- Concernant MuseeDesColonies-SalonDuMinistreReynaud.JPG il ne s'agit pas de l'oeuvre d'Albert Laprade (mort en 1978) mais cela ne change pas l'existence d'un problème de droit d'auteur car, si le mobilier est de Jacques-Emile Rhulmann (mort en 1933, donc il y a plus de 70 ans), les peintures sont de Louis Bouquet (mort en 1952) et donc encore soumises au droit d'auteur jusqu'à fin 2022. Concernant MuseeDesColonies-SalonDuMaréchalLyautey.JPG, il ne s'agit pas non plus de l'oeuvre d'Albert Laprade (mort en 1978) mais également cela ne change pas l'existence d'un problème de droit d'auteur puisque le mobilier et l'habillage sont d'Eugène Printz (mort en 1948, droits d'auteur jusqu'à fin 2018) et surtout les peintures de Ivanna et André Lemaître (morts en 1973 et 1965) dont les droits d'auteur s'éteindront fin 2043 et fin 2035. Faute d'information contraire, on peut effectivement supposer qu'Albert Laprade est l'auteur des couloirs et escaliers à l'intérieur du bâtiment et qu'il dispose encore de droits jusqu'en 2048 pour MuseeDesColonies-EscalierEst-1erEtage.JPG, MuseeDesColonies-1erEtage.JPG et MuseeDesColonies-EscalierEst-RdC.JPG. - As I said before, I haven't seen any photo of him that is like this image, the closest might be the mugshot, and you can see many differences. We should be able to see the one it is based on since the only images of him there are are publicly available. I would say the face is an entirely new likeness created by AI, and since there is no copyright for likeness per Commons:Fan art, there is no violation as far as the facial image goes. (For what's it's worth, I tried to do one, but the AI site refused citing violation of its rules, presumeably by that time it already knew that the image might be controversial). - From the discussion above it sounds like the evidence we have is that the image clearly looks AI-generated, and that the Instagram user ticked the box for "can indicate a wide range of AI use" when sharing it to social media. But Commons needs to know that it does not contain sufficient human authorship to support a copyright claim to be able to mark it as PD, and I don't think we've seen enough evidence for that yet.

- No, it's the other way around. The onus would be on the uploader to prove that the image was prompt-generated. They might be able to do that by linking to an archived copy on the AI service, or by specifying the prompt and service and showing that very similar images could be created on demand. That could happen here if we get in touch with the Instagram user, but it hasn't yet.
