All these images can be found on http://birdsofsanibel.free.fr. The versions on Commons are of bigger size, but are by no means more detailed (in other words, it seems that the images are from the website mentioned above, and the uploader just artificially increased the image size to make them look like the original shots). Also note the absence of EXIF metadata, which would be very strange if these were indeed the originals.
The uploader left two messages on the Village Pump (COM:VP#Request for assistance and COM:VP#More bird images) where he implies he is the original author, but I think it's very unlikely. –Tryphon 14:07, 9 August 2009 (UTC)[reply]

I wrote a reply underneath that was saved and refutes this nasty claim. My email at my website and my email for my registration on Wikepedia is the same. Case Rested!!

The website has Peter Wallack's email and phone. The email is the same as the one registered with Wikepedia!!!!! There has to be a better way than making accusations without investigating. You just guessed and assummed. Look at the first three letters in assume and be a little self reflective.

 Keep I do not see a reason to doubt that the images were uploaded by the author despite of the lack of EXIF data. I also think a change of the license on Wallack's site to bring it more in line with Commons licenses would go a long way towards clarifying this issue. --Jarekt (talk) 18:40, 9 August 2009 (UTC)[reply]
 Keep As Jarekt, I don't see any reason to doubt that the images were uploaded by the copyright owner. Peter Wallack should be made aware that, by publishing them on Commons under a free license, he allows anyone to use his images for any purpose, including commercial use. You can become my "friend" and then post to the MOHEGAN WOODS DAY CAMP asking about me; this is a 25 years reunion page and the members of the group were counselors and campers at that camp which I owned and directed.

You tell me that all the bird images are from BIRDS OF SANIBEL at http://birdsofsanibel.free.fr/. How small your knowledge of geography and bird range and how little time looking at what I contributed. It says at http://birdsofsanibel.fre.fr/ that I have another house in Santa Fe. Half the bird photos I contributed are from New Mexico. Here is just some birds on that list: Western Scrub Jay, Spotted Towhee, Black-headed Grosbeak, Canyon Towhee, Western Bluebird, Gila Woodpecker... Didn't the word western give it away. Go to a Bird of North America book by National Geographic and check the range maps.

You also insult the quality of the printing. You are not qualified. You are a bore; a little authority fits under "Power Corrupts" for you. You owe me apologies for calling me a theif and insulting my work. Otherwise, delete everything.

You should have googled my name and you would have come up with places like the Callosahatche Bird Club where I did a slide show; Vince McGrath and I birded together and he could have been asked about the veracity of my persona by asking Vince to go my Facebook image. There are dozens of other ways you were asked to investigate to find out you were wrong. A leader, a confident man, a scholar, or a man of justice would have investigated as I indicated. Instead you use the cloak of your pseudonym and veil of the internet to be an unjust and unscholarly insecure fool. Your so weak it is ridiculous. You slander me and hide; you are an internet bully. Shame on you.

As I already told you on numerous occasions, you need to send a mail to OTRS as a proof that you're the copyright holder, and to make it explicit that you release your images under a free license (which also means they can be used commercially, outside wikipedia, etc.) All I'm doing is protecting Peter Wallack's rights (meaning yours, apparently); anyone could have created an account on Commons named Peter Wallack and uploaded your copyrighted files without your agreement. As for my comments on quality, I just pointed out that the high resolution images you uploaded were in fact blown up from the smaller ones on your website; look at them full screen, you'll see what I mean.
And to both people who voted to keep the files, I'm a bit surprised. The files are available on the internet under a clearly non-free license, and the uploader has made several comments that seem to indicate he does not fully understand the extent of the rights he gave away by posting them here. I'm pretty sure we need to clarify this through OTRS before we decide to keep the files. –Tryphon 15:40, 10 August 2009 (UTC)[reply]

Dr. Wallack: I filled out that form where I was linked but I guess you will have to email me one of those forms. BTW, I may have screwed up that page. :) My only resistance to this is it is unfair to many like National Geographic who have paid for a license of use to now give it freely to commercial competitors. I really do not understand why you would want to give this to commercial enterprises. PLEASE EXPLAIN THAT TO ME. BTW, as you see in my website quoted above I have always given these images to hundreds of educational organizations like you so I will never stop that in the future. Also non-profits, state environmental refuges for birds, the National Parks, NBII, and many other government agencies use these images already. I also allows individual students and adult learners to use the images including people who do power point presentations for groups like Audubon. Just google my name and these uses will be on 20 something pages because my name is always attributed. My effort with Wikipedia was to have them get these images because it seems you didn't GET IT ( that possibility ) yourself. My original copyright will always be the legally dominant copyright; your copyright will apply to your dissemination. I truely hope you have no intentions of actively contacting possible commercial users for I am sure they are not approaching you in a way that would, as said above, make previous license holders annoyed. I really have more than enough money now and for many generations; my concern is not money but fairness, integrity in my dealings, and respect for those who did buy licenses.

ADDITION 8 HOURS LATER: Filling out another form will have to be facilitated by all of you by 10 PM USA MT today, August 11. Tomorrow I go onto the slabe for knee surgery. I do not know when I can finish off this business with you. If you are going to delete 25 hours of uploads AND PREPERATION FOR UPLOADS do not expect for me to repeat that work. I do thank those who did COMPLETE CATEGORIES FOR ALL MY GALLERY IMAGES, as asked above, on their own effort. I do thank those who figured out to right click the images selecting properties to get the Metadata they wanted. I DO HOPE PATIENCE AND SOME MORE WIKIPEDIA PEOPLE HELP SORTS THE REST OF THIS OUT.

                  • When the 1/2 of the images from http://birdsofsanibel.free.fr/ were transfered by me all that could be improved were improved. The website has the results of Photoshop 6. I have had Photoshop CS2 for a few years. Also, I was still learning Photoshop in 2001- 2003 under Guilio Zuljani, my Photoshop Mentor from 2000-2003, who can be googled to verify that indeed beyond question I am the copyright holder and author. CS2 has Image-Adjust-Highlights Shadows, Filter-Noise-Noise Reduction, and Auto Color which are super for images originally taken in sunlight with the sun low in the sky and behind me usually between the shoulders. One observor here said the images from the web had no more detail. Wrong!!! Study the Eastern Phoebe and see the yellow of a Tryant Flycatcher from mid to lower torso in the gallery here and a hot spot on the website.. Study the website Ring-billed Gull and the one posted here and see my ability to use the Color correction of Image-Adjust-Color Balance is markedly improved in the last 6 years. There are many more examples of completely new detail that that is another area for apology by obviously a less than fine art photographer, not reading my bio of fine art photography on the website, made without any real ability to evaluate honestly. How disresptful!!

You can e-mail me whether or not you have deleted my whole gallery because my wife can do the email and print it for me. I think I deserve to know when that is decided; not doing it will only reflect on your ability to deal with published/gallery fine art photographers. This could prove to be an unfortunate mandate for several relevant articles in various magazines, newpapers and websites.( see profotos.com )
