Happy New Year!!

About those files

I want to say I'm sorry about those pictures. I thought it was ok to put a copyright claim on pictures that have no copyright because I've seen other users do it before. I don't want to cause problems, I want to contribute to the Wiki websites.

I was wondering if you could uphold them again and give me a week to credit the proper owners. I do have knowledge on those photos. For example, I can say for a fact that the Vic Darchinyan picture was taken on his fight with Joseph Agbeko on August 11, 2009.

What copyright template do I use for this situation?

Also, I have been talking to someone from Massis post (the people you credited with File:Hripsime Khurshudyan medal 1.jpg) and they are willing to let me use it. I instructed them on how to give permission to OTRS. If they recieve the permission, will you re-upload the photo? --TheShadowCrow (talk) 20:11, 30 December 2012 (UTC)

OTRS permission from the copyright holder/s is needed before the file/s can be restored. INeverCry 20:14, 30 December 2012 (UTC)
Can't photos with out a copyright claim be uploaded under a public domain/free tab without permission? Because there is no way for me to contact some of the owners. --TheShadowCrow (talk) 20:32, 30 December 2012 (UTC)
The owners automatically have copyright protection. INeverCry 20:37, 30 December 2012 (UTC)
Like I said, some of the websites don't have a contact option. Is there any scenario where I can upload a picture without contacting someone? --TheShadowCrow (talk) 20:45, 30 December 2012 (UTC)
We have to have proof that the file has been released under a free license by the copyright holder. INeverCry 20:49, 30 December 2012 (UTC)
Since you couldn't find the copy right owners last time, is that proof they have a free license?
I got some of these photos from the Facebook's of the athletes themselves. Does that count as them being released freely? --TheShadowCrow (talk) 21:01, 30 December 2012 (UTC)
Every image has an author and a copyright status. Facebook is a copyrighted source and states this directly. INeverCry 21:14, 30 December 2012 (UTC)
So if I credited the Facebook page would that be all I need do? --TheShadowCrow (talk) 21:19, 30 December 2012 (UTC)

No, because the images have no free license. INeverCry 22:19, 30 December 2012 (UTC)

Where does it say Facebook is a copyrighted source? Am I crediting the user or the website?
Also, I believe the website that posted the Vic Darchinyan picture has been removed. What do I do? --TheShadowCrow (talk) 21:13, 31 December 2012 (UTC)
At the bottom of each facebook page it says Facebook © 2012. As for the Vic D. image, if you can't obtain permission for its use, it can't be hosted on Commons. INeverCry 21:20, 31 December 2012 (UTC)
Am I crediting the user or the website and what tag is used for this situation?--TheShadowCrow (talk) 20:42, 1 January 2013 (UTC)
What situation are you referring to? INeverCry 20:44, 1 January 2013 (UTC)
Facebook photos. --TheShadowCrow (talk) 21:51, 1 January 2013 (UTC)
OTRS permission from the author/copyright holder is needed. INeverCry 23:12, 1 January 2013 (UTC)
Is that the Facebook user or Facebook itself? TheShadowCrow (talk) 02:02, 2 January 2013 (UTC)
The author/photographer of the image in question, or in some cases the person/s they've transferred copyright to. INeverCry 02:13, 2 January 2013 (UTC)

Adding OTRS tags

Please don't add the {{OTRS}} tag if you don't have access to OTRS, like you did with these four files. The ticket is not confirmed yet. Techman224Talk 21:52, 1 January 2013 (UTC)

I restored those 4 files per Commons:Undeletion requests/Current requests#Various images with OTRS permission. I figured if a trusted OTRS member is requesting restoration, than the ticket he gives would be ok. I think you should talk to User:Magog the Ogre about this. INeverCry 22:33, 1 January 2013 (UTC)
I just rechecked the ticket, and it's now confirmed. User:Magog the Ogre has changed the templates on the images. Just remember that only OTRS agents can confirm tickets. Anyone else that does triggers a filter. Thanks. Techman224Talk 00:41, 2 January 2013 (UTC)

Buggy script? --Leyo 23:22, 1 January 2013 (UTC)

I've had some errors with DelReqHandler over the past few days, where I have to reload the daily DR page, etc. Thanks for pointing out the above case. I've fixed it and the file talk. INeverCry 23:32, 1 January 2013 (UTC)
OK, thanks. --Leyo 23:39, 1 January 2013 (UTC)

You mistakenly deleted Raul Julia-Levy's image, citing I did not seek permission to use it. I own said image, which I have described. Please explain what I am to do to restore the image. Thank you. 71.107.254.84 03:17, 2 January 2013 (UTC)

OTRS permission from the copyright holder is needed before the file can be restored. INeverCry 04:11, 2 January 2013 (UTC)

Need a little help here

File:Natalie Wood publicity 1963.jpg. The problem is that the photo came from the Seattle Times, who has a habit of attaching a clipping of text from their paper and then stamping the back as copyright for the clipping. I do a lot of work with photos that come from this newspaper; Help Desk told me to obscure the text and remove the copyright stamp. Here's an example: File:Julie Newmar Catwoman Batman 1966.JPG. I can copy the back of this, obscure the copyrighted text and upload it if you'll delete the back of the photo that has the text on it. I don't see any issues with the photo itself. Thanks, We hope (talk) 05:14, 2 January 2013 (UTC)

Sounds good. Let me know when you need the old rev deleted. INeverCry 05:44, 2 January 2013 (UTC)
OK--have uploaded the revised photo back and added a note on the file about what was done. Thanks! We hope (talk) 06:10, 2 January 2013 (UTC)
I deleted the old version. INeverCry 06:53, 2 January 2013 (UTC)

Ask first, and then fire

Hello, you flagged File:Nalu Logo.png as a possible copyright violation, I am the owner of the copyright, and I did uploaded it to commons under a commons license, please talk to the person before saying they are violating copyright, I'll ask you to delete that banner from my page, thanks in advance. Dennis6492 (talk)

The logo comes from a website that states its copyright. Please send permission via email to OTRS. INeverCry 18:30, 2 January 2013 (UTC)
Done, I sent the email, here is the webpage http://surfnalu.grupos.usb.ve/ I'm the copyright holder and administrator, how long does it take to the email to be approved? Dennis6492 (talk) 18:44, 2 January 2013 (UTC)
I've added an OTRS pending tag so the file won't be deleted before the permission comes through. This could take a week or more. INeverCry 19:03, 2 January 2013 (UTC)
Ok, thank you I'll keep tabs on it Dennis6492 (talk) 19:06, 2 January 2013 (UTC)

Why are you deleting my photos?

Hey guy! The user http://www.flickr.com/photos/jeffersoncapuxu/6200872861/ is me, also http://www.flickr.com/photos/jeffersoncapuxu/6200894355/ (2011)) and also http://www.flickr.com/photos/egbertoaraujo/3730880744/, these are my older accounts on Flickr. http://omeucaico.blogspot.de is a blog made by my dad, he let me use Catedral_de_Sant'AnaC. jpg smoothly. So, why are you deleting my photos? Please, can you help me? — Preceding unsigned comment added by Eduardodantas16 (talk • contribs) 20:23, January 2, 2013‎ (UTC)

Please send an email to COM:OTRS confirming permission for the blog source. If everything checks out, they can restore the files that come from that source for you. As for File:Sao Bernado.jpg, it's All Rights Reserved on Flickr, as are the other Flickr images. This is unacceptable for hosting on Commons. If those are your Flickr accts you should set the images you want to upload to Commons to a free license instead of All Rights Reserved. See COM:L for license guidelines. INeverCry 04:55, 3 January 2013 (UTC)

How do I restore the files that you deleted?

You deleted this file which I uploaded and which has valid permission. The file is not even available for discussion to resolve. Even if you have some reason to doubt its validity, aren't you supposed to give notice before just removing the file? I am not an expert here and I find it very confusing to trace through what is supposed to resolve this. How do I go about restoring it?

— Preceding unsigned comment added by Joeentry (talk • contribs) 14:45, January 3, 2013‎ (UTC)

These 2 files were deleted per Commons:Deletion requests/Speedy deletion. One of these was deleted for being taken from an internet source, while the other was deleted for being a scan or photo of another photo. OTRS permission from the copyright holders is needed before the files can be hosted here on Commons. INeverCry 22:52, 3 January 2013 (UTC)
Both files are used with permission. There has to be a better way for this to work then for you to just delete the files without discussion. The first image WAS NOT copied from another website., Perhaps they got the file from the same original author. I do not not know where they got it, but the version I uploaded is legit. My question to you is how do we get it restored?

What do you mean that the second photo is a scan or photo of another photo? Is there another version in Wikimedia Commons? This is the best version I have and have loaded it with permission. If you have another version available that would be great. Otherwise this is the best version available to make public. How do I go about restoring these when you have deleted the source? I don't see any place to contest your actions. Please help.

Commons needs proof of permission. The copyright holder/s need to send an email/s to OTRS giving permission for these files. If every thing checks out, the files will be restored. INeverCry 01:01, 4 January 2013 (UTC)
I will have the necessary documents emailed. In the meantime, please restore these images and include a warning that the file will be deleted if evidence is not provided on a timely basis. That is a more appropriate treatment of this situation as waiting a week to go through this process is reasonable. There is no critical need to immediately delete this file without discussion.
These can't be restored until permission is confirmed through COM:OTRS. As for deleting the file without discussion, this action is covered by Commons:Deletion requests/Speedy deletion and COM:PRP. Hundreds of copyvio files are speedy deleted daily without discussion. INeverCry 02:47, 4 January 2013 (UTC)
You may have doubts, but that does not merit speedy deletion. What does it matter whether hundreds of files are deleted daily every day? I have no idea if you are making the same error with those hundreds, or how much time you are wasting by abusing and overusing the _speedy_ option. I'm sure hundreds of other files are marked for discussion before deleting by less aggressive moderators. I have told you that these are valid and should be restored. They should have been marked for discussion, not speedy deletion. I'm sure that knowing what you know now you would have posted a deletion request and not made it speedy.
I see that you're upset about these deletions, but there's no need to make accusations. Any actions I take here on Commons are done in good faith with the intention of upholding Commons policies. I stand by these speedy deletions, and I don't think the files should be restored until we have confirmation of free licensing. You have the option of posting an undeletion request so that another admin can look at these files. INeverCry 03:50, 4 January 2013 (UTC)
I am not making "accusations" other than saying you should not be making speedy deletions for these situations. You haven't explained why being a "scan or photo of another photo" would warrant removal or indicate the image is not a candidate for submission. The links you send do not have any mention of that. The process or submitting "proof" is very confusing and the fact that there is no longer any page for this photo in which I can reference my "Proof" make sit more confusing. I don't think you understand the amount of extra work and confusion you cause by doing it this way.
So why does a "scan or copy" warrant speedy deletion? And how now do I send proof when there is no file to reference? — Preceding unsigned comment added by Joeentry (talk • contribs) 20:25, January 3, 2013‎ (UTC)
These are the 2 file names you would reference:
  • File:Jim Metzger receives Joseph M. Margiotta Distinguished Service Award.jpg
  • File: James_Metzger_with_8_top_athletes_from_different_sports_-_Hofstra.jpg
File: James_Metzger_with_8_top_athletes_from_different_sports_-_Hofstra.jpg appears to be a scan of a print. It looks like a professionally taken team portrait, and so we need permission from the photographer who originally took the image. File:Jim Metzger receives Joseph M. Margiotta Distinguished Service Award.jpg can be found on http://underthebucket.com/college-lax-news/division-1/former-lacrosse-all-american-james-c-metzger-83-makes-largest-commitment-in-hofstra-athletics-history where it was posted on December 12, 2011, 7 months before you uploaded it. This means it is copyrighted by that website unless and until we have permission to host the image from it's copyright holder. I would advise you to focus on arranging for the permission on these files to be sent to COM:OTRS or, if you've done so, being patient while the email is processed. I hope this helps. Deletion of my 4 pictures of the ceiling of room XX at UNO-Geneva

Hello,

You are about to delete 4 pictures I have taken and posted on Commons of the ceiling of the room of the Council of Human Rights and Alliance of Civilisations at the UN in Geneva. I believe said ceiling was a gift from the Spanish Government to the UN in Geneva. FOP rules do not apply in Switzerland.

I have just sent an e-mail to Miquel Barcelo asking him for permission to make his work known to the world.

If my pictures are to be deleted, I kindly request that the following pictures be deleted too. They don't even mention the artist's name. The fact that they have been taken by the US Mission is no waiver for rules that apply to the vulgum pecus.

File:Esther Brimmer and Eileen Chamberlain Donahoe Listen to Debate at HRC emergency session on Syria (2).jpg

File:Human Rights Council Discusses North Korea.jpg

File:Human Rights Council Universal Periodic Review of Syria’s Human Rights Record, October 7, 2011 (2).jpg

File:Human Rights Council Urgent Debate on Syria February 28..jpg

and others.

Another of my pictures showing a publicly visible building in Luxemburg has already been deleted. I will try and obtain the green light of the architect.

If I manage to get an answer from Barcelo and from the architect of the building of the European Court of Justice, what do I have to do? Whom do I have to send the authorisation to?

Thank you in advance for your understanding and for your help

--BiiJii (talk) 17:57, 4 January 2013 (UTC) (Geneva)

Hi BiiJii. Someone else nominated those to be deleted. I only converted them from speedy deletion to a standard deletion request so that the issue could be discussed. You should definitely make the above comments at Commons:Deletion requests/Files in Category:Copyright violations at the bottom of the page. What is most likely needed is permission from the artist to be emailed to COM:OTRS. INeverCry 18:05, 4 January 2013 (UTC)

Please delete

File:Kps_logo.jpg

Hi! I can assure that this is the school's actual logo (as unoriginal as it is! - see www.kingedwardprimary.co.uk) and I uploaded it to the wrong place and without permission. I'd be really grateful if you would just delete it for me. Cheers! ukgegeluk :-)

Hi. The file may be ok to have on Commons. The question is whether or not it's design is original enough to be copyrighted. In any event, now that I've switched to a deletion request, we'll have to wait for the result. INeverCry 20:09, 4 January 2013 (UTC)
Being new at this, how long is that likely to take? I tried to change it to 'without permission' or something. I probably chose the wrong thing to say that it was a 'copyright violation' - it has just been published without permission of the owner. Please help! ukgegeluk
Deletion requests usually take 1 week. If the file doesn't meet COM:TOO, permission wouldn't be needed. We'll see what others think of it. INeverCry 20:27, 4 January 2013 (UTC)

Hi INeverCry, just wanted to alert you that File:Portrait of a Boy by Chaim Soutine, 1920s - Worcester Art Museum - IMG 7127.JPG which was in Category:Undelete in 2013 is being re-deleted - in fact it won't be out of copyright in France until 2014 and in the US until 2025. I placed it in Category:Undelete in 2025. Dcoetzee (talk) 02:33, 5 January 2013 (UTC)

File:Gran elefant dret i arbre.JPG

Hello INeverCry: The image which I take and upload called File:Gran elefant dret i arbre.JPG is under freedom of panorama in Spain. The artwork was exposed on the street in Barcelona. In Spain any thing that is on the street is considered of public domain. Why this image violates copyright policies? I should know which images I take in public domain I can upload to wikimedia commons and which not, in order to prevent more erasures not discussed previously. --Bestiasonica (talk) 14:30, 5 January 2013 (UTC)

I was mistaken. Sorry about that Bestiasonica. I've restored the image. INeverCry 17:47, 5 January 2013 (UTC)
0k. Errare humanum est. Ego humanis sum. Ergo ego quoque erro. No problemo, big hug, good work. ;-) --Bestiasonica (talk) 18:35, 5 January 2013 (UTC)
Could you restore also the File talk page? Thank you. --Bestiasonica (talk) 18:38, 5 January 2013 (UTC)
Done. Sorry again for the trouble. INeverCry 18:40, 5 January 2013 (UTC)

Not sure how to proceed

I was asked by Karla LaVey to put up a photo. She provided the photo for me to use. The photo she chose is used all over the internet and I, in fact uploaded the original hi-res version of the file (of which you cannot find anywhere else on the internet). That, in itself, should be proof enough that I at least have access to the original photo.

A friend of Karla's took this photo several years ago using her camera. It is her wish that this be the photo used as her headshot. She emailed me the photo to put on Wikipedia. Of course, I can ask her to contact permissions-commons@wikimedia.org, but she is concerned for her privacy and does not wish to give her email address out freely. Not to mention, I'm not even sure there is any way to prove that any email that comes from Karla is actually from Karla. (Not sure I buy into that system of security). The best I can do is ask you (or someone) to do a search for "Karla Lavey". As an example, you find a lower resolution version of that image on these sites:

http://www.discogs.com/artist/Karla+LaVey http://i240.photobucket.com/albums/ff130/satanicchurchradio/klhal6.jpg http://www.myspace.com/satanicchurchradio/photos/3242215#%7B%22ImageId%22%3A3242215%7D

In fact, you can find references to the Photobucket file on: http://en.wikinews.org/wiki/Comments:Satanism:_An_interview_with_Church_of_Satan_High_Priest_Peter_Gilmore

The fact that this photo is found on http://e-hotsex.com/karla/karla-lavey-of-the-first-satanic-church-picture-by.html is because they took it from Photobucket. They do not own the copyright. e-hotsex is a porn site that is trolling for clicks.

... Anyway, I've read the process docs, and I get why it is what it is. I'm just not sure I can completely comply. It's not my file, and I have no idea how you would prove that Karla owns the file, or that she emailed you, or that anyone, in fact, owns it at all. I think the fact that I uploaded the highest resolution you can find should say everything. — Preceding unsigned comment added by Mrcnwmn (talk • contribs) 12:24, January 5, 2013‎ (UTC)

Her wish is for this photograph to be free for everyone to use. — Preceding unsigned comment added by Mrcnwmn (talk • contribs) 12:54, January 5, 2013‎ (UTC)

It looks to me like COM:OTRS permission is needed for this particular image. The OTRS people are careful concerning privacy. Another idea might be for you to take a new headshot of her and upload it for use at full res with EXIF. You could also use w:File:Karla LaVey.jpg in the infobox of her article, rather than having it in the article body, as it looks pretty good IMO. INeverCry 21:00, 5 January 2013 (UTC)

Actually, that's how this started.... she hates that photo, and wanted to remove it from the page. I told her that it's better to replace it with a photo she likes, rather than have no photo.

I've forwarded this thread to her. Thanks for the help. — Preceding unsigned comment added by Mrcnwmn (talk • contribs) 13:27, January 5, 2013‎ (UTC)

It's too bad she doesn't like that photo. The pose and outfit/pitchfork are great, though I think the whole thing would look better if she were centered and all red or natural skin tone, as the green/red combo and the sparkling stuff behind her shoulder make the shot look a bit Christmassy. I guess the best option, if OTRS is a no-go, is a new photo. INeverCry 21:42, 5 January 2013 (UTC)

Hi Jobas. These 3 files are not ok for uploading to Commons. The Santaspain image could only be uploaded with permission from the photographer, while the 2 Flickr images are All Rights Reserved. INeverCry 01:32, 6 January 2013 (UTC)

Hi, mind elaborate a bit further? I don't mean to delete those, though. There are some more similar images (like this) so I want to know if they could be uploaded to commons as well, using the same license.--Lakokat (talk) 06:53, 6 January 2013 (UTC)

In regard to File:Frost.gif, the logo features the simple geometric shape of a hexagon and text, and so I tagged it as {{PD-textlogo}}. The logo you link to features flames, and that may put it over COM:TOO. In order to qualify as a text logo, a logo should "consist of simple geometric shapes and/or text." Your file renamings

Please explain how File:Kłodzko, ul. Matejki 5 1.jpg is a "completely meaningless name" as opposed to File:Kłodzko, ul. Matejki 5 (1).jpg. I have noticed you moving tens of images like that, and I don't feel that they fell under file renaming criterion 2 in any way. odder (talk) 10:16, 7 January 2013 (UTC)

Hi odder. I figured this Polish speaking IP often means criterion 6 with his requests. His moves seem ok/good faith to me, and this same person seems to have done 1000s of IP edits with dynamic IPs. I thought it would be easier to do the moves as they are rather than trying to explain a small technical detail to someone who speaks a different language than me. Also, since he's using dynamic IPs, it might be hard to talk with him using those IP talkpages. INeverCry 17:13, 7 January 2013 (UTC)

Thank you! Boo-Boo Baroo (talk) 18:08, 7 January 2013 (UTC)

You're welcome. INeverCry 18:15, 7 January 2013 (UTC)
Hi - a question related to this. In your opinion, is file moving such as to remove "(French" from e.g. "File:Théodore Chassériau (French - Portrait of Raymond de Magnoncourt - Google Art Project.jpg" superfluous, or reasonable under "harmonizing". This pops up with Google Art Project files where the original Google metadata uses various names for the same artist. I expect it wouldn't be worth the bother if the file were well used and had been around years--but we're talking very fresh/unused files. (That's just an example, I wouldn't take it on as a huge project even if it were within the guidelines.) Thanks, Boo-Boo Baroo (talk) 18:19, 7 January 2013 (UTC)
I would think about how many changes of this kind would be needed, and what the level of benefit would be in comparison to how much time you would have to spend on it. You always have the option of getting feedback at COM:VP in cases where the prospective moves might effect numerous files or future uploads. INeverCry 18:31, 7 January 2013 (UTC)

Hi - you seem to have deleted this as a copyright violation. Can you explain your reasoning? I can't see the file now, but I'm pretty sure I uploaded it from a valid Flickr licensed page, and our Flickr Review Bot likely confirmed. It's not a huge problem as I remember it was a blurry photo, and we have better now, so I'd have accepted a judgment of removal due to low quality, but the copyright violation think pinks my ego a bit. --GRuban (talk) 18:53, 7 January 2013 (UTC)

It looks like a close-up shot of a big screen showing a televised ComicCon interview. INeverCry 18:57, 7 January 2013 (UTC)

Yenişehir, Mersin

Hi INeverCry, why did you delete File:Yenişehir, Mersin.jpg ? Somebody requested on the ground for possible copyright violation. But although I asked for a proof that editor couldn't prove his/her claim. Actually there is none. Because I created that image with my own camera and there is absolutely no copyright violation. Well I'll upload another image. But I would like to learn the procedure. Is it the usual practice to delete a file after an unproven claim ? Nedim Ardoğa (talk) 08:24, 7 January 2013 (UTC)

I deleted that file per COM:PRP. It's a tiny pano shot of a beach that's only 23k in size, which is barely high enough quality to be usable. It has no EXIF and it looks like a copyvio taken from the internet to me. The burden of proof on Commons regarding copyright is on the uploader. If you intend to upload more images, I would suggest you upload them in higher resolution and with EXIF. INeverCry 17:04, 7 January 2013 (UTC)
But the rationale was copyright violation. It means cheating and I was insulted. I 'll upload a larger version. But you could have warned me about the size instead of accusing. OK ? Remember unless the opposite is proven all editors are honorable people and nobady agrees to be accused. Nedim Ardoğa (talk) 17:46, 7 January 2013 (UTC)
Copyright is a legal issue, and so the burden of proof is on the uploader, not Commons. If uploads are considered to be potential copyvios, they can be deleted per COM:PRP. This policy is in place to protect Commons though, and certainly not to insult or accuse you. It's a precautionary measure applied equally to all uploaders here. INeverCry 17:55, 7 January 2013 (UTC)
Please wait a minute. Have can I prove that there is no copyright violation other than my statement. I am serious. No contributor in Commons can prove it. Do you ask for a notarial document ? Although it is against my good intentions, for the sake of clarity suppose that I tagged a hundred articles for copyright violations just for fun. Are you going to delete all of them ? Nedim Ardoğa (talk) 21:12, 7 January 2013 (UTC)
We have ways of "proving" copyvio, or atleast removing significant doubt: COM:OTRS permission, free-license sources, COM:EXIF, and others. The shot you uploaded looks to be taken with a good level of skill, and so its very small size/low quality and lack of EXIF led to the deletion nominator questioning the copyright status. Alot of small files like this are taken from the internet and uploaded here, and alot of them get deleted daily. If, as you say, you intend to upload a higher-res version, that's a good idea and a good way of showing the file is your's under copyright. INeverCry 21:23, 7 January 2013 (UTC)

You just deleted a file I tagged for speedy deletion that was uploaded by this user (see File:Brian Evans.jpg). The user has uploaded many files in which he makes similar statements as to the origin of the files, namely that he created the work but that some other Commons user is the "author". I seriously doubt that Croonerman has created some of the images, but the actual copyright status of the images isn't as clear to me as it was for the Evans image. I would appreciate it if you could look at the upload history of the user at Commons. I believe there has already been some discussion of the images and their genesis. I don't know my way around Commons very well (I'm an admin at Wikipedia). I can easily see the upload history of Croonerman in terms of images that have not been deleted, but besides the Evans file, I'm not sure if there are others that have also been deleted. Anyway, forgive me if I'm going about this wrong.--Bbb23 (talk) 13:16, 7 January 2013 (UTC)

Past uploads from this user have been deleted: see this. I've started a mass DR for the rest: Commons:Deletion requests/Files uploaded by Croonerman. INeverCry 17:26, 7 January 2013 (UTC)

Francisco Lopez Contardo

Something weird happened. I was in the process of reverting myself after doing some research and we appeared to revert at the same time. [1] The history is botched and I don't see where it is. Regards, — Moe Epsilon 20:14, 7 January 2013 (UTC)

Hi Moe. I had declined the original rename request, but somehow you moved it within seconds after that. I then deleted the redirect to move it back, but you had already moved it over redirect. ;) I wonder why the tool allows 2 people to perform an action on a file at the same time? Anyways, I'm working on finding and restoring the history if possible. INeverCry 20:20, 7 January 2013 (UTC)

I've repaired File:Francisco López Contardo.jpg. We were lucky - this was cropped from another file, and there was another crop from the same file by the same uploader to move info from. ;) INeverCry 20:47, 7 January 2013 (UTC)
How strange, so the original information couldn't be found? Maybe some kind of bug report should be filed. Regards, — Moe Epsilon 22:46, 7 January 2013 (UTC)
I've seen this happen quite a few times over the past year since I started moving files. I've seen it mentioned either on VP or AN, I don't remember which. INeverCry 23:11, 7 January 2013 (UTC)
Good I catched you both here. Sorry to say this (and I'm going to repeat some stuff I alredy wrote on Moe's page), but the reverts made by you (INeverCry), are wrong this time, I guess I left part of the discussion on the image page (my mistake). The original file (the one that got cropped), is wrongly identified, and you can only proove (or check it) using your sharp eye on google images (Fransico López [2] vs Jeremías Israel [3]). To be honest, I'm not goofing around and just annoying you guys, but I know I'm right on this matter, and definitely... I'm not eager to keep a mistake on Commons or Wikipedia, but already three lengauges have the wrong image up, because is milabeled. You can keep the discusion with Moe's (or others) and figure out how it goes, but I'm pretty darn sure I'm right on this one this time! Good Luck and best wishes!--3BRBS (talk) 04:37, 8 January 2013 (UTC)

Question re: deletion

Commons:Deletion requests/File:Natalie Wood.jpg According to the DR, File:Natalie Wood.jpg, this photo was to have been deleted on November 29, 2012. It's still very much with us, along with a derivative File:Natalie Wood 1958 cropped.jpg which didn't come up at the DR. Is this one of those bugs again, or did someone just forget to delete the photo? Thanks! We hope (talk) 01:21, 9 January 2013 (UTC)

The file deleted per the DR (in Nov 2011 rather than 2012) was a different one than the current image, though User:El Matador is the uploader of both. The original is a smaller image, tightly cropped with Natalie facing and looking forward with her hand to her face. INeverCry 01:28, 9 January 2013 (UTC)

Hello INeverCry, the poster for my film File:Condition_poster.jpg was deleted. I hold all the rights for it. Is it possible to return it or do you recommend uploading again with better references? Thank you! — Preceding unsigned comment added by North4future (talk • contribs) 09:07, January 10, 2013‎ (UTC)

Hi. I'm guessing you're Andrei Severny then? I would suggest that you send an email to COM:OTRS giving permission for hosting this image on Commons. INeverCry 17:15, 10 January 2013 (UTC)

I'm not being offensive to anybody but basically copyrighting an image on internet seems pretty stupid to me. I mean isn't the internet was built for our freedom. Then these stupid corporates come and take it all away and now even images are copyrighted. Sir Gambon is a classic actor and I tried to upload his image on his wiki article but unfortunately there is no image of him on the whole net that has a commercial license. This copyright issue has choked the freedom out of us internet users. I'm not making any personal attack against anyone or sounding off here but this copyright thing must go. Basically I understand Wiki was against copyrights on the internet and it should have stayed that way instead of endorsing it. Thank you. KahnJohn27 (talk) 07:57, 9 January 2013 (UTC)

Also sorry if I mistakenly offended you in some way. Also images from getty images can be published freely in the UK and US and some other countries but you deleted this one File:Michael+Gambon+Grand+Opening+Harry+Potter+fhdJtofGPAAl.jpg. KahnJohn27 (talk) 08:02, 9 January 2013 (UTC)
This particular image is copyrighted by its author Jason Kempin. INeverCry 18:35, 9 January 2013 (UTC)
I guess you didn't understand what I said this image is copyrighted but all getty images are free to be published in the US, UK and some other countries and as far as I know Wikimedia is a british site. So i don't know how this is violating copyrights. But please give a proper answer. KahnJohn27 (talk) 12:35, 10 January 2013 (UTC)
Photos from Getty Images are copyrighted, and are not free. See Commons:Problematic sources#Common cases. You'll see Getty Images on the short list there, and directly below it: "If an image is listed at one of these sites, it's copyrighted and not freely licensed, and thus must not be uploaded at the Commons." INeverCry 17:18, 10 January 2013 (UTC)
Well alright then I agree with you. I wish I really could find a site where free images were provided without any copyright. Bad Luck I guess. KahnJohn27 (talk) 06:59, 11 January 2013 (UTC)

Hi Tito. In regard to the name change/revert issue, I would personally agree that the date/name info shouldn't be included in the filename, as there are better ways of keeping track of this info: the date field and user upload categories; but policy isn't against the practice, and it's relatively common.

Slight differences in spelling are something you'll see now and then. I've always seen alot of differences in the English spelling of Russian names, i.e Nikolay/Nikolai, Sergey/Sergei, etc. You could change all the spellings, but new uploads would most likely be done with the old spelling, just as new Russian articles on en.wp use every variety of name spelling you could think of. Sometimes there's no practical solution to spelling differences.

As for descriptions, it's easy enough for an uploader/editor to give the info in their own words, rather than copying and pasting chunks of text. INeverCry 01:17, 13 January 2013 (UTC)

1) It can be proposed (if there is something like Village Pump proposal here) to change the policy (i.e. though it not mandatory, it is recommended not to use date and specially uploader's name in image file name, it indirectly violates Wikipedia's rule "no sign/authorship" in article body. I have not given any example in my essay for uploader's privacy, but, I meant files like this: File:Sunil Gangopadhyay taken by Ragib.jpg.
3) Copying from Wikipedia in file description without giving attribution in talk page and/or edit summary is copyvio which is not very uncommon in Commons!
You could make a proposal at Commons:Village pump/Proposals, or you could bring up the topic at Commons:Village pump to see if there's support for making a proposal.

As for the copyvio c/p issue, that'll be around forever, as I can't see any way of preventing people from doing it, especially new uploaders, or people who aren't that good with English, etc. INeverCry 02:23, 13 January 2013 (UTC)

I am sorry, but this is a map more than 70 years old. These maps are company work and become PD 70 years after publication. That michelin stil exist is irrelevant. It is not a natural person (author) where you have to wait 70 years after the author dies. On this reasoning you would have to protect works more than 200 years old if the original compagny or organisation stil exist. When an organisation abolished the successors take over the copyrigths, but this is limited to 70 years after publication. Anyway this should never have been a speedy delete whereby I was notified after the delete. Smiley.toerist (talk) 20:21, 13 January 2013 (UTC)

Now they have come to my talk page and calming they are producer of the film.
You can see an unfragmented discussion here: Wikipedia:User_talk:BlackBlanks#Non_free_image. I have converted the speed to DR. After then I felt DR was not necessary too, please delete nomination page if you think it is unnecessary. Now, if they are really producer of the film, they own copyright and logically the first copy (which you deleted) should exist. FOP and permission by the artist

Hi INeverCry, remember how I got an image of mine deleted from commons due to FOP not being valid in France? It was of [Défenseur du Temps], and since the artist is still alive, I couldn't publish the picture on wikipedia. I wrote to the artist, but he didn't reply in time to prevent the deletion. Now he did reply, but he requests that I make the picture in a slightly different way. I'll be glad to do this as soon as I visit Paris again, but I wonder: how should I "register" this permission when uploading the new photograph? It would be very easy for anybody to just fabricate such permission, so is there something special I should do, or is it just an honour system where you are all going to trust me? All I have is a written permission by email, stating that it's cool to upload the new picture. Thanks for your time Stijndon (talk) 18:26, 14 January 2013 (UTC)

I would figure that there would have to be explicit COM:OTRS permission from the author, detailing the precise license he releases the image under. You can ask about the proper procedure and what's needed at Commons:OTRS/Noticeboard. INeverCry 18:36, 14 January 2013 (UTC)

I think you jumped the gun on deleting this file. The file was uploaded in response to a request I made on a reef aquarium enthusiast forum here, http://www.bareefers.org/home/node/15265. The important thing to note is that the uploading user name, Treylane, is the same name as the album owner author name on robotninjapirate.com. You can see that Treylane also responded on the forum thread.

The photo was uploaded by the original author per their declaration at time of upload. I am not sure how to reverse the deletion. Any guidance would be appreciated. It's probably mystifying and disappointing to a Wiki-noob like Treylane to see their first contribution nuked. I am not sure how you decided that the material was in violation of copyright but it does seem unwarranted in this case. Thanks — Preceding unsigned comment added by Bondolo (talk • contribs) 20:32, January 13, 2013‎ (UTC)

My concern is that most of the photos at robotninjapirate.com say "owner:Jess", while only a few say Treylane, and these also say "owner:Jess". Who is Jess? INeverCry 18:27, 14 January 2013 (UTC)
Jess and Treylane are the same person --bondolo (talk) 07:03, 15 January 2013 (UTC)
I don't see any explicit free license release on the site, and the image we're talking about is web-res at 720 × 480 (46,928 bytes), so I would suggest having him either upload a high-res version with original EXIF or send an email w/ permission to COM:OTRS. If you disagree, you have the option of posting an undeletion request. INeverCry 07:14, 15 January 2013 (UTC)

I'm a bit confused by this. If he is the original publisher, and he published them via IMDB as well as here, shouldn't there be a note of original publishing, or a letter via OTRS, or some other explanation? I'm fine with whatever the conclusion is, but I didn't mark all of them, just the easy to find ones with what little time I had. If this is legitimate, it is very difficult to tell the difference between that and a simple copy vio. Until he can establish he is the legitimate owner, it seems difficult to maintain. As for "fair use", I am just assuming that is a misunderstanding of the actual licensing terms (and that Commons doesn't allow fair use) and not what they really meant. Dennis Brown (talk) 00:28, 15 January 2013 (UTC)
The uploader seems pretty convincingly to be Luisa Pisani. See her other uploads. Looking at the EXIF and range of shots, I think it is her. You might also ask User:Wknight94 who seems to have had some contact with her about her images in 2011. I don't know if OTRS was involved or, if it was, what resulted. In regard to the above images, they're sourced to LP on IMDB. This TP message came from a new user, so I disregarded the mention of fair use as a misunderstanding. INeverCry 00:40, 15 January 2013 (UTC)
Ok, I will leave the others alone and trust your judgement in this. I just noticed [6] Luisa was indef blocked with issues at enwp (NLT, SOCK), but that isn't related to the ownership of the photos. Thanks again. Dennis Brown (talk) 12:59, 15 January 2013 (UTC)

You deleted File:Fire Hall, Etobicoke, Royal York Road, s.e. cor. Tenby St. -b.jpg. The entry you put in the deletion log says: "(Copyright violation: Non commercial license. Only for personal, educational, research and general publication. See http://www.torontopubliclibrary.ca/digital-archive/license.jsp)"

After seeing your note I went to http://www.torontopubliclibrary.ca/digital-archive/license.jsp and I reached a different interpretation of it than you seem to have reached. I don't see anything on that page to make me believe that any of their images that are explicitly marked "public domain" aren't in the public domain.

The note has three sections, the first under the section heading "Personal, educational, research and general publication" says:

Images identified as "Public Domain" in the Digital Archive may be reproduced in print or electronic format for personal, educational, research and general publication. General publication use includes published materials such as books and journals.
If material from the Library's Digital Archive is published, a credit line, "Courtesy of Toronto Public Library" is appreciated.

It seems to me that the phrase "general publication" here includes both commercial and non-commercial publication. When amateurs use a license with an element of ambiguity we sometimes choose to err on the side of caution. Professional curators aren't amateurs, and I suggest we should interpret this page at its face value.

As for the later clause: "It is the user's obligation to determine and satisfy copyright, or other use restrictions (such as donor restrictions, privacy rights, publicity rights, licensing and trademarks) when using images made from our collections." I suggest that when the curators explicitly marked an image a public domain, recognizing that public domain notice is all we have to do to honor the warning of our obligations, and that the clause is really intended for those images they didn't mark as public domain.

So, I request you restore this image.

If you think it requires further discussion, then why not initiate a full deletion discussion?

Thanks! Geo Swan (talk) 19:57, 17 January 2013 (UTC)

As above, please restore File:Fire Hall, Etobicoke, Royal York Road, s.e. cor. Tenby St. -a.jpg. Thanks Geo Swan (talk) 20:18, 17 January 2013 (UTC)

Deletion of a picture…

Hi, could you explain me, why you deleted this picture: File:Strasbourg- Rue Lucien Febvre.jpg? The reason, the IP quoted was the freedom of panorama in France, but the picture wasn't even a panorama. Regards --CherryX (talk) 20:04, 18 January 2013 (UTC)

Freedom of Panorama doesn't refer to panoramic images, it refers to what subjects can be photographed and where. See Commons:Freedom of panorama. INeverCry 20:08, 18 January 2013 (UTC)

Hey. :)
What's there to do?.. That's finally an irrelevant page now that it's both been emptied and the content is settled & coherent with the context. Sorry if I've missed anything. Cheerz. Orrlingtalk 21:10, 18 January 2013 (UTC)

Hi Orrling. If this is a place, shouldn't it be Category:Artworks in Giv'at Ram rather than Category:Artworks on Giv'at Ram? Also, I noticed the disagreement of Foroa; I'll have to ask him what he thinks of this. INeverCry 21:19, 18 January 2013 (UTC)
..It's a hill --- this is why it's basically correct to say "on", see Artworks on Mount Scopus.. but on the other hand it's also a city district, so it might need to be "in". I don't care. The point is that whichever variant is preferable, you have restored a page that is using the "on"-variant just like the new page,, and is in addition misnamed using single noun "artwork" rather than "artworks" and the like minor blunders.. So I can't be sure why we need to get this into an issue, which doesnot exist :] Orrlingtalk 21:54, 18 January 2013 (UTC)
I've mentioned it on Foroa's talk. I'd rather defer to him on the whole subject seeing that he was involved in the original discussion. INeverCry 22:12, 18 January 2013 (UTC)

Picture of the Year voting round 1 open

Dear Wikimedians,

Wikimedia Commons is happy to announce that the 2012 Picture of the Year competition is now open. We're interested in your opinion as to which images qualify to be the Picture of the Year for 2012. Voting is open to established Wikimedia users who meet the following criteria:

  1. Users must have an account, at any Wikimedia project, which was registered before Tue, 01 Jan 2013 00:00:00 +0000 [UTC].
  2. This user account must have more than 75 edits on any single Wikimedia project before Tue, 01 Jan 2013 00:00:00 +0000 [UTC]. Please check your account eligibility at the POTY 2012 Contest Eligibility tool.
  3. Users must vote with an account meeting the above requirements either on Commons or another SUL-related Wikimedia project (for other Wikimedia projects, the account must be attached to the user's Commons account through SUL).

Hundreds of images that have been rated Featured Pictures by the international Wikimedia Commons community in the past year are all entered in this competition. From professional animal and plant shots to breathtaking panoramas and skylines, restorations of historically relevant images, images portraying the world's best architecture, maps, emblems, diagrams created with the most modern technology, and impressive human portraits, Commons features pictures of all flavors.

For your convenience, we have sorted the images into topic categories. Two rounds of voting will be held: In the first round, you can vote for as many images as you like. The first round category winners and the top ten overall will then make it to the final. In the final round, when a limited number of images are left, you must decide on the one image that you want to become the Picture of the Year.

To see the candidate images just go to the POTY 2012 page on Wikimedia Commons

Wikimedia Commons celebrates our featured images of 2012 with this contest. Your votes decide the Picture of the Year, so remember to vote in the first round by January 30, 2013.

Thanks,
the Wikimedia Commons Picture of the Year committee

Вячеслав Бондарчук deletion of picture

Hello You have deleted a foto I uploaded for this article: http://ru.wikipedia.org/wiki/%D0%91%D0%BE%D0%BD%D0%B4%D0%B0%D1%80%D1%87%D1%83%D0%BA,_%D0%92%D1%8F%D1%87%D0%B5%D1%81%D0%BB%D0%B0%D0%B2_%D0%91%D0%BE%D1%80%D0%B8%D1%81%D0%BE%D0%B2%D0%B8%D1%87 I am sorry but I think I gave not correct information about owner of it, because of misunderstanding conditions But I know that an owner of picture had sent email with permission of using it. I aked her to do this and it was done. Can I do something to resolve it, please ? — Preceding unsigned comment added by Kelfam (talk • contribs) 10:39, January 19, 2013‎ (UTC)

If the owner of the image has sent a permission email to COM:OTRS, than all you have to do is wait until the email is processed. You can also ask about this at Commons:OTRS/Noticeboard, where you can check on progress. INeverCry 18:48, 19 January 2013 (UTC)

She sent it the same night whrn I asked her to do this. Maybe she has to resend ? — Preceding unsigned comment added by Kelfam (talk • contribs) 11:24, January 19, 2013‎ (UTC)

The file was uploaded more than a month ago, and the oldest OTRS emails I'm seeing are from 17 days ago, so you may want to have her send an email following the directions at Commons:OTRS. INeverCry 19:41, 19 January 2013 (UTC)

Hello there INeverCry. You deleted File:Elia_Markopoulos.jpg because of copyright violations, but the uploader did upload the file to imgur in the first place and licensed it. Please restore the image. Much appreciated! Vacation9 (talk) 21:44, 19 January 2013 (UTC)

The file was uploaded by Foleyfunk89 but says "taken by Picture Dave 9-22-12" in the description. Some clarification is needed. Is there a link to an explicit free license? Otherwise we would need COM:OTRS permission from the copyright holder. INeverCry 21:56, 19 January 2013 (UTC)

BSicons

Thanks for moving File:BSicon BHF 3399FF.svg. The thing is, there are seven more such files: File:BSicon exABZlg 339999.svg, File:BSicon exABZrf 339999.svg, File:BSicon exCPICIa 339999.svg, File:BSicon exKBFa 339999.svg, File:BSicon exKBFe 339999.svg, File:BSicon exKDSTa 339999.svg and File:BSicon exHLUECKE 339999.svg. These are not as much used as BHF, so performance would not be an issue. The only reason why they could be moved is to follow the suit of other icons in Category:Icons for railway descriptions/set 3399FF. In your opinion, is it worth it? If so, could you please move them from "exXXX 339999" to "XXX 3399FF"? Sorry for bothering... YLSS (talk) 22:58, 20 January 2013 (UTC)

I have no problem with doing these moves, if you think they're worthwhile and necessary, but you'll have to do the {{Rename}} tagging. INeverCry 23:04, 20 January 2013 (UTC)

File rename

I notice you moved the file File:Abraham ready to sacrifice his son, Isaac (top); Abraham cast into fire by Nimrod (bottom).jpg, which was originally entitled "Abraham ready to sacrifice his son, Ismael (top); Abraham cast into fire by Nimrod (bottom).jpg". This was at the request of Alan Leifting [7] who said it was an "obvious error". The only obvious error was Alan's, I'm afraid! Muslims believe that Ishmael was the child who was almost sacrificed. This is a Muslim, not a Jewish or Christian, image. What is more, it is only used on pages about the Muslim version of the story. The file should be moved back ASAP. I tried to request a move in the normal way, but only got a list of policies popping up in a separate window, which I couldn't edit, hence my "unofficial" request here. Paul Barlow (talk) 20:52, 22 January 2013 (UTC)

BTW, the source given for the file also give the correct subject [8]. Paul Barlow (talk) 20:56, 22 January 2013 (UTC)
Hi Paul. I think this should be brought to Alan's attention before any further action is taken so he can respond to your concerns. I try not to reverse good-faith actions without atleast allowing the user in question to address the issue. INeverCry 21:00, 22 January 2013 (UTC)
I'm not suggesting there is was any kind of bad faith. He's just made a mistake, that's all. You can look up the details provided at the link or any other reliable source. However, I will notify Alan. Paul Barlow (talk) 21:03, 22 January 2013 (UTC)
He has been notified. Paul Barlow (talk) 21:12, 22 January 2013 (UTC)
I suggested a simple spelling change but another editor suggested a more comprehensive change. I am not to concerned about the file name but it should be descriptive and not contain spelling errors. (In the case of this image there is a need to show that there are two parts to it, hence the new name.) I was discovering that editors on Wikipedia would correct the spelling in a file name not realising that it breaks the link. Alan Liefting (talk) 03:19, 23 January 2013 (UTC)
(Sorry for butting in) Alan, novice editors do copyedit image names anyway, with or without any obvious reason (have just reverted one), this does not mean we should rename images "for better prose flow". Materialscientist (talk) 06:03, 23 January 2013 (UTC)
I've asked DS to comment here. INeverCry 03:29, 23 January 2013 (UTC)
OK, I missed some of the details in my first message. Apologies to Alan (despite the other editor's intervention Alan's name still appeared on the request template as the editor who was requesting the move). The important point is that the file depicts Ishmael, not Isaac. The other changes to the name are improvements, so should probably stay. It would, I suggest, be best to have "File:Abraham ready to sacrifice his son, Ishmael (top); Abraham cast into fire by Nimrod (bottom).jpg" Paul Barlow (talk) 10:16, 23 January 2013 (UTC)
Oh, didn't realize that Muslim tradition says Ishmael instead of Isaac; mea culpa for that detail and I'm fully okay with the filename being changed to correct that error. The other three details (spelling; the image has two sections; and Abraham may be ready to sacrifice his son in this image, but he is not sacrificing anyone) should stay. Hi, per what has been said about maps (per [9] etc.), should this map be undeleted? --Eleassar (t/p) 21:45, 22 January 2013 (UTC)

Perhaps an undeletion request is in order? Also, I've closed Commons:Deletion requests/Files in Category:Maps of Slovenia with the suggestion that a new DR be started to avoid confusion. INeverCry 21:51, 22 January 2013 (UTC)
I've been thinking about it, but don't have access to the deleted map. As to the closed request, I've just started separate requests for the files that need to be deleted. Thanks. --Eleassar (t/p) 22:01, 22 January 2013 (UTC)
Since Yann closed the DR you linked to, maybe he could make a better-informed decision regarding the possible restoration of the above image? INeverCry 22:05, 22 January 2013 (UTC)
This has not much to do with that request. As you have deleted that image, I've expected you could say whether it is to be undeleted or not, based on this and the above-linked comment. --Eleassar (t/p) 22:14, 22 January 2013 (UTC)
You had actually tagged this as no source before the DR, and this is why I deleted it. The stated source is http://sl.wikipedia.org/wiki/Slika:Pokrajine_spodnja_stajerska.png. INeverCry 00:24, 23 January 2013 (UTC)
We've later come to agree that in cases where no source map is identified, we assume good faith and keep the map. Like e.g. [10]. I apologise for the problem, but I think that this map should be undeleted. I'll take it to the Undeletion requests. --Eleassar (t/p) 08:08, 23 January 2013 (UTC)

Image deleted which I think had OTRS permission

I processed OTRS permissions for several images, including http://commons.wikimedia.org/wiki/File:Dokdo-East-Isle-2.JPG

with ticket # 2013012310012168

I processed it on 23 Jan 2013, but it was deleted today.

I've restored it. The OTRS needs to be updated if it's now confirmed, and the no-permission tag needs to be removed. INeverCry 22:56, 24 January 2013 (UTC)

Deleting images

I believe I know the person who uploaded this image and I though he took it himself - but I have no way of checking because all details disappeared once you delete the images. Is there no log of the uploader or the discussion preceding the deletion? It's a shame to waste wikipedia contributor's time like this. http://commons.wikimedia.org/wiki/File:%D8%B7%D8%A7%D9%84%D8%A8_%D8%A7%D9%84%D8%B4%D8%B1%D8%A7%D9%81%D8%A9.JPG --عبد المؤمن (talk) 11:00, 25 January 2013 (UTC)

The uploader states that the image was given to him by Yousif Omer Wad Bader, who authorized the upload. We need COM:OTRS permission proving that Yousif Omer Wad Bader has so authorized the uploading of this image. INeverCry 19:50, 25 January 2013 (UTC)

I think the basketball puts this over COM:TOO, so {{PD-Textlogo}} isn't right for this. I would suggest uploading this locally if needed via fair-use. INeverCry 00:39, 26 January 2013 (UTC)

Indeed ... I send them via the OTRS wiki and via Commons (on both I clicked on "E-mail me a copy of my message.", but I didn't get a copy). Trijnsteltalk 00:01, 26 January 2013 (UTC)
Hmmm. I've gotten emails from other users yesterday and today, so everything should be ok. You'll have to try again. INeverCry 00:04, 26 January 2013 (UTC)
Ok, will do that tomorrow then. I'm not sure what the exact words were. :) Trijnsteltalk 00:09, 26 January 2013 (UTC)

deleting of picture

Dear INeverCry, on Jan 4, you deleted the picture I used for an article about the Dutch journalist and writer Annemieke Hendriks (on the Dutch Wikipedia-site), because the author of this picture did not give written permission to use this picture. Meanwhile I received a letter from the author (photographer David Ausserhofer, from Wandlitz, Germany) stating that he gives permission to use this picture for this specific goal. How can we get back the picture of Annemieke Hendriks on the wikipedia-site, c.q. wikipedia commons? Antinoos talk

OTRS permission from the author is needed before the file can be restored. INeverCry 18:12, 29 January 2013 (UTC)

Bill alone07 contributions

Hi, I see you just speedied the Ayumi Hamasaki photo. Thanks for the quick response. I think most, if not all, of Bill alone07's contributions are also copyvios. I'm not familiar with all the subjects; I was just lucky to recognize the Hamaski one. But his uploads are "too good" and apparently of celebrities, to believe that they're truly his own work as claimed. For example: File:94cc7b6675f7d9.jpg, File:Longnhat207jpg1348915829.jpg and File:Dam-vinh-hung.jpg all seem to be professional work. File:64 photo3.jpg may be public domain, for all I know (it's certainly old, but of course that's not always enough); but it's extremely doubtful that it is this contributor's "own work" as claimed.

I'm mostly an EN Wikipedia editor, and don't know my way around commons well enough to figure out the right way to handle these; can you assist? TJRC (talk) 22:17, 30 January 2013 (UTC)

Restoration

Hi INeverCry. I restored this file ... the copyvio tag was added by a vandal. Now we have to re-add it on all pages, <sigh> Trijnsteltalk 22:21, 30 January 2013 (UTC)

Sorry about that Trijnstel. Unfortunate that I didn't catch that. I hope it's all fixed now. I see that someone autopatrolled me half way thru those reverts, and thanks for checking the others. I restored 265 images yesterday per an OTRS request at COM:UDEL, so this was a piece of cake in comparison. INeverCry 23:10, 30 January 2013 (UTC)

Thanks very much for the kitteh! Thanks again, -- Cirt (talk) 23:18, 30 January 2013 (UTC)

On a related note, curious if you had any thoughts, or maybe some advice, about this User_talk:Cirt#Mr._Hankey_images? -- Cirt (talk) 23:25, 30 January 2013 (UTC)
I've commented at VP. INeverCry 00:08, 31 January 2013 (UTC)

I guess after reading that, I'm more confused, you think it's okay to upload those 2 more Flickr images here to Wikimedia Commons then? -- Cirt (talk) 00:53, 31 January 2013 (UTC)

File:I ate Mr Hankey by Kenny Lex.jpg this one should be okay, right? What about that first one I'd mentioned? -- Cirt (talk) 01:03, 31 January 2013 (UTC)
Since the Hankey representation is such a small part of the composition, and there are quite a few sausages (I hope those are sausages!), you might have a case of COM:DM for that image. The wall art/graffiti one is probably COM:DW. You might want to wait a bit, especially if DC is planning on mass DRing the cat. It'll be good to get comments from others. INeverCry 01:09, 31 January 2013 (UTC)
Okay, sounds good, I'll wait on the other one and hold back, and leave it as is for now. What do you think can be done to avoid "mass DRing the cat", if at all possible? -- Cirt (talk) 01:13, 31 January 2013 (UTC)
If there end up being comments from others in those VP threads against deletion, or if DC decides against a DR. INeverCry 01:29, 31 January 2013 (UTC)

Hi, INeverCry. Firstly I want to say Thank you very much for your efforts. I controlled files deleted by Commons:Deletion requests/File:HACC1.jpg. I think now, these files abuse not only FOP, but also real photographers' copyrights (in short, they are not own works of the uploader). For example, as to File:HACC2.jpg, This image was posted to skyscrapercity.com on 29 June 2012 by Black_Diamond. I believe we'd better control those files (especially files that were deleted with FOP cases). Thank you. Takabeg (talk) 20:53, 31 January 2013 (UTC)

So far I've tagged 5 or 6 copyvios from this user posted on the web by atleast 3 different authors, and I've noticed 4 or 5 different expensive cameras used. INeverCry 23:58, 31 January 2013 (UTC)

All I can do is give honest answers and see how it goes. Hopefully it will go well, because I really do think I'd be a good admin there, if not quite as heavily active a one as I am here. INeverCry 19:52, 31 January 2013 (UTC)
I work with RfA at enwp a great deal, and would bet money it will be a decisive pass to the bit. We need more bridge building between Commons and enwp, and often it is very helpful to have someone who has access to deleted material on both, or simply can deal with problem users that are active on both, in particular, dealing with sockpuppetry. The two wikis will always be very different (and should be) but having some dual admins that can be trusted is very, very helpful on many levels. We are also very short handed with experienced copyright admin at enwp, so you really have some skills that are dearly needed, even if you are only part time there. As for other issues, you are correct that it is water under bridge and we both realize we could have handled it differently, but it started with my overaggressive "policing", so I accept the bulk of blame. People that genuinely care about the place are going to bump heads from time to time, it is the nature of the beast. Dennis Brown (talk) 15:04, 1 February 2013 (UTC)
Like you, I really do care about these projects, and the people who contribute. I like to help people. It makes me feel good. If the RFA goes through, we'll see more of each other, and you'll be one of the people I go to for advice. Right now though, my most pressing issue is a bad tooth that was really kicking my ass last night. I always put these dentist visits off until the last minute. INeverCry 21:08, 1 February 2013 (UTC)

Request for checking the PD license and possibly correcting it.

Hi, I've uploaded there images - File:Betty Archdale with two other members of the team at St Pancras Station, 19th October 1934.jpg, File:Ladies vs Soldiers match at Ramsgate in Kent.jpg and File:14th September 1889 — a lady cricketer catching the ball during a game.jpg. I understand their PD Status based on the description and years passed since the pic was taken. But I'm confused with regard to license as PD-UK is a deprecated license and I wonder if the one I chose fits the pics. I'll be happy if you correct the license in case if I've erred here. Hindustanilanguage (talk) 12:27, 31 January 2013 (UTC)

Hi. File:Betty Archdale with two other members of the team at St Pancras Station, 19th October 1934.jpg and File:14th September 1889 — a lady cricketer catching the ball during a game.jpg are both attributed to known authors, so PD-UK isn't right for these. With File:Ladies vs Soldiers match at Ramsgate in Kent.jpg, you'd have to show what research you've done regarding the author in order to use PD-UK. This isn't my area of expertise, so give me some time and I'll look into these more. INeverCry 15:59, 31 January 2013 (UTC)
File:Betty Archdale with two other members of the team at St Pancras Station, 19th October 1934.jpg is by J. A. Hampton who was active till atleast 1939 and may have lived into the 50s or 60s or even later. File:14th September 1889 — a lady cricketer catching the ball during a game.jpg is by Lucien Davis who died in 1951. File:Ladies vs Soldiers match at Ramsgate in Kent.jpg is labeled as being by Stringer/Getty Images at the source, and I've found Stringer images dating from the 1950s by search. These images may have to be deleted as copyvios. I'll ask for another opinion though. INeverCry 20:05, 31 January 2013 (UTC)
I'm afraid I agree with INC. There was a DR on a batch of British images from around the same era a few months ago and almost all of those were deleted. If we can get a date of death for Hampton, the first one might be saved (but he would have had to have died before 1943); if Davies died in 1951, his works won't be PD until 2022; and even if the author of the last one died in the 1950s, their works wouldn't be PD until 2030 at the earliest. This is one of those cases where it's vanishingly unlikely anybody would object, but they have to go because they're still (technically) in copyright. I'm not sure what use I would have for copyright 69 years after my death, but that's the state of the law. HJ Mitchell | Penny for your thoughts? 20:25, 31 January 2013 (UTC)
So you're saying all 3 will go or may be 2 of the 3. "+70 years after" criteria does not apply here? Hindustanilanguage (talk) 06:56, 1 February 2013 (UTC).
It does look like all 3 will have to go, as none of the authors has been dead long enough. The one by Hampton would be a long shot because his best known work Leap of Faith was done in 1939, so the chance that he died before 1943 is very slim. I can delete these for you when I come on in the morning if you'd like, so you don't have to deal with tagging them. If you ever found Hampton's death date and it was before 1943, that image could easily be restored. INeverCry 09:29, 1 February 2013 (UTC)

Deletion of files without notice

Hi, this file File:Railwaystation in Bolzano Bozen.jpg was deleted without notice. I don't feel its correct not to inform me, considering the great amount of work I deploy to provide Commons with good pictures --Wolfgang Moroder (talk) 15:48, 1 February 2013 (UTC)

Hi Wolfgang. I deleted this via Commons:Deletion requests/Files in Category:Bolzano train station which is one of the many Italy FoP DRs done by the nominator. It certainly isn't a reflection on you or your contributions, as you're definitely a trusted editor and a great contributor to Commons. I think the reason you weren't notified is that the nominator has been working on hundreds of these FoP DRs of files in Categories rather than focusing on uploads by specific users. INeverCry 19:34, 1 February 2013 (UTC)

Request to reconsider two requests for deletion

Hello,

Would you be so kind to have a second look at the following deletion requests :

Have you spoken to Yann about these? His keep vote in the first DR was my basis for closing keep, and I kept the other per consensus, including his vote. I would suggest talking to him regarding both images, as he has alot of experience regarding India FoP. INeverCry 01:00, 2 February 2013 (UTC)
While it should be noted that I discovered that he was the uploader only after I had clicked on the "Nominate for deletion" link (I make deletion requests based on what I see on the picture, not based on who is the uploader), User:Yann happens to be someone I have a poor relationship with. He behaves like he is the owner of fr:Wikisource and everytime I say something he disagrees with, he has an authoritarian attitude not commited to dialogue and peaceful relationship. It seems that any kind of dialogue between Yann and I seems impossible. I don't think Yann has enough knowledge with copyright matters. I think the users on Wikimedia Commons with the deepest knowledge on copyright matters, and in particular on COM:FOP matters are people such as User:Clindberg, User:Nard the Bard and User:Lupo. I also want to include myself among the editors of page COM:FOP, as I added a number of countries and contributed to a number of subjects on the related talk page CT:FOP. Teofilo (talk) 23:07, 2 February 2013 (UTC)
I agree with you that the editors you've named are highly knowledgeable. I would suggest asking one of them if they feel re-opening a DR on these images would be appropriate, or you could ask about it at Commons:Village pump/Copyright. INeverCry 23:13, 2 February 2013 (UTC)
Well, these are only two pictures. I think I am going to find some more exciting tasks to do here on Wikimedia Commons or Wikipedia. Thanks for spending the time to reply. Teofilo (talk) 23:45, 2 February 2013 (UTC)

Hey, I'm sure you'll see it sooner or later, but I though I'd point you to the above. Your input would be appreciated. Cheers, HJ Mitchell | Penny for your thoughts? 18:45, 2 February 2013 (UTC)

re

All I can see in the EXIF is (C) Jakub Torenc while uploader name is Jakubtr. These two names are obviously similar, but not the same. Could you, please, kindly proof that Jakubtr is Jakub Torenc or that Jakub Torenc granted his permission to Jakubtr to dispose of any of his copyrighted files?? Btw. what you exactly mean his files? Do the files uploaded to commons/released to PD belong to anyone?--Bogusz.wittis (talk) 22:52, 3 February 2013 (UTC)

As I said, I see no reason to doubt that User:Jakubtr is Jakub Torenc, and I see no evidence to think that these aren't his personal creations. I've done google image searches on some of these, and I found no previous postings on other sites of any of them. What I mean by "his files" is simply that he uploaded them to Commons. Also, since he uses this name tag in EXIF on many, if not all, his uploads, the proper procedure to address doubts about copyright or his identity in regard to his uploads would be Commons:Administrators' noticeboard/User problems, rather than tagging individual files. You say you took it with your Nikon. Can you upload a version with the original EXIF intact? INeverCry 23:57, 4 February 2013 (UTC)
@Degagebouche: I personally doubt, after doing a quick Google Images search for "Nicki Minaj Las Vegas", that you took that picture. Unless you provide the EXIF data, I am willing to tag it as a copyright violation. Going a bit further, unless you are a recognized photographer working for a press agency or a well-known website/similar, I doubt you were able to get that close to her and take the picture. — ΛΧΣ21 00:17, 5 February 2013 (UTC)
After looking into this file more, I've deleted it as coming from http://www.oneasianworld.com/2013/nicki-minaj-hosts-vegas-new-years-eve-party/. This image shows more of the carpet in front of her feet. Your version has that area cropped out. This suggests to me that you cropped out the watermarks and uploaded it. If the file is yours, you should be able to upload the full frame with EXIF. INeverCry 00:32, 5 February 2013 (UTC)
Hi,

Yes, i'm able to, but what's EXIT? --Degagebouche (talk) 06:18, 5 February 2013 (UTC)

See COM:EXIF. INeverCry 06:55, 5 February 2013 (UTC)
Hi, http://commons.wikimedia.org/wiki/File:Nicki_Minaj_At_Las_Vegas.png I re-uploaded the file, is that enough for you? And I don't understand your EXIF thing, i'm french so my english is pretty medium.. --Degagebouche (talk) 21:49, 5 February 2013 (UTC)
You re-uploaded the same image with black spotting where you blended/removed the watermarks rather than cropping it like last time. I've deleted it again. If you upload the same image again, you're account will be blocked. If you need to, you can ask about EXIF in French at Commons:Bistro. INeverCry 22:55, 5 February 2013 (UTC)

Recent file deletions

I'm sorry about the 3 recent files that you had to delete, they were in a 1600 files gallary on Flickr and I used a bot to upload all of them. I couldn't check them all. Wish you a great day, Viscontino (talk) 09:54, 5 February 2013 (UTC)

With such a big batch, some bad ones can be expected. It's no big deal. INeverCry 19:53, 5 February 2013 (UTC)

Help!!! Deletion

Estaba dando errores. Si no tuviera otra manera, puedo descargálo por Special:Upload. Y pedir eliminación de duplicata. Disculpe la molestia. Voy a quedar más tranquilo. Buenas tardes! Eduardo P (talk) 15:37, 5 February 2013 (UTC)

If these are duplicates, you should tag them with {{Duplicate}}. INeverCry 19:44, 5 February 2013 (UTC)

Photo of Mohammed Shia Al-Sudani.jpg Deletion

Hello, Would you be so kind to have a second look at the deletion request of (Photo of Mohammed Shia Al-Sudani.jpg) this photo was taken by me before few months in a conference as I work in the ministry of human rights so I hopefully wish you will reconsider it or at less told me an easy way to make legal uploading because I can't understand this OTRS thing.Iraq2media2human

You had indicated that the file hadn't been previously published, but it was actually published here on 20 November 2012. If you're the copyright holder of the image, you'll have to either go through COM:OTRS, or you could upload a high-resolution version of the image with original EXIF. Request for reinstating deleted images

I uploaded 2 image files File:Life! Camera Action... Movie Poster.jpg & File:Another Day Another Life.jpg but they have been deleted due to some copyright issues. In reality I own these creations so do not see any reason for them to be deleted or may have infringed any copyright issues. May be I did not enter correct information at the time of uploading them. Strangely after I uploaded these images they displayed fine on the wiki pages but after a few days were deleted. I have also sent an email to permissions-commons@wikimedia.org to reinstate these images. I sincerely request you to please help me reinstate these images and please let me know if you need any additional information Lcarg2012 (talk) 20:16, 5 February 2013 (UTC)

If you've sent an email to COM:OTRS, then all you need to do is wait for them to process it. If everything checks out, they'll restore these images for you. OTRS can take a couple weeks. INeverCry 20:21, 5 February 2013 (UTC)

Thank youLcarg2012 (talk) 20:44, 5 February 2013 (UTC)

--Degagebouche (talk) 23:29, 5 February 2013 (UTC)

See Commons:File types#Sound for the type of files accepted. Remember also that you can't upload anything that isn't available under a free license or that you don't have permission for from the copyright holder. INeverCry 00:00, 6 February 2013 (UTC)

Your random deletions

You have speedily deleted File:Estpresident 1c300 8523.jpg and more. If you feel this is correct, do me a favour, delete (permanently) all files by me with name "Estpresident..." (yes, all of them). If you do not want to delete all of them, please explain in detail why. By the way, where was the discussion for/against deletion? Was i given notice? Do you think I have time with this deletion stuff? --Janwikifoto (talk) 17:25, 4 February 2013 (UTC)

I didn't speedy delete that file. It was deleted via Commons:Deletion requests/File:Estpresident 1c300 8523.jpg after a 7-day period. You were notified on your talkpage about the deletion request: User talk:Janwikifoto#File:Estpresident 1c300 8523.jpg. These few deletions were done because the group of children was out of COM:SCOPE. This certainly doesn't reflect on the rest of your work. INeverCry 19:49, 4 February 2013 (UTC)

Deletion Of My Photos???

It looks like you are or have deleted photos that I took with my own camera from my seats at Vanderbilt stadium. I was wondering why and with no notice.

MDSanker MDSanker

These were deleted because they are derivative works. There's no doubt you took the pics, but the big screen and what's being shown on it are copyrighted, so photos of it can't be uploaded to Commons. I've re-deleted the first one. INeverCry 00:02, 8 February 2013 (UTC)
I don't know who you are however reading the information I did not see anything that say's a scoreboard at a football game is a copyright issue, it looks like you maybe stepping over your boundary's by deleting my work. The team has a new score board and this was illustrating what it looks like not anything else. I truly think you are wrong in your interpretation of this kind of issue. You need to undelete them please. MDSanker MDSanker 01:26, 8 February 2013 (UTC)
The problem here is not the scoreboard itself, but the images being played on the screen. The footage is copyrighted by whoever is filming it and broadcasting it. INeverCry 01:30, 8 February 2013 (UTC)
All the photos are of none broadcast to any network the where only in-stadium shots I even asked the Vanderbilt vice chancellor David Williams if this was okay he said as far as he know it was.MDSanker 01:35, 8 February 2013 (UTC)
We would need a Vanderbilt representative to give permission for these images by contacting COM:OTRS. INeverCry 01:41, 8 February 2013 (UTC)
Okay thanks May I ask who are as for as what is your role at wikipedia. MDSanker 01:44, 8 February 2013 (UTC)
I'm a regular Commons user/volunteer like everyone else, serving as an administrator. INeverCry 01:53, 8 February 2013 (UTC)

Vesta sobre España

¿Por qué borraste "Vesta sobre España"? ¡Estuve horas componiendo esa imagen!

Quisiera volver a subirla, porque es de mi autoría. Si hay algún problema te agradeceré que te comuniques conmigo.

Gracias.

That image was deleted because you didn't provide the source. INeverCry 00:05, 8 February 2013 (UTC)

AnneNess

Hi INeverCry, the account AnneNess (talk · contribs · deleted contribs · logs · edit filter log · block user · block log) is a spambot, so I've blocked them and deleted their userpage spam. This spambot actually belongs to a larger group, see this overview on Meta. Please let me know if you have any questions. ;) Kind regards, Mathonius (talk) 18:32, 7 February 2013 (UTC)
