[edit]The building was completed by architect Zaha Hadid (1950–2016) in 2014. Unfortunately, there is no freedom of panorama in South Korea. The copyright term in the country lasted for 70 years, and the images can be undeleted in 2087.

- DDP has a notable portion in the image, IMO it fails de minimis. Removing DDP would make the image largely different, or even not useful anymore. --A1Cafel (talk) 09:48, 21 January 2021 (UTC)

- Are you really saying that there cannot be any non-commercial picture of a South Korean building from the last 70 years at all on Wikipedia? The Template:NoFoP-South Korea/en template states: "This image features an architectural or artistic work, photographed from a public space in South Korea. Article 35 of the Copyright Act (Act No. 432 of January 28, 1957, as amended up to Act No. 14634 of March 21, 2017) provides freedom of panorama exception, but for noncommercial purposes only. In particular, the exception does not apply if "the reproduction is made for the purpose of selling its copies." Warren Whyte (talk) 17:44, 10 January 2021 (UTC)
- @Warren Whyte: sorry but noncommercial purposes is not allowed in Commons. It fails one of the criteria at Commons:Licensing#Acceptable licenses. Also: there was an existing court case outlined by Explicit last year (though it is not yet written at COM:CRT/South Korea). This court case solidifies no Commons-acceptable FOP in that country. You may have a glance of it at Commons talk:Copyright rules by territory/South Korea#Add example of FOP?. Unless Seoul reforms and amends their copyright rules to remove noncommercial restriction, Commons cannot accept images of South Korean buildings and sculptures whose designers are still living or have died recently. Permission from the heir/s of Architect Hadid (as she is already deceased) is required. JWilz12345 (Talk|Contrib's.) 01:56, 14 January 2021 (UTC)
I put this in Discussion, sorry I am not too good with how the edits are supposed to be done here:
The linked copyright page seems to focus on Article 35 of the WIPO https://www.wipo.int/edocs/lexdocs/laws/en/kr/kr058en.pdf
Article 5 states:
Article 5(Derivative Works) (1) A creation produced by means of translation, arrangement, alteration, dramatization, cinematization, etc. of an original work (hereinafter referred to as "derivative work") shall be protected as an independent work.
These are artistic photographs, that are a derivative works and fall under their own copyright. The relevant statement of Article 35 seems to be
"(4) A portrait or a similar photographic work produced by consignment shall not be exploited without the consent of the consignor. "
As mentioned, the photographs are not a portrait reproduction, rather derivative creative works. — Preceding unsigned comment was added by 71.172.242.243 (talk) 03:46, 9 January 2021 (UTC) — Preceding unsigned comment was added by 128.235.169.10 (talk) 14:29, 11 January 2021 (UTC)
- @Explicit: for this. JWilz12345 (Talk|Contrib's.) 01:56, 14 January 2021 (UTC)
- Delete. Per COM:FOP SK, there is no freedom of panorama in South Korea. FOP encompasses derivative works of architecture/structures and 2D/3D works, and the allowance of such derivative works are exemptions in a country's copyright law. However, South Korea's stipulations simply don't allow DW to be free enough for Commons' purposes. ƏXPLICIT 23:51, 14 January 2021 (UTC)
- Delete all, sorry @钉钉: , COM:DM doesn't apply to South Korea due to Commons:Deletion requests/Files of the exterior of the N Seoul Tower in Category:N Seoul Tower. --Liuxinyu970226 (talk) 01:53, 2 February 2021 (UTC)
- @Liuxinyu970226: Comment Look at this COM:DM South Korea. And there is a case where photos were undeleted accordingly. See Commons:Undeletion requests/Archive/2021-02#N Seoul Tower photos were deleted without FoP. Ox1997cow (talk) 14:00, 20 February 2021 (UTC)
Deleted: None of them appear to meet COM:DM except File:Dongdaemun Design Plaza at night, Seoul, Korea.jpg, a borderline case. Given that it is used in some Wikipedias to illustrate the Seoul skyline as a whole, I have cropped the bottom to emphasize the panoramic nature of the photo. --King of ♥ ♦ ♣ ♠ 04:30, 30 July 2021 (UTC)
