I am sorry, but this sculpture has been installed in 1995[5] and there is likely still copyrighted. Regrettably, Commons:Freedom_of_panorama#Russia is valid only for buildings and garden design. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Belgium. Being the author of some of them I humbly reject the opinion that "[s]ome of them have a tag indicating that the coin is a banknote, but this is not the case;" this sounds like authors such as myself were lying when they applied the {{Money-EU}} template. My English is not good, and I went by the text of the German translation of this template, which uses the expression "Währungseinheit" (unit of currency); the Spanish translation says "dinero de euros" (euro money). Even the English version said "unit of currency" until 2011-01-21 and, until that same date, the French wikipedia version used the term "pièce de monnaie" (= coin)! In regard to File:Maidan Nezalezhnosti 001.jpg: from some other angle, the focus would be only on the tree, but in this case the focus is on both the tree and the monument. In regard to the rest, per COM:DM#An example, what matters is the photographer's intent and one cannot make a work de minimis by including more of the surrounding area. The only reason to tag all these images as images of the statue was participation in WLM: images of monuments were accepted (this statue is a monument), but images of the whole square were not (the ensemble of the square is not protected as a monument). Thus people did tagged these images as those of monuments, although many names (like File:Maidan Nezalezhnosti 001.jpg or File:Вечірній майдан.JPG) indicate these images are views of the whole square, not of that particular monument — NickK (talk) 17:02, 7 May 2014 (UTC)[reply]

Some of these images are illustrations to articles. Because you want to delete all the images of this object, the Wikipedia remain without illustrations. A part in the WLM will be for you a clue where to look for pictures to be deleted. It turns out that people are trying to send pictures of the object, and you are removing. De minimis doesn't depend on the size of the images but on the purpose of the photograph and whether the shown parts are above the threshold of originality. See for example this court ruling from the European Court of Justice. Showing coins is one of the main purposes of the image (the file name even mentions money), and the coins are clearly visible. There's no problem in using images of the designs of euro coins. I wrote the european central bank and various central banks of europe. The problem is when you use images of an specific web page. I made the photographs of every coin I uploaded. Euro images CAN BE USED because they DON'T HAVE COPYRIGHT RESTRICTIONS. European central bank even told me that I could use the images in their web page if I cite them as authors of it. That's even written in their web page!! This means that you cannot use images of the coins to create parodies of the Euro or any other derivative work. And that means that they are not free enough to keep on Commons. Euro coins are more complex than that. There is one common side, shared by all countries. The European Central Bank owns the copyright to this side of the coins and decides the restrictions, and the conclusion on Commons is that the common side is unfree. Therefore, pictures of the common side may not be uploaded to Commons.
There is also a national side, for which the restrictions depend on the country of issue. For the national side of the coins, coins from Latvia are fine per {{Latvian coins}}, while coins from Finland probably are fine per {{PD-FinlandGov}}. Lithuania will introduce the euro on 1 January 2015, and Lithuanian euro coins will be fine per {{PD-LT-exempt}}. The national side of the coins from other countries are not fine, and can't be uploaded to Commons without OTRS permission from the copyright holders. I asked if I could use the images to write an article in wikipedia and they answered "yes, you can if it is not detrimental to the image of the euro". The use of the image, as I used it, is not detrimental in ANY WAY to the euro. It's not a parody either. Yes I see it has been discused but I think it's a mistake. Commons requires that all images hosted here are free for any use by anybody anywhere. Your WP article may be perfectly all right with the Bank, but that is not enough to keep it here -- they must be OK with any use, even parody, which, obviously, they are not. Eric Koch made photographs by order of Anefo. Anefo owned the copyright. The database and copyright was transferrred to Nationaal Archief. Because these photo's were made for publicity reasons, we can safely assume that Yves St Laurent was aware of the fact that the copyright would be owned by Anefo. The exception, Mondriaan's paintings, fall under the freedom of panorama.

@Natuur12: Sorry, but this decission is counterproductive and in opposition to everything mentioned above. FoP simply isn't necessary here, because the photographer obviously had the permission to photograph and publish the artworks included in this picture. It's just absurd to assume, that professional photos who are in use for decades, become copyvios in the moment they are donated here, just because they are legaly based on permissions that are not so common among amateur-commons-photographers.

An undeletionrequest has been done and has been rejected so I'm not going to spend any more of my time to discuss this but generally we asume that the license is valid for the actual photograph and not for the underlying work. If you think that ANEFO has permission to publish the underlying work under a creative commons license (the photographer didnot had such permission since you had no cc-licenses back than.) mail them and send evidence of permission to OTRS. FoP is not necessary as long there is credible evidence, that the photographer had the permission to shoot and publish this picture by the copyrightholder of the works visible in this picture. It's absolutly irrelevant if this permission for the work this photo is based on explicetly named a CC-licence or not, as long as it didn't include any restrictions incompatible with that licence. And considering that this image series is arround for almost 50 years, including highend fashion and art publications, it would be just absurd, to assume that it has been a copyvio ever since.

Likely they use the work under the citaatrecht, you can compare it with fair use but it is way more restrictive or they use some provision for newspapers etc. Both are not compatable with the licensing policy of Wikimedia Commons. It is unlikely that they ask permission of copyrightholders of underlying works like this painting to release the images under cc-by-sa-3.0 and they don't mention this at their website either. You assume a lot (the part where you claim that I didnot concidder all the argumets is clearly false for example.) but still, hard evidence for your claims is still missing, for a deletion however, we only require that there is significant doubt. However, the location is France where there is no FOP at al, my bad, but better clearify this but is also matter where the file has been published for the first time to determine which laws apply. No, I am speaking only about logos of organisations. Logos that are not logos of organisations (e.g. uk:Файл:Емблема ФК Княгинин.gif) are not in public domain. I don't see why RfC is needed here, it's a question of copyright, and one should prove that a given logo is indeed a logo of an organisation. It can't be done by a mass undeletion (and anyway it's not an issue of a mass, as many logos already exist and were not deleted), as for each case a proof is needed that it is an official logo of an organisation (as projects of logos are copyrighted and logos of unregistered organisations are copyrighted as well) — NickK (talk) 14:11, 25 October 2014 (UTC)[reply]

I am not sure I will be able to provide all proofs, but I can confirm that it is not true that provided logos are mostly or all unfree, they are mostly or all free per {{PD-UA-exempt}}. It's true that we haven't asked our partners if the logos they provided are their official logos, and it could have happened that some logo is not an official logo of a registered association. But even if it happened, this logo would be by far COM:DM compared to the rest of the album, as it would take some 1% of 1 page (out of 68), thus about 0.02% of the entire album. I believe that an image with 0.02% of space displaying a non-free logo would be considered free, especially given that this particular logo is not the main object of this file — NickK (talk) 21:07, 26 October 2014 (UTC)[reply]

If you only need this file for your user page please categorize it as user page images to solve the problem. As the image, at least in this small version, nevertheless looks very blurry and all in all of very low quality I strongly suggest to replace it with a much better one.   • Delete based on uncertainty. The direct source is this Wall Street Journal article, and the WSJ's source was the Justice and Treasury Depts. I uploaded it on the basis of the source being US government sources which are public domain, but there is a possibility that the WSJ has a copyright issue if they chose specific green bubbles in the chart, or they have some kind of copyright based on their choice of chart. I do not know if the chart was copied identically from a US govt source, or whether the WSJ substantially modified them. Derivative works of coins. Some of these images have a copyright tag which tells that you can use images of banknotes in certain situations, but coins are not banknotes, so that copyright tag isn't applicable here. Some of these images lack evidence of permission from the photographers, which is required for currency images according to COM:ART.

We are missing permission from the engravers and sometimes also from the photographers. {{Money-EU}} can only be used for banknotes, but a coin is not a banknote.

These commemorative euro coins from the Netherlands are, just like the national sides of the "normal" euro coins, copyrighted. In an earlier undeletion request it is ruled that, although published on the Netherlands national government site under {{Cc-zero}} and although these coins are made commissioned by this same goverment, we apparently cannot be sure that the site has taken care of permission by the artist. By the wording of my request, you can read that I have problems with that decision, but if taken, then by consequence these images have to be deleted as well.

  • Comment: It looks like an interesting exception to what we are used to. I usually favor the deletion of coin images when they are not free, but here the images are clearly released through a CC-0 statement on an official website of the government who owns the copyright. Can one say, without splitting hair, that the ministry of the Prime minister (who publishes the website) is violating the copyright of the ministry of Finance? People should be expected to believe that the official website is telling the truth and that it has been making the release in full knowledge and with full authorization of the relevant government institutions. If not, it's the problem of the governement, not of the citizens. It's hard to imagine a court ruling in favor of the minister of Finance suing a citizen because the citizen believed the explicit written authorization given on the official website of the ministry of the Prime minister. The citizens must still respect the non-copyright restrictions on the use of designs of currency and the government authorities probably consider that those non-copyright restrictions are sufficient. Regarding the artist, I think we always assume without difficulty that the governments have legally and validly obtained the rights from the artists who designed their coins. I don't know why we would make an exception here. (However, I think we should make the effort to always mention the artist, even if the patrimonial rights are owned by the governement.) I suppose we can say copyright assignee, or copyright possessor, or copyright holder, or another expression, for the notion of patrimonial copyright owner (as distinct from the notion of the author or full original copyright owner), but the idea is the same : it refers to the person or entity who is legally in actual possession of the patrimonial rights and exercises them. The governments reproduce those designs on millions of coins. Almost all governments also publish images of their coin designs in publications in print and on their websites. Like I said above, I am under the impression that we routinely accept the assumption that the governments who commission artists to design their coins have validly obtained the assignment of all the patrimonial rights they possibly can obtain from the artists on those designs, unless someone can provide evidence to the contrary. I think that is a reasonable assumption, that the governments obtain from the artists a general assigment of the patrimonial rights, not only a limited permission to use the design in limited circumstances. Or maybe not. I don't know if our principle of precaution could imply that we should challenge the statement of the Dutch government and ask them to provide a copy of their contract with the artist to prove to us that the assignment contract allows the government to do what they do with the images. It does not affect the moral rights, which remain with the artist. Moral rights are not considered by Commons to be an obstacle to hosting media, as long as there is no problem with the patrimonial rights. Another aspect of the question might be if the possessor of the patrimonial rights has the possibility of declaring a CC-0 waiver of his rights when the moral rights are retained by the author. The text of the CC-0 seems to make that possible, as it states that the affirmer waives his own rights but disclaims responsibility for clearing rights of other persons that may apply to the work. -- Asclepias (talk) 17:52, 12 March 2012 (UTC)[reply]

 Comment There is a similar issue with Swedish coins. There is this page which states that "Riksbankens bilder är fria att ladda ned och användas fritt. Vänligen uppge Riksbanken som källa vid användning." Translation: "The images of the Central Bank are free to download and may be used freely. Please attribute the Central Bank when using them." There is a specific restriction to images on this page, implying that other images of currency are OK. However, there is also this page which says that copyright is held by the coin & note designers and not by the central bank. It also says that the central bank isn't allowed to authorise or reject permission to reproduce coins & notes, contradicting the statement on the other page. I'm not sure how Dutch law works, but the situation on the web site of the Swedish central bank seems very similar. --Stefan4 (talk) 16:38, 15 March 2012 (UTC)[reply]

Indeed the situation is somewhat similar. On a Dutch governmentsite ([10]) it is stated that "Voor reproductie van de nationale zijde van de Nederlandse euromunt heeft u toestemming van de ontwerper nodig. Wilt u deze zijde reproduceren, neem dan contact op met de Stichting Pictoright." - "For reproduction of the national side of Dutch eurocoins you need permission of the designer. If you want to reproduce this side, please contact Stichting Pictoright." The Swedish situation is different as the permission that one could read from the CC-0 statement does not stretch to all Euro coin national sides. I do agree that it seems unlikely that the Dutch government would not have contacted Stichting Pictoright or the designer to arrange the right to publish the images for which deletion is requested. That is a good find, the page and section "Reproducties nationale zijde" on www.rijksoverheid.nl. Perhaps the link could be added to the Netherlands section of the Commons:Currency page for reference. Like you say, it makes it look uncertain if the government has cleared enough patrimonial rights on the designs for its CC-0 statement on the images to make them freely reusable.
