Not in Source?

This file lists a source which doesn't actually include the image (and apparently never has according to Wayback). I don't know what the Commons equivalent of {{Failed verification}} is. {{Source missing}} wouldn't apply because the file has a source, but it's just wrong. Deletion of file: Penny_Pennington_portrait.jpg

Hi, On April 18, 2019 I uploaded a portrait of Penny Pennington to here: https://commons.wikimedia.org/wiki/File:Penny_Pennington_portrait.jpg. It was deleted on June 9, 2019 by Jcb. His/her reason was "(No OTRS permission for 30 days)". Ms. Pennington, or her representative, sent a permission letter to OTRS but I suppose the volunteers did not get to the photo's file before the 30 day limit, nor even before about 40 days. The file did receive a tkt # (2019112610011197). I know there is a backlog, so I waited until November 27 when I contacted Jcb and asked him/her if the picture could be re-instated. I did not receive a reply. I wrote again on Jan. 2, 2020, and still no reply. I went to Jcb's editing history, and noticed he/she has not edited on Wikipedia since October 15, 2019, so perhaps he/she is away, and that is why this issue is not getting dealt with. I hope someone at the Help Desk can give me some advice about how to get File:Penny Pennington portrait.jpg back on Commons so her portrait can be placed on her Wikipedia article. Hi Yellowpoemelos, there still were some questions open regarding the copyright, however, the last message sent by the OTRS agent to Ms. Pennington's representative (dating from July 28., 2019) has never been answered. Of course the image will be restored as soon OTRS receives sufficient copyright information. Hey Reinhard Kraasch. The message was received and replied to, but was not sufficient to establish the license of the work, and it looks like they never responded to the last message that was sent to them a few weeks ago. The copyright for an image normally rests with the photographer, and not sue subject of the photo, unless there is some legal contract transferring the rights to the photo, normally as part of a work-for-hire agreement. Even if she paid the photographer, if she did not have a contract transferring the rights, she may have permission to use it for her own purposes, but she or her representative would not be the owner of the copyright, and not able to release it under a free licence. Sorry @Reinhard Kraasch: . When I edited I didn't see that you had commented also. Didn't mean to pile on unnecessarily. But the issue is just as they have said here in this thread. I'm not sure I revealed much else other than that "Ms. Pennington, or her representative, sent a permission letter" for a "portrait of Ms. Pennington". Mess? Scaled down? Please explain. I am not intentionally trying to cause any type of "mess" by uploading the images. I thought I was uploading efficiently and properly using the provided upload wizard, I never got an alert or warning or anything. Version licences on more images uploading in one time

(1) Problem with Commonnist. It wants to use old filenames in the upload, in stead of recent ones. Now I have to use the standard upload tool. But that has the next problem:

(2) I want to use licenses {{User:Stunteltje/license}} {{Self|Cc-by-sa-3.0|GFDL|attribution={{User:Stunteltje/attribution2}} }} for 22 images in one time.

How can I force Commonnist to use the resent filenames and/or how can i use the mentioned license whith the standard upload? --Stunteltje (talk) 10:44, 1 January 2020 (UTC)

Uploader sent my photo with wrong licence. Need to delete it.

I was using the photo uploader to give it to the English Wikipedia, NOT to Commons with a license for everyone to use it and/or edit it. I clicked Upload, NOT Upload on Commons but suddenly it was on Commons.

I cannot find any way to delete or undo. Please instruct me. I will remove it and attempt to place it correctly.

@PhotoBrit: I presume you mean Portrait of Restaurateur and Philanthropist Barbara Lazaroff.jpg. We would delete it but it is used on her Wikipedia article. Please remove it from there and it will then be deleted from here. Rodhullandemu (talk) 17:55, 1 January 2020 (UTC)

New pages not live

I have written two new pages (Thomas Skinner and The Fluffy Pillow Company) but they are not live. This is for a UK celebrity. Both pages seem to be under my user page but should be articles/pages with their own distinct headings. @Rochrozario: Your articles are in your sandbox on Wikipedia, not here, which is Commons. You need to ask there how to make them "live". Meanwhile, you will probably have problems with images given to you by their subjects because the copyright is almost certainly owned by the actual photographer. Please take a look ar COM:LICENSING. Hey Rochrozario. Your draft is unlikely to be accepted in its current form. In order to qualify for a Wikipedia article, a subject needs to have sustained in-depth coverage in reliable published sources, usually things like books, newspapers, and magazines, and excluding things like social media or official websites. If this subject has received such coverage, then it should be used to source the information in the draft. If the subject has not received such coverage, then it likely does not yet qualify for an article on Wikipedia. GMG^talk 13:46, 2 January 2020 (UTC)

Uploading picture

Hello,

I'm trying to upload a picture of Pål Barkvoll, the Dean of the faculty of dentistry at the University of Oslo, for his biography at Wikipedia. The picture is previously being deleted and it seems to prevent me from uploading the picture once more. The picture is owned by the University of Oslo, is that why the uploading is cancelled by Wikipedia? I also tried uploading another picture for our Dean's biography, but I did not succeed. I appreciate your help.

• @Kariaov: According to our records, this account has never uploaded any images to Commons, deleted or otherwise.
• If this was on a Wikipedia (you don't say which language) it would be very hard for us here at Commons to sort this out.
• At this point, I suspect that the only reasonable way to move forward is the process described at COM:OTRS. If anything there is unclear, please feel free to come back here with specific questions. - Jmabel ! talk 16:42, 3 January 2020 (UTC)

Uploading an official government photo

I want to upload an official photo of NSA's Dr. Deborah Frincke to a Wikipedia article that was published about her. I cannot upload the photo - I get a message that Wikipedia cannot verify that the image is my work. Actually I get the following message: We could not determine whether this file is suitable for Wikimedia Commons. Erroneous Martha Jefferson portraits - really her daughter Martha Jefferson Randolph

I am not sure how to go about correcting the association of File:Martha Jefferson Randolph cropped.jpg and File:Martha Jefferson Randolph.jpg which have been attached to Martha Jefferson articles in various languages and other pages. I can handle the English pages, but am not sure what to do for other languages.

In addition, I tried removing it from the Wikidata page, but that hasn't made a change to the record in Category:Martha Jefferson. What needs to be done? Thanks so much!CaroleHenson (talk) 18:12, 3 January 2020 (UTC)

@CaroleHenson: Many Wikipedias have an "Embassy", where people who don't speak that Wikipedia's language can bring cross-language concerns. There's a list of them on m:Wikimedia Embassy. A quick glance through one of them suggests to me that this kind of problem would fit in there. As for Wikidata, you just needed to wait a little: the category page no longer shows a picture. --bjh21 (talk) 18:45, 3 January 2020 (UTC)

Copyright help regarding File:London Lions.png

Hi Commons,

I need help fixing the London Lions image for their basketball page. Commons is saying it may be copyright and will delete it in 7 days. I did put the source of the image and source took me to the main website of the London Lions basketball team.

I’m still learning how to use Wikipedia. Images has been very confusing for me.

Why don't you log-in under your username? The source-site says "Copyright © 2019 London Lions Basketball Club". So, there is no evidence that the image is under a free license, which is required for any upload to Commons (see COM:L). --Túrelio (talk) 21:48, 3 January 2020 (UTC)

• Re: "What more do they want," what they want is for people to abide by copyright law. If an image is copyrighted, implicitly all rights are reserved unless the owner of the copyright grants a license. That has not happened. - Jmabel ! talk 23:47, 3 January 2020 (UTC)

Help updating image

I have updated https://commons.wikimedia.org/wiki/File:VehicleInspectionLawsUS.svg to reflect new laws in WA since Jan 1,2020. I guess my account is too new to replace the image. I have put the new edited version of the image at https://commons.wikimedia.org/wiki/File:VehicleInspectionLawsUS-updated.svg. I would like to upload pictures to Wikimedia commons from the website of Thorcon.

They have a copyright notice at the bottom of their website which says "© 2020 ThorCon CC BY-SA".

• @Terjepetersen: Insofar as the pictures are theirs, probably so (though just "CC BY-SA" is a bit vague, I wish they'd stated a version and/or linked the license); use the "Permissions" section of {{Information}} to indicate that the license can be found at the bottom of http://thorconpower.com/. be careful only to upload images that you can be confident are really theirs or, if not, clearly credited as to license; for example, probably not anything that says "Courtesy of..." etc. (as does the picture to the right of the text on that page beginning, "Rapidly Deployable"). - Jmabel ! talk 08:48, 4 January 2020 (UTC)

Correcting description of image based on Wikidata

Hi, I have been updating w:en:Elizabeth Hay, Countess of Erroll (born Elizabeth FitzClarence, 1801, and wife of the 18th Earl) but have identified the associated image is of the wrong person. According to the source data at the National Library of Wales, it is the wife of the 16th Earl, Elizabeth Jemima Blake.[1] In addition to the source note of it being the wife of the 16th Earl, it was also dated to around ten years before the birth of FitzClarence. I was going to update the description at File:Portrait of Elizabeth Dowager (4670847).jpg but notice it uses {{Depicted person|Q434689}}. I note that the template has an option for either a specific code or for the name of the individual. Should I replace the code with {{Depicted person|Elizabeth Jemima Hay, Countess of Erroll}} or remove the template and insert a text description? @Bjh21: Thanks for the advice but I only encountered Wikidata with my first upload on 31 December. Could you please point me in the direction of a guide on how to get started with it? @From Hill To Shore: d:Wikidata:Introduction is probably the best place to start, though the d:Wikidata:Tours don't seem to be working for me. A simple first edit would be to update Elizabeth Hay, Countess of Erroll (Q434689) to remove the erroneous image (P18) property. If you can't find an item for the wife of the 16th Earl (and I couldn't), then the Create a new item link in the left sidebar of any Wikidata page allows you to create a new one. The editing form is quite good at suggesting properties you might want to fill in. You can also use Elizabeth Hay, Countess of Erroll (Q434689) to find properties you might like to add. You'll probably also want to update the main subject (P921) property of Elizabeth Dowager (Q55012718), and to add a spouse (P26) property to George Hay, 16th Earl of Erroll (Q21886085). --bjh21 (talk) 20:09, 4 January 2020 (UTC)

It is a 100 years old video, which was created by 90y long defunct company. The copyright expires within 70years in Hungary. So it is a free stuff. Can you help me to upload it, because this spam filter look very dumb and stubborn. Thank you!

CumbererStone I re-encoded the file, maybe the filter reads the metadata, which gets deleted on re-encoding. If you use https://tools.wmflabs.org/video2commons/ , you can easily bypass the filter. Or use FFmpeg to re-encode on your computer. -- Eatcha (talk) 15:04, 5 January 2020 (UTC)

Do you consider graffiti a public art?

At first, I didn't have a problem with this until Solomon203 asked me: “所以你認為外牆塗鴉是公共藝術?” The parent category of Category:Graffiti is Category:Street art, but no one explained why graffiti is a public art. People can do their graffiti anywhere they want, such as this file: File:Comic Horizon graffiti area 20180505.jpg.--Kai3952 (talk) 11:43, 5 January 2020 (UTC)

COPYRIGHT of IMAGE

I would like to use on a Wikipedia article a small sample of a Nineteenth Century map, which is published by the National Library of Scotland.

They grant user permission to reproduce from their online maps, on a CC-BY licence.

But Wikipedia seems to want only a CC-BY-SA licence?

Can I put the sample on through Wikimedia Commons, or will it be knocked out?

ArchaicW: Both {{cc-by-4.0}} and {{cc-by-sa-4.0}} are both acceptable here where your should uploaded it. You want to familiarise yourself with Commons licensing. Ww2censor (talk) 18:21, 6 January 2020 (UTC)

Image upload question.

I would like to upload rural population distribution maps from the linked PDF below to the Wikipedia article about the American Frontier. It's digitized by Fraser but I'm not sure if they're a public or private organization. The subject themselves are from the 1910 US Census though. Am I allowed to upload them without Fraser's explicit permission? I would cite them properly of course.

@Killroy is here: Yes, I think you can upload that without needing permission from the Federal Reserve Bank of St. Louis. Based on the filename, I reckon the original document was published in 1914, and anything first published in the US before 1925 is in the public domain. The digitisation doesn't look like it had significant creativity applied, so no new copyright was created by that. "Undefined" at request renaming form

No, it always says "undefined", no matter what I enter into the form. I uploaded a screenshot of the form illustrating the problem. I've found a lot of discussion here about Alamy taking photos from the Commons, but not the reverse situation. I am interested in the following photo on Alamy. Concerns related to two photographs I have uploaded

I uploaded two images just now. The image I have highlighted here is used in the English Wikipedia in the en:2020 JNU Attack article.

This image is a handmade poster which I saw at a Anti-CAA protests in New Delhi today; it has a printout of a photograph taken during the en:2020 JNU Attack which has been all over the Indian media and even in a police media brief.

This is the caption over at the english wiki article - A visual of the JNU attack that was all over the media at anti-CAA protests in New Delhi on 11 January 2020. According to Newslaundry, the girl in the picture (covered in a blue cloth) is DU student Komal Sharma from ABVP. Reference: Malik, Anukriti (7 January 2020). JNU violence: Masked girl in viral picture of mob attack is Delhi University student Komal Sharma? (in en-UK). Newslaundry. Retrieved on 2020-01-11.

Proposing a category move

Hi all, as part of my editing on EN WP I often visit WikiCommons.

I'm hoping for a link to the local process to propose a move to a category, and ideally also a script to help my automate proposing it (like twinkle)

I want to propose a move for a category, but I'm not sure how to do this and I want to respect local convention. I also don't want to just move most categories as I worry I may (1) not be respecting local convention / rehashing old discussions that I can't find or (2) cause a mess. I've tried googling and searching but can't find if there's a usual way to do this.

200 MBs PNG file

Hi, I recently uploaded a map that is in public domain. I uploaded the version that the website allows to be downloaded. However, I have the hi-res image but it is 200 MBs, Is it okay to upload it? Is it possible to upload 200 MBs? The current one doesn't quite show the names in a clear resolution. SharabSalam: As the map is public domain, you can upload a larger version. If the only difference is a higher resolution, you should upload as a new version of the existing file, using the "Upload a new version of this file" link. SharabSalam: It seems it can't easily be uploaded as a new version. I'd upload it as a new file using Special:UploadWizard, which should allow it, then ask an admin to do a history merge, which will make the new image a version of the old file. Hi SharabSalam, "I don't think I need it to be the highest quality", we always recommend the greater size as possible, because we are making this files available to whole Human Kind, we can not predict how, or for who people will use this files. This map can be printed one day, or to be studied is better have the biggest resolution possible. 200 mbs is not a giant file any-more.

Twitter's Terms of Service

From what I infer from their ToS (section 3), it seems that by uploading any content to twitter grants them a royalty-free license to distribute the shared content to the rest of the world and let others do the same. So is it suitable for commons?

@AdillAdell: , this is Mas’hafi (1751–1844)? Any photos or drawings made during his life would probably be in the public domain by now, and could be uploaded to Commons. Later drawings may still be copyrighted. @AdillAdell: , no, there's an image that appears on a few sites in different variants, but I don't see any indication of where it comes from originally. It's probably a scan from an old book, but we'd need to know when the book was published. SVG with embedded file

I'm trying to upload a new, more accurate version of File:RosettaStoneAsPartOfOriginalStele.svg, but when uploading I get an error message: "<a> elements can only link (href) to data: (embedded file), http:// or https://, or fragment (#, same-document) targets. For other elements, such as <image>, only data: and fragment are allowed. Try embedding images when exporting your SVG. Found <image http://www.w3.org/1999/xlink:href="2974d5a2d85405a5.jpg">". I assume this problem is related to the raster image that is embedded in the SVG (which I did not edit when making the new version), but I don't know how to get around this problem. A. Here, we upload media (photos, videos, 3-D models, audio, etc.) that can be used by anyone for any purpose, including on Wikipedia. If you want to see about an encyclopedia article written about your band, I would take a look at the notability guidelines at that project. You will need to have verifiable sources and generally speaking, writing about yourself is frowned upon but not strictly forbidden. @Nattregn: Assuming that your band was at all publicly known and the photos any good at all, the photos are probably welcome here on Commons even if your band doesn't merit an article in an encyclopedia. You don't say what country, but typically photos from the 1980s would still be in copyright, so we would need permission from the individual photographers. We would need those individual photographers (or their heirs) to give permission via the process described at COM:OTRS. I recommend the CC-BY-SA 4.0 license as conforming to our rules while still reserving the right to be attributed if the photo is reused by someone else. - Jmabel ! talk 03:39, 13 January 2020 (UTC)

Reading your User:Nattregn page, it is very unlikely that the band was significant enough to merit mention in Wikipedia. Shortlived, never released any recordings, and as far as I can tell no one went on to more notable bands. You'd need to be able to cite pretty extensive coverage of the band from sources independent of the band to get that into Wikipedia.

Also, I see that the country in question is Sweden. Photos would indeed still be in copyright, with rights held by the photographers or their heirs. - Jmabel ! talk 03:47, 13 January 2020 (UTC)

The images you downloaded were copyrighted and non-free, so you were not allowed to used them without permission of the individual copyright holders. Even if any media may be free to download online, as in free-of-charge, it does not mean, that you can simply use them wherever you like. In fact most recent images are copyrighted, and unless there is an explicit statement about a free licence at the original website, we cannot host them here. Photographs of public buildings < 150 years old

I had hoped to contribute an English language Wikipedia page on the Quartiere Coppede in Rome and wanted to add a few of my own photos via Wikimedia Commons. The district is comprised of art deco buildings, thus early 20th century and less than 150 years old (a criteria I found on the Wikimedia guidelines pages). As far as I understand, these buildings are currently inhabited, if that has any bearing on this. Is it acceptable to publish these photos (mostly architectural details including doorways and gates)? Please do not reupload this image when it has been deleted (File:Laurence Mason.jpg). Doing so is a severe breach of our user rules and may get your account blocked. To restore the file, we need a permission by email coming directly from the copyright holder; please see COM:OTRS for instructions. This permission would also have to include a free licence for anyone to use this picture for any purpose, and not just at Wikipedia. Also, copyright is most often held by the original photographer and not by the person depicted, so Mr Mason may not be in a legal position at all to provide a licence for this photograph.

Declassified Military Photos

I recently have come across a declassified image of the USS America (CV-66) sinking in 2005. A quick look through the Wikimedia gallery for the ship shows that it is not part of the site's archive of the ship, a fact that I find very unfortunate, and wish to see corrected.

The problem, obviously, is that it is not my picture. I found it online. And it is a poor quality image at that. But at the same time, it is by its nature in the public domain, and there are plenty of worse quality images of historical events that are present on Wikipedia that are used because of how important they are in documenting a subject.

So my question is, can I upload this image to the Wikimedia Commons, despite 1) Not being the owner, and 2) Not having the explicit permission of the owner? — Preceding unsigned comment added by K9Thefirst1 (talk • contribs) 04:25, 14 January 2020 (UTC)

• @K9Thefirst1: I'm not sure what you mean by "by its nature". Either (1) it is by a U.S. Government (e.g. military) employee and can be uploaded with {{PD-USGov-Military}} or a similar license; (2) there is some other basis on which it is public domain, and that basis would need to be stated; or (3) lacking a basis for PD, it is recent enough that it would still certainly be under copyright. The subject matter of the photo has nothing to do with the case.

Hey Mates Čiha. As far as images in general taken from online, the answer is almost always no. The vast majority of images online are copyrighted and non-free, and can't be used on Commons. You can however try to find contact information for the person or their organization, explain that you are a Wikipedia editor who wants to improve their article, and ask if they'd be willing to release an image under a free license by following the instructions at COM:CONSENT. Given the important role that Wikipedia likely plays in a pubic understanding of their person and/or their brand, many people and organizations have a pretty strong incentive to help us improve our coverage of them. c:File:Lexican 3 2 index.png with problematic "newer uploads"

Image c:File:Lexican 3 2 index.png, which is a software-screenshot, originally was uploaded in 2011 and received "PermissionOTRS"-status shortly thereafter.
But in 2013, and in January 2020 the file has been overwritten by newer uploads done by a different (and inexperienced user). Each "newer version"-upload did not alter the "PermissionOTRS"-status defined in 2011.
How can we solve this ?
a) Extract each of the 2013- and 2020-version into a unique, new file with respective filename ? Then revert file c:File:Lexican 3 2 index.png back to the original content ?
But realising that these 2013- and 2020-versions are screenshots of a software, it is questionable if these files will violate copyright rules.
b) Simply revert file c:File:Lexican 3 2 index.png back to the original content, as the "newer uploads" do not fit to the original content.
c) Other way ?

The later versions look like copyright violations (or fair use) to me, so I think the right thing would be to revert to the first version and then use {{Overwritten revdel}} to request deletion of the intermediate ones. This is a question that's really for a lawyer. You're going to need to look at your contract in the context of your employment situation and local laws. If they explicitly bought "first publication rights only", then you can do what you want once they've been published. If you were working as an employee or explicitly signed a contract transferring copyright, you probably need their permission. I believe national law might have different interpretations; I'm best with US law. I know lawyers are expensive, but you really need more help than an amateur can give you.

Secondly, if you can upload them, you'll need to work through COM:OTRS to establish you are who you say you are and have rights over this work.

Third, I take it you are the woman described as "India's first woman political cartoonist"? In which case I would find your works a great addition to Commons, and hopefully no one will disagree, but other users who published in local 'zines or even collegiate newspapers might bring up questions of COM:SCOPE.--Prosfilaes (talk) 06:50, 15 January 2020 (UTC)

Semi-protection

Hi, I am trying to upload the profile picture of a contact person who already has a wikipedia entry. He shared with me his picture, but every time I want to upload it, I get a message that the site is semi-protected. I was able to make other adjustments to his entry, so it is only the upload of the picture that is being stopped. Is there a solution to it? • @Valrup2019: There are two separate issues here:
  1. I suspect the "semi-protected" issue is on Wikipedia, not here on Wikimedia Commons, but perhaps I'm wrong. I don't see how uploading a picture within Commons could encounter anything about a "semi-protected page". You were probably using some sort of cross-wiki upload.
  2. "He shared with me his picture" probably does not mean that you have the required license to upload it. Typically, copyright of a picture belongs to the person who took the picture, not the subject of the picture; also, in most countries those rights cannot be transferred orally. We need permission from the photographer. It the picture is online with an appropriate free license, great, indicate that as the source. If not, you'll need the holder of the copyright to grant a specific license as described at COM:OTRS. Either way, attribute the author accurately, please do not falsely claim "own work". - Jmabel ! talk 00:42, 16 January 2020 (UTC)

Vanishing of a file that I uploaded

I uploaded a WebM file File:trwiki-oto-kaynak.webm which was basically a Wikipedia screen recording, created by me. It got deleted because it didn't have source info. That is OK. The strange thing is that it also disappeared from my contributions history, like it never happened. I had some trouble finding the page later. Is it a normal procedure to vanish the contrib history when deleting a page? I think that it damages transparency. Gufosowa (talk) 12:19, 8 January 2020 (UTC)

Why the VICbot is not tagging the images as VI which are nominated by me and successfully passed the nomination? Some examples are :

How to rename a category

Hey Jo-Jo Eumerus. In a nutshell, if you think its an uncontroversial fix, you can move the category page itself using the move tab, just like on Wikipedia. But also like Wikipedia, this just moves the category page and doesn't move the contents of a category. For this you would probably need to use a semi-automated script. Hey Dudley Miles, sorry if this is bothering you. I don't know if that works, but no objection–and since I've never said it I want to thank you for all your fantastic work on nature reserves. I guess I can email you if I need to. The real reason I make the links is so articles have a link to a Wikimedia Commons category on the left-hand side. You can put that in yourself if you like when you create the articles (indeed, it's the most convenient time to do so, as you know which articles have complementary categories). All you need to do is on a Wikimedia Commons category click "add links" on the left, then in the dialogue box put in 'enwiki' in the top row and then your article's title. • @Clamasal: Just to be clear: the issue isn't who might own a physical copy of a picture, but who owns the intellectual property rights. If that's what you meant, not an issue.
• "Full permission" is vague. We need a specific license conformant with Commons:Licensing#Acceptable license.
• If the owner of the rights already has a copy online on a page that is clearly controlled by them, or they can do so, then they can indicate the grant of the license there.
• If not, they (not you) will need to go through the process described at COM:OTRS to grant the license. - Jmabel ! talk 19:22, 18 January 2020 (UTC)

Requests for comment on category name for files from digital archive

The State Library of New South Wales (Australia) has published an extensive archive of negatives from the mid 1960s to the late 1980s from the Tribune newspaper, the official paper of the (original) en:Communist Party of Australia (which is different from the party which currently uses that name). The negatives have been released under a CC4-BY licence and I have been adding some of these to various articles of relatively famous Australians. To make matters a little complex the Communist Party of Australia was dissolved in 1991 and all of its assets were wound up into an organisation called the en:SEARCH Foundation. The question I have is how to categorise photos from this archive? Should it be Tribune (Australian newspaper) Archive? Problem in Uploading

Uploading images over 2000 x 3000 pixels time out. Using "Re-try" also times out. So, I remove the image and try to upload again. No go. @GBGB333: If you want to delete the whole history, you can edit the file description (using the "Edit" link at the top of File:Karen LaMonte examines Cumulus.png and add {{SD|G7}} at the top of the text. I'd suggest that first, though, you upload the version you actually wanted to upload, under a new name, and update the various pages to use the new version. If you only want to delete one version, you could instead add {{SD|G7|Please only delete the first version}}, but I'm not sure if that will work. --bjh21 (talk) 17:38, 20 January 2020 (UTC)

@Bjh21: I assume this was about File:Karen LaMonte examines Cumulus.png. I've deleted the original version for you since you asked, but I can't really see why this was worth the trouble. I have no idea why you cared to prevent that version from being visible.

Also: clearly that image derives from Karen LaMonte's presumably copyrighted work, which you seem to be aware of since you have credited her rather than yourself as the author. You should:

1. Get her overt permission to license the photo. That permission either can be given on a web page clearly under her control (e.g. her own web site or her own public twitter account, which you can then reference from the file page) or should be sent via the process described at COM:OTRS.
2. Correct the "author" to indicate that she is the sculptor and you (however you wish to be credited) are the photographer.

Uploading a photo on behalf of someone

Can someone who understands the whole business take a look at this twitter thread from a verified account and see if permission given here is suitable for use of the photo on wikipedia? (I am still trying to talk the subject and photographer into loading the photo themselves but as with many people, they are not familiar with the wiki and may not do it - but they have given permission for the photo to be used on a verified account so I am not sure if that's good enough or not.)

FIDO DIDO confusion, want to add original FIDO DIDO from 1985

I want to upload a photograph of a T shirt that the artist gave me when I worked at New York Magazine. It has his copyright on it and his name was Johnny, a gay man who waited tables and showed me his drawing of this character and his original CODE OF ETHICS for the character. I see here, that two women are attributed with drawing the character on a napkin just like I saw from the original napkin... and I am a bit confused because when I left NYC he was still the artist. British Library images that should be public domain

Does anyone know if there is a way to get British Library's images that should be otherwise public domain? Like these which are from the 1850, but they are marked "rights-managed" for some reason. --Voidvector (talk) 08:06, 22 January 2020 (UTC)

It may be an idea to upload some of them to commons with the BL copyright claim printed across them, and name them in the filename and description as copyfraud examples. A couple of embarassing blog posts about the BL damaging public knowledge by falsely making copyfraud claims on its public domain and publicly funded manuscripts might help to get the attention of the board of trustees or middle management. • Contributing financially has nothing to do with uploading photos or editing.
• As far as I know, all of our photo contests are open to everyone except the handful of people who are blocked or banned from the site.
• It's a long process for any given picture to become Picture of the day. First it has to be uploaded in the normal manner; then it has to be selected as a Featured Picture. Only then will it be considered for Picture of the Day. - Jmabel ! talk 17:43, 23 January 2020 (UTC)

correcting an incorrect caption in an insert from the Archives of American Art

There has been added to my Wikipedia article on Oliver LaGrone an image of him, which I appreciate. "File:Artist Oliver LaGrone with mallet and "Mercy" model, from- Archives of American Art - Oliver LaGrone-2214(cropped).jpg"

However, the CAPTION includes a mis-statement and spelling and punctuation errors. "Oliver LaGrone WPA Sculptor in his studio" Commas are missing from the descriptive phrase "WPA Sculptor"; the word "sculptor" is not used as a proper noun and therefore should not be capitalized; LaGrone was not in 'his' studio.

The CAPTION should read, Oliver LaGrone, WPA sculptor, University of New Mexico, 1930s

I was wondering what the correct US copyright tag is for old UK Ordnance Survey maps published over 50 years ago, for which Crown Copyright has expired (being a special case in UK copyright law). The photo used by Jepson may have circulated that way.

Hallo, gibt es eine (Spezial-)Seite auf Commons die mir Dateiuploads anzeigt, wobei ich auf 'Seitenneuerstellungen' und auf 'Dateityp' filtern kann?
Ein zusätzlicher Filter, der Bot-Uploads ausschließt wäre gut.
Weder mit c:special:newfiles noch mit c:special:listfiles komme ich zu dem Erebnis.

Hi, is there a (secial-)page at commons which lists user-uploads? The list should be filtered by 'new-pages (first upload)' und 'filetype'.
It should be possilbe to exclude bot-uploads.

Copyvio might be a problem, but we don't have video of most of this stuff. Last time I checked, we have one video of a blowjob, and that's between bats. COM:PORN is a misleading title for a section that says "Low-quality pornographic images that do not contribute anything educationally useful to our existing collection of images are not needed on Commons." • @Milosvlajkovic553: Assuming this is a living (or recent) person, it is very unlikely you can use the photo. Almost any photo from the last 50 years (and many that are older than that) will still be in copyright. You would need a license from the rights-holder, which is typically the photographer. UK copyright - photograph in 1952 Newspaper - author unknown

I have several photographs I want to upload to wikimedia that were published in a British newspaper in 1952. Usually under British copyright the protections expire 70 years after the death of the author, however the person who took the photographs is unknown.

What can I do in this situation?

• Presumably nothing in the next couple of years, since even if the photographer had keeled over while snapping the photo, it would still be in copyright. Correcting a MIDI file

The original version of File:Nannerl Notenbuch - Minuet in G.mid had a small error. I downloaded the file, corrected that error and uploaded it again. The resulting file sounded very different from what I uploaded, so I slightly changed the MIDI format and uploaded it again. Same result. I then recreated the MIDI file from scratch and uploaded that. Same result. I've described what I did at File talk:Nannerl Notenbuch - Minuet in G.mid. The cruical point is that when I play the 3rd and 4th version from the entries in "File history", using the dated entries there, it sounds exactly as I wrote them. The 5th version in that list and the one from the play button at the top of the page are wrong. When I download the latest version and compare it to what I uploaded, they are different. However, when I play the latest version at onlinemidi.com via https://www.onlinemidi.com/Editor.php?wp=https://upload.wikimedia.org/wikipedia/commons/8/89/Nannerl_Notenbuch_-_Minuet_in_G.mid it sounds correct. Hey Mamata Padhi. It looks like this textbook was published in 1985, which is quite recent as far as copyright goes. So it's not clear why this image should be available under a free licensed or in the public domain. Commons only accepts free images, and does not accept images from non-free copyrighted sources. • @Rosiestep: If you want them deleted, you can nominate them yourself and ask for the to be deleted as a courtesy. As far as I know she's not notable enough that there would be a particular problem in granting a courtesy deletion.

@2600:6C50:17F:F95C:E0E7:6796:F727:D6D7: No. When uploading things to Commons, it says "When you upload your work to commons you are donating it to the world by using a free content license which allow everyone to use, modify, and redistribute your work for any purpose. Copyright issue

I imagine this question has been asked hundreds of times, but I can't find anything in the archives. How do you know if an image that is taken up by all the press, blogs, private websites etc, has a copyright or not? @Raresvent: Everything is copyrighted upon it completion, until the legal term that made that work enters its public domain. Though the image come from a blog, and have no copyright notice, the blogger still have the copyright. A work is free only if it is in public domain, or it is licensed under a free license. Hi Sir, I just read on Special:UploadWizard page which says: "By sharing your work on wiki media commons, you grant anyone permission to use, copy, modify and sell it without notifying you" Does it grant to produce the prototype of a product and take over their rights on the products??

Example: If iphone11 is on wikipwdia then can anyway take over the company's right?

What the person has uploaded is an image of the phone, not the phone itself (see La Trahison des images by René Magritte). Only the image can be used, copied, modified etc. under the terms of the the Wikimedia Commons’ license. If someone were to make a model of the phone for their own private use then it probably wouldn’t break any laws. However, if they went on to sell copies of that model then (as far as I understand such matters) in most countries this would be against the law as the design of the phone would be covered by Intellectual Property legislation and possiblity also Patent Law.

At the same time, even if the full design specs for a device were released under a free license, there may still be restrictions not-related to copyright, including infringement on trademarks and patents. Can I uploading a screenshot (snip) from a band website, that lists opening acts?

I was editing the page for the New Jersey band Save Face to add in their appearance at a Motion City Soundtrack concert I went to. I went to MCS's site which lists the tour dates and at the bottom lists all the opening bands. It said I had to make an account to upload images so I did and now I'm being told I have to own any images I upload. There are NO LOGOS in the image, NO people, just generic font and the names of bands (There are weird symbols being used in place of * with are placed next to the corresponding dates, but the dates are not in the image JUST THE BAND NAMES IN GENERIC FONT. Two of the symbols are a C in a circle and an R in a circle respectively but they ARE NOT BEING USED as copyright or Registered Trademark symbols.)

I would like to upload this image to the page but I don't want to say I own it, I don't really think anyone does, it's just a bunch of band names, no logos, no nothing. SO if I can upload this then please tell me how I do so. Do I just check the box and not worry about it or is it disallowed? • If something is public domain, then anyone with an account can upload it. Improving my user page/user category

I've started to become a little more active here, so I'd like to (a) have a category with my works, as I've seen for other users, and (b) have my user page contain a gallery with those works (mostly photos, and a few videos).

For the first thing, have I created Category:Images taken by Sdkb correctly, or is there another way to do it? Is there any way to set things up so that new uploads I mark as self-published work will be automatically added? Should I create a separate category for my videos, or rename my category to something like Category:Works produced by Sdkb so that it'll be able to include videos?

For the second thing, what code do I use to get the gallery to appear? Thanks for the help! Sdkb (talk) 06:59, 29 January 2020 (UTC)

@Sdkb: Hello, and welcome to Commons. Regarding your first question, I could find Commons:User-specific galleries, templates and categories and two categories (Category:User galleries and Category:User categories). Based on these pages, I think there is no standard for user categories. We have categories like Category:Files by -Strogoff-; they refer to all files uploaded by a user. "Works produced by..." is also a good idea, but you can only add it to files that you have created, not necessarily those you have uploaded (for instance, I haven't created File:Azadi Motorcylce Circuit 2019-08-10 15.jpg, but I have uploaded it). We also have categories like Category:Monkeys by user:Alexkom000 (subject-specific) and Category:Audio files by Pleclown (type-specific), so there should be no problem with creating a separate category for your videos. To my knowledge, you have to add the category to your files manually. You can use cat-a-lot (or other similar tools) to do it faster, but it's most useful when you have many uncategorized files, not just a handful.

Regarding your second question, I suggest using {{MyGallery/userbox}} as an automatic method to do so. Otherwise you should add your uploads manually, at least as far as I know. I personally suggest using the template, it will also make your userpage's load speed faster. In contrast, using images directly will lower the load speed of the page. File edit dispute

Myyrmanni bombing in Greater Helsinki

I and User:Ralf Roletschek seem to have an edit dispute about the name of this image. I have requested to rename it to File:11-07-31-Vantaa-by-RalfR-046.jpg, because the picture is of Vantaa, not of Helsinki, but Ralf Roletschek keeps reverting my edits, because it's used in a page where all the other images also have "Helsinki" in their name. I think I'm with Ralf here, partly because we have a strong preference for stable filenames. Description is really where to sort this out to the facts. But it is a little tricky, and does require some local knowledge as to whether the locals routinely make this distinction and would find it actively misleading to call this Helsinki. To take an example from a city I know better: people often refer to the only Ikea in the area as the "Seattle Ikea" even though it is 10 or so miles outside city limits in a part of Renton so bland it has now come to be known as the "Ikea District", but would object to using "Seattle" in referring to something in downtown Renton. I agree that this name should not be changed. For another example, we have a category called Category:Las Vegas Strip shooting, with many files referring to just the Las Vegas shooting, despite the fact it happened miles south of Las Vegas. It annoys my inner pedant, but even some locals don't know the Strip is not within Las Vegas, and nobody ever refers to the Winchester shooting. "By this logic"? I said nothing about what you should name a file, merely about when a filename should be changed. Taking a closer look at the original case, File:11-07-31-helsinki-by-RalfR-046.jpg is a lousy filename, and changing Helsinki to Vantaa doesn't help one bit. It's not something to fight over, but if it is to be changed, "Myyrmanni shopping centre in Vantaa Finland 11-07-31 by RalfR.jpg" would be something worth changing it to, not a name that leaves it completely unclear what's being photographed.--Prosfilaes (talk) 21:37, 2 February 2020 (UTC)

There's still something I'm not understanding here. If everyone here agrees that Myyrmanni is in Vantaa and not in Helsinki, and file names are a mere technicality and not a big deal, why is everyone so adamant that the file name must remain the same and include "Helsinki"? I agree that "Myyrmanni shopping centre in Vantaa Finland 11-07-31 by RalfR.jpg" would be a much better name than the one I proposed, but why is everyone so opposed to correcting the misleading name? US Tags and UK copyright law.

Unrelated to my previous post, I would like to upload a diagram from a book with no given author published in the UK in 1947 (and therefore out of copyright in the UK). There would appear to be no suitable US public domain tag here, since neither PD-1996 or PD-US-Expired (which cover works published outside the US) apply.

As far as I can tell from doing some research, this may be because in theory the original copyright could have been renewed in the US after 28 years and so would therefore still be in force, although it is highly unlikely this would have been done (and the publisher no longer exists). In order to establish this for certain, however, it seems a fee of $100 is payable to the US copyright office.

Since it merely represents data in graphical format and is one of many such images in the book, it could be argued that reproduction of the diagram is fair use of the material (especially as the data is presented ONLY in graphical format).

US copyright law had a bunch of technicalities that were especially hard for foreigners to follow. When US finally signed the Berne Convention, other countries demanded that the US restore copyright to works still in copyright in their home nations; the US did so in 1996, but otherwise does not follow the rule of the shorter term. Thus any UK work that was in copyright in the UK in 1996, and couldn't be considered a US work, got treated as if it followed those technicalities and thus were in copyright for 95 years from publication. Unless said work was published within the US within 30 days of first publication, it's in copyright in the US until after 1947 + 95 = 2042.--Prosfilaes (talk) 22:06, 30 January 2020 (UTC)

Having done some further research I’d just about reached the same conclusion... evidently it isn’t necessarily a good thing that all of Wikipedia’s servers are located in the US. However, I’ve discovered that there may be an earlier version of the the diagram, which if it exists will be out of copyright in the US within the next 5 years – so hopefully within my lifetime! There may, indeed, be a way of circumventing the problem entirely by using more modern data that can be obtained under the Freedom of Information Act 2000 or is already in the public domain.

The situation with the 1947 work is slightly complicated by the fact it doesn’t list the original sources of the data on which the diagrams are based (which would have not belonged to the publisher) and most of them, although redrawn, had been published previously in 1929/30. Even these, in fact, were in all likelihood not based on “raw data” but were simply copies of others (note that according to advice I have received from the Ordnance Survey, contrary to the situation in the UK and European Union, current US law offers no protection to publishers who redraw or substantially alter copyright-expired maps even if substantially altered at great time and expense, and I presume this extends to all diagrams).

You do raise an interesting point concerning the reason why the copyright was restored (in my opinion in an extremely clumsy manner). Since the purpose of the legislation was to meet the demands of all signatories to the Berne Convention at a stroke, I suspect that a fair case could be made in court that since these countries could not reasonably expect greater protection under US law than under their own – and indeed were not seeking this, the law is unreasonable. As I am guessing you know already, typically judges base their findings not just on “the letter of the law” but the rationale behind it and clearly in this instance the context is important. Do you know of any rulings on this point?

What is the work / items under question? It's a lot of easier to talk about relevant details for copyright if we know more about the work in question.

I don't think that's correct, and certainly puts emphasis on the wrong issues. Creative work gains a copyright; a one-minute sketch map almost certainly is copyrightable, even if it's based off a copyright-expired map. Simple copying does not garner copyright in the US, no matter time and expense; hand-traced, photographed or scanned and auto-traced copies of PD maps aren't going to get a new copyright, no matter how tedious and careful the copy is. Substantially altered works are almost certainly going to get a new copyright in the US, even if it might be thin, only covering the exact changes.

The law says what it says, and it's pretty clear the intent was to do what it says. It also says the Berne Convention is not part of US law. Judicially-made "rule of the shorter term" would be pretty extreme.

Personally, I oppose the rule of the shorter term, for two reasons.

For one, intertangling national law is problematic. US lawyers and judges know English and are trained in US law and how that's interpreted. Asking them to interpret laws in Estonian or Chinese, from legal traditions of interpretation quite different from what they've been trained in, is problematic, unreasonable and unpredictable. There may be necessary cases, but I don't see this as one.

For another, without the rule of the shorter term, the UK increasing its copyright duration wouldn't affect trade balances; it'd be largely Brits being helped and Brits being hurt. With other countries supporting the rule of the shorter term, the UK increasing its copyright duration would increase the amount of money coming from foreign nations to the UK. This has been cited as part of the reason why the EU went life+70 when most member nations were life+50 and the US added 20 years to its copyright durations.--Prosfilaes (talk) 21:03, 31 January 2020 (UTC)

What I was told by an authority was that, say if I was to convert (extract) features from old Ordnance Survey maps into vector format by hand, then I would be able to claim copyright over the result in the UK and EU, but not in the US. I suppose it comes down, at least on part, to how one decides if something has been ”substantially altered” or not.

My original query was about railway gradient diagrams, which aren't quite the same as artistic works as they’re simply a representation of data (in often the only form available). If the data was presented as a table, then there probably wouldn't be an issue – I’ve encountered many tables on Wikipedia that are extracted from sources which (as a whole) are subject to copyright and I was wanting to use only one of several hundred diagrams in the 1947 book.

I can understand why you would discourage the adoption of a rule of the shorter term to works published outside the US, although I’m not convinced it would necessarily be that difficult to implement in US law, at least if all that one is concerned with is the length of term itself (which is precisely defined). As to such a rule encouraging individual countries to increase the length of copyright, I can see that this may be a problem, but then the situation, as it stands, is proving problematic for me! I think there are factors which work against countries having lengthy copyright periods, one of which is that it can stifle innovation and wealth creation with the counties themselves. For example, many special interest books of a historical nature simply wouldn't then get written, as the cost of including images would wipe out (or even exceed) any profit to be made from the relatively small audience – and there's also the issue that in many instances, as time passed it becomes difficult or impossible (not to say costly) to determine who the current copyright holder actually is.

Incidentally, I discovered a fairly clear summary of US copyright law at [6] which you may be find useful to refer people to in the future.
