear (see eg here for US). So... it seems to be considered an exception to COM:PRP, because it's so unlikely that copyright would be successfully enforced. But: there should really be a tag for such cases, to make it clear that the issue of the underlying copyright has been considered, as well as for tracking. like er {{Non-free graffiti}}... - I think this is the wrong point. We need to assess if there is "significant doubt" here or not. Very theoretical arguments which are not based on any past enforcement of copyright or any concrete case law cannot be considered significant doubt. To clarify, there has never been a legal case where someone creating illegally placed graffiti has sued re-users of a photograph of that graffiti regardless of the artistic content of that graffiti. There have been tangential cases (such as cases raised by the property owners to keep the graffiti against action by local government) but these do not set a precedent to determine if the graffiti artist has an enforceable or recognized legitimate copyright that would either hamper photographers of the work or the later re-use of such photographs.
- Commons should make a reasonable judgement on photographs based on existing interpretation of copyright law that we can support by example cases. If we go off on hypothetical tangents in order to find incredibly weak and unsubstantiated reasons to delete images, then our mission to preserve open knowledge and as a consequence social and cultural history, is seriously under threat by wikilawyering ourselves out of any useful existence. --Fæ (talk) 08:07, 13 September 2012 (UTC)

- The main idea of COM:CB#Graffiti seems to be that it is usually impossible to prove that you are the artist. If you tell someone that "I drew this", then you would probably also have to present some evidence for the court that you really are the artist if you wish to claim compensation from a potential copyright violator. Compare with the usual situation of copyright violations on Commons: if you upload a random photo from a random website to Commons, no one will trust you if you say that you took the photo, and you need quite good evidence (via OTRS) if you want the picture to stay. If you have some random, anonymous street art, it might turn out impossible to prove that you are the artist. Thus, COM:CB#Graffiti seems safe for most anonymous works.
