FP Promotion question
[edit]- Congrats for your picture. Not just this one, but I like your images in general. BTW, I'm not sure if you noticed: File_talk:Plafond de la chapelle des Maccabées 3.jpg. Good news if they (SSPBC) start using Commons images. If you care (and for future images), it might worth explaining them how to link them. I started Category:Cultural properties of national significance in Switzerland, but it's likely to take some time until it will be of use to them. -- User:Docu at 12:10, 10 January 2010 (UTC)

No response on permissions-nl@wikimedia.org
[edit]Dear Yann, please could you tell me what I have to do? About one month ago I asked for a ticketnumber on permissions-nl@wikimedia.org for a photograph I wanted to add to Category:Athletes from the Netherlands. Although I repeated my question several times, I never received any answer. This never happened before, because up to now handling these questions always went smoothly. I hope you can help me out. Re: What is this? (Thunderstorms on the Brazilian Horizon)
[edit]Dear Yann, the photograph was taken from behind a window so it could be some kind of artefact caused by light passing through the glass. It could be a reflection from the sun or from some other light source, but I don't really know. I don't suppose you know of any way to remove such artefacts? Time magazine cover
[edit]Hi,
You once deleted File:Time 1933.jpg. It now exists in the English Wikipedia as en:File:1933 Time Man of the Year cover.jpg, listed as {{PD-US-not-renewed}}. If i understand correctly, the files under Category:Time Magazine covers are in the same situation.
So, is it possible to upload en:File:1933 Time Man of the Year cover.jpg to Commons? Or should the files under Category:Time Magazine covers be moved from Commons to en.wikipedia?
Thanks in advance. --Amir E. Aharoni (talk) 14:47, 20 March 2010 (UTC)

QI reviews
[edit]Bonjour !
Bien cordialement, --Jebulon (talk) 17:24, 30 August 2010 (UTC)

Bonjour,
Cordialement--Bapti ✉ 08:33, 3 September 2010 (UTC)
Bonne continuation.--Bapti ✉ 09:10, 3 September 2010 (UTC)

- I have answered there, and on his talk page. Most of the time, small thumbnails of pictures of people are copyright violations. Beside there are no EXIF data any more, which makes his claim suspicious. Regards, Yann (talk) 10:26, 8 September 2010 (UTC)
- Okay, thanks. I hope you have noticed that tagging such an image with "no source" is definitely not the best way to deal with this. Cheers --Saibo (Δ) 20:26, 8 September 2010 (UTC)
- Well No source here means rather Uncertain source. May be we need to reword the warning message. Yann (talk) 07:09, 9 September 2010 (UTC)
- The "No source" template is correct if there is no source. What you mean here is "Uncertain source"; for which it is best, in my opinion, to just ask the uploader why exactly you doubt the source given and ask him to explain e.g. why the file is that small or why the EXIF is missing. Cheers --Saibo (Δ) 17:25, 9 September 2010 (UTC)

Tolstoy Pics
[edit]The first 2 pics on the Tolstoy page are of Leo Tolstoy's oldest son, the sculptor Lev Lvovich Tolstoy (see Wikipedia). From the look of his clothing and age the date is most likely 1920-25. The reason this image was originally labeled Count Tolstoy is that the title is hereditary, and as the oldest son Lev Lvovich became Count Tolstoy in 1910. Please don't change the captions. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues. |

Could you please explain to me how the precautionary principle is not a "valid reason for deletion" and/or point me to some examples of how the precautionary principle is actually applied in practice? Alternatively, an explanation of how my legal reasoning was invalid would be equally appreciated. VernoWhitney (talk) 12:35, 23 November 2010 (UTC)
- Would you be so kind as to answer my question? VernoWhitney (talk) 13:10, 29 November 2010 (UTC)
- I'd still appreciate an answer, unless you're purposefully ignoring me. VernoWhitney (talk) 14:26, 1 December 2010 (UTC)
Jacqueshb (talk)
This image was donated to the Commons by the creators of the original work, and this was clearly indicated in the file information. PLEASE try contacting the uploader before you delete files. I realize you're not a newbie, but this only makes your action even more weird and difficult to understand.
I will proceed to upload the image once again and add it to the relevant article(s). — Preceding unsigned comment added by Uspn (talk • contribs)
- I think we probably need a written permission sent to OTRS for this file. Yann (talk) 06:48, 30 November 2010 (UTC)
- There is a mention of the licensing on the site and I've added a direct link to the missing information. Thanks for pointing out the lack of information on the Commons page. Uspn (talk) 22:28, 30 November 2010 (UTC)
Thank you for the feedback on Commons:Valued image candidates/Hamandir Sahib (Golden Temple).jpg
[edit]Hi,
Thank you for your feedback on my submission to the “Valued image candidates”. I am new here and I see that you (unlike me) have a lot of experience and I highly value your feedback (hopefully over time I'll learn as well). I have replied (on the image submission page) – please let me know if it makes sense or if perhaps I misunderstood the description or rules (which can happen). If you still disagree, please help me with a suggestion what would be a preferred/suitable scope for the image? Thank you for your time and interest in helping me to learn Wikicommons! --Oleg 22:31, 14 December 2010 (UTC)
- Hi again,
- Thanks for the suggestion of the new category. I have changed the category. If possible, please kindly re-vote. Thanks! --Oleg (talk) 18:38, 15 December 2010 (UTC)
Any information on Paul Gavelle?
[edit]Hello! I'd like to know if you could, perhaps, have any information regarding a photographer, who was probably French, called Paul Gavelle, who worked in the early 20th century in France. I believe he took photos in Eu. Thank you very much! Kind regards, --Lecen (talk) 05:38, 21 December 2010 (UTC)

[edit]Hi, you deleted the uploaded logo of a serbian newspaper. Now i'm asking myself, why the other logos are not deleted? For example of the New York Times? Greetings--Bukephalos (talk) 15:31, 21 December 2010 (UTC)
Since you of all people closed the deletion request again, would you care to actually explain your "No valid reason for deletion." comment? VernoWhitney (talk) 16:12, 21 December 2010 (UTC)
- I was not and am not arguing. I am asking for an explanation which you have still refused to give. I'd still like to know what policy and relevant copyright law you feel I am missing since I felt I explained myself fairly thoroughly. To be clear, I don't have an issue with the image being kept since it was finally asserted that the uploader was the photographer. What I'd like to know is why your stance seems to be that the image should have been kept even without that assertion since you didn't even reference it in your closing statement (and it was not mentioned in the first DR anywhere). VernoWhitney (talk) 18:29, 21 December 2010 (UTC)
- Would you please at least try to explain your decisions? I was under the impression that admins were supposed to "help users when they request it, or point them to someone or somewhere else where they can get help". VernoWhitney (talk) 15:28, 6 January 2011 (UTC)
- There cannot be any other copyright holder than the camera owner, unless there is a common agreement than the photographer take the photo for himself. It is so obvious and common sense, I cannot imagine that you want to argue something else. Yann (talk) 15:52, 6 January 2011 (UTC)
- Thank you for answering. So you're saying that if I loan my camera to a friend who takes a picture of me then I hold the copyright? Is this also the case if I loan my camera to a friend who, for example, travels to a different country and takes pictures completely unrelated to me? VernoWhitney (talk) 17:01, 6 January 2011 (UTC)
- For me it depends if he takes the photo for his own use, or for yourself. If it is for yourself, it is similar to a work for hire: you ask him a service. If it is for his own use, he owns the copyright of his photos taken with your camera. In this case, its self-evident that the photo is taken for the camera owner's benefit. If you lend your camera to your friend for his holiday, you give him a service. So a service is given to a beneficiary. It is quite common sense, that, unless it is formally decided otherwise, the beneficiary owns the result of the service, i.e. the photos, and the copyright which is attached to the photos. Yann (talk) 17:08, 6 January 2011 (UTC)
- Okay, I understand the common sense argument. Since we're looking at legalities though, common sense doesn't necessarily apply. Looking at http://www.copyright.gov/help/faq/faq-definitions.html the first paragraph tells us "[T]he creator of the original expression in a work is its author. The author is also the owner of copyright unless there is a written agreement by which the author assigns the copyright to another person" (emphasis added). Doesn't this contradict your common sense interpretation of the situation? VernoWhitney (talk) 17:37, 6 January 2011 (UTC)
- Intent applies. The creator of the work is the one who commissioned it and directed it. I hand an anonymous person a camera and tell them to take a photograph a certain way, I am the creator, the individual taking the picture is just in my temporary employ. The creativity of the photograph, done under my direction is primarily mine. Any minor adaptations resulting from the photographer is incedental. Bastique ☎ appelez-moi! 17:42, 6 January 2011 (UTC)
- If you control every creative aspect of the work then I see your point as they are only acting as a mechanical agent like a tripod and remote timer. I don't see that this would apply if you handed your camera to someone and simply said, "could you take a picture of us?" or similar, though, without any creative direction. Wouldn't anything that involves them providing the minimal creativity required for copyright make them at least co-author and thus lead to the copyright problem? VernoWhitney (talk) 19:47, 6 January 2011 (UTC)
- In this case, it is similar to a work for hire, as I have already mentioned above. Yann (talk) 19:50, 6 January 2011 (UTC)
- Okay, this might be getting to the actual difference of opinion here: Are you saying that the photograph actually is a work for hire or just that its similar and the copyright isn't the photographer's for some other legal reason? VernoWhitney (talk) 20:32, 6 January 2011 (UTC)

Hello Yann. You applied the no source tag on "File:年賀状-安眠うさぎ-縦.png". But this image seems to be the uploader's derivative work as shown in the summary and there are informations of the sources. What is the problem? --丁 (talk) 13:06, 22 December 2010 (UTC)
Thank you, but would you explain more? The Source1 is unneccessary, you think? --丁 (talk) 13:27, 22 December 2010 (UTC)
You whacked a licence request on that file. No worries about that. The file operates under the same licence as these. If there is a problem, delete them all of fiddle the things so that there is everything even. If you intend to delete the file, let me know a couple of days before. There is no link to a particular discussion page on the sticker you whacked on the file. OAlexander (talk) 15:37, 22 December 2010 (UTC)

[edit]I just noticed that file File:Douglas 1956 still.jpg was deleted from the commons, but I don't see that any warning tag was used to allow fixing the problem. Can you please check into this so that I can restore the image? Thanks. --Wikiwatcher1 (talk) 20:27, 22 December 2010 (UTC)
- Thanks for restoring the file. I added more relevant PD information. If the file is PD per you satisfaction, could you remove the Deletion discussion tag, since it states the discussion is ended, and might confuse some. Thanks again. --Wikiwatcher1 (talk) 08:57, 23 December 2010 (UTC)

[edit]Bonjour, pourriez vous me debloquer ?

Deletion of "Honda Phantom Vehicle Inspection Checklist" or similarly named on 24/12/2010
[edit]Dear Sir/Mdm.
You removed my technical diagram (which I made) for the Honda Phantom motorcycle without warning, on the basis of "it is a non free screenshot". Please note the following.
1. This is NOT a screenshot. 2. This is MY work. 3. I created this diagram to aid in technical seminars for local motorcycle commuters. 4. Kindly note the person credited in the diagram. That's me. I'm sharing it F.O.C. for others' benefit.

Comment faire ?
[edit]Bonjour,
Cordialement, Yodan94

[edit]Please reopen File:Alfombras-Puertaalsur.jpg; it already passed one DR, with three users feeling it was worth being kept. Whether or not it is useful, it needs a full DR, not two hours on Christmas Day.--Prosfilaes (talk) 21:32, 25 December 2010 (UTC)

How dare you delete my contribution?
[edit]I saw you deleted my contribution (File:Dia Mirza.JPG), did you cross check the credibility and the reasoning of the person who added the speedy deletion tag?
Fanofbollywood (talk) 07:07, 26 December 2010 (UTC)
My apologies for my tone, however It seems nonsensical to me if someone out-rightly deletes contribution without even checking the case thoroughly. As far as permission is concerned look carefully, there is a link which goes directly to the website, for your convinience here it is - http://www.filmitadka.in/static/filmitadka-creative-commons-attribution-share-alike-license.html
Fanofbollywood (talk) 07:15, 26 December 2010 (UTC)
I reverted the tag because it was absurd on the very first place to add a tag on an absolutely proper image, and now I see that you have deleted other images as well, I don't know how are you planning to compensate me.
Fanofbollywood (talk) 07:18, 26 December 2010 (UTC)
Man I don't know is there a kid on the other end of the system, all I can say is instead of wasting my as well as your time, why don't you take up the matter at any appropriate platform (Discussion page) on wikimedia. For all I know, the website clearly states that a particular section region is available on that particular license and not the whole website. And for that matter this file here File:BACHCHAN Amitabh 03-24x30-2009.jpg as well says that it is copyrighted under the same license, but when I follow the source there it is written "copyright", what should I do, shall I add a deletion tag?
Fanofbollywood (talk) 07:28, 26 December 2010 (UTC)
Exactly, and in a similar fashion, follow that link which I provided you and there you have the written permission from this website, also I encourage you to go through the ToC, which clearly mentions that ToC is applicable only until something else is not explicitly mentioned, second thing is you said that "link is there or not it doesn't matter", well then what matters? There is written content, video content on the wesbite which is fully copyright protected, of course they can't remove that footer.
