Hey, dies ist ein Bild einer gar nicht so alten Moschee in Marokko, wo es keine Panoramafreiheit gibt. Von daher meine ich, dass dieses Bild auf Wikimedia Commons nichts zu suchen hat. Einwände? 84.61.135.58 12:50, 8 January 2013 (UTC)
- Delete I agree, the architect was Michel Pinseau who died in 1999, this building was completed in 1993, Morocco has no Freedom of panorama, and therefore Commons requires a clear license (from the architect's heirs or firm I assume). Possible defenses: under the threshold of originality? No. Faithful copy of a work already in the public domain? Unlikely. De minimis? No, too large. -84user (talk) 21:36, 13 January 2013 (UTC)

- Good luck with removing almost every pre-1963 publicity photo, since in almost all cases there is no conclusive evidence whether it is out of copyright or not.
- That's why all those publicity photo's on Wikipedia have additional information below them: "Publicity photos have traditionally not been copyrighted. Since they are disseminated to the public, they are generally considered public domain, and therefore clearance by the studio that produced them is not necessary." etc... well done sir, well done.J187B (talk) 21:05, 7 January 2013 (UTC)

About a half of images posted by User:Myararat83 are derivative works of images that was taken by other users at panoramio, flickr, wowturkey etc.. Because we can find some images in the user's page of my ararat at panoramio (for example: File:Little AraratDSC 3125.jpg © All Rights Reserved 2011/02/15), I think User:Myararat83 is my ararat at panoramio. - Keep It consists simple geometric shapes and text. It does not meet the threshold of originality needed for copyright protection, and is therefore in the public domain. Same issue can be seen in this DR.--Rapsar (talk) 22:07, 5 January 2013 (UTC)
- Keep The designers' name is unknown and former copyright holder was Beşiktaş Gymnastics Club (legal person, it still holds the trademark right of this logo). The team colors have not changed since the end of the Balkan Wars. The basic design hasn't changed since the end of the World War I. After 1929, Arabic characters had been converted to Latin characters. But characters are not protected by copyright law. Star and crescent had been added by Adnan Menderes in 1952. But star and crescent are not protected by copyright law. So I think {{PD-TR}} can be applied to this emblem. Takabeg (talk) 23:53, 6 January 2013 (UTC)

- Delete I agree, this building was completed in 2010, and therefore Commons requires a clear license from the copyright holder, the architect Foster and Partners in this case. - This is obviously a modern drawing of the coat of arms, although it might be based on the same blazon as the one used at George IV's time. The copyright expires 70 years after the death of the person who made this particular drawing of it. See also User:Jameslwoodward's closure above. The problem with that one was that the artist of this particular representation of the coat of arms was misidentified. --Stefan4 (talk) 12:49, 14 June 2013 (UTC)

Auguste Brouet is a French artist publishing in France who died in 1941. Because French wartime extensions extended the 50 pma copyright of all works in copyright in 1948 by 8 years, the works were in copyright on the URAA date in 1996, so any works published 1923 or later will remain in copyright in the United States until at least 2019. The dates of most of the works are unknown, but unfortunately Brouet published work both before and after 1923, and without more information they must be deleted. The source websites offer no information about year of publication. --Dcoetzee (talk) 02:05, 5 January 2013 (UTC)

Édouard Vuillard (Category:Édouard Vuillard) is a French painter who died in 1940. On the URAA date in 1996, France had 50 pma, plus an additional 8 years of wartime extensions for works before 1948, so his works were still in copyright then. This means that any 1923 or later works by Vuillard like the above remain in copyright in the US until at least 2019. Fortunately most of his works predate 1923 and are not affected. I was able to find dates for most of them, but a few are unknown, and lacking information we must assume the worst (that they date to his death year). As usual I added one year for "circa" dates to be safe. --Dcoetzee (talk) 05:06, 5 January 2013 (UTC)
- Keep You can't maintain this haughty attitude, we can't publish it in the US, so we won't publish it in the rest of the world. Jan Arkesteijn (talk) 16:29, 6 January 2013 (UTC)
- As I noted many times before, the WMF explicitly forbids hosting works that are copyrighted in the US on any WMF project except under an EDP compliant with US fair use law, as does Commons:Licensing. Please don't characterise me as "haughty" when I am only enforcing policy - reserve your ire for the lawmakers who create these inane restrictions. Dcoetzee (talk) 00:48, 7 January 2013 (UTC)
- Then the WMF must change its attitude. It isn't possible to impose the bad US copryright laws on the rest of the world. --91.18.44.21 11:00, 9 January 2013 (UTC)

- Keep The wartime extensions have been included into the French law until February 2007 only for works published during the wars. Non of the works above was published during Worldwar I or II so there is no extension in these cases and therefor these images have not been copyrighted in 1996 in France. Thus URAA does not apply her. For non-musical works the court of cassation made the laws invalid later in 2007, however that isn't of relevance in this context anyways. --91.18.44.21 11:49, 9 January 2013 (UTC)
- This is not how the wartime extensions work. The WWII extensions apply to any work published before January 1, 1948 that was not in the public domain on August 13, 1941; none of Vuillard's works were out of copyright less than two years after his death. See en:Wikipedia:Non-U.S._copyrights#endnote_tab_france for explanation and citations. These can only be retained with a suitable license statement from Vuillard's heirs. I will however re-upload them to Wikilivres after deletion. Dcoetzee (talk) 20:55, 12 January 2013 (UTC)

Modern building in Luxembourg. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in this case. . Jim . . . . (Jameslwoodward) (talk to me) 11:34, 5 January 2013 (UTC)

- Is there not an exception for buildings of major importance, as the European Court of Justice is one of the most important institutions of the European Union?--Bdx (talk) 13:29, 8 January 2013 (UTC)
- In a word, "No". Copyright is copyright. Another user has exchanged e-mails with the architects and they have given permission for WP, but not a more general license. This was, I think, because our colleague did not request the more general license, so he is trying again. . Jim . . . . (Jameslwoodward) (talk to me) 14:18, 8 January 2013 (UTC)
- OK, thank you. If it needs to be deleted, then so be it. So just to be clear: if I want to upload a picture of a modern building in the future, can I do it by using another license or do I always need to ask the architect for permission? --Bdx (talk) 13:23, 9 January 2013 (UTC)
- It depends entirely on what country the building is in, see COM:FOP. For example, Germany, the UK, the USA are OK, France is not. . Jim . . . . (Jameslwoodward) (talk to me) 18:27, 11 January 2013 (UTC)

wrong licence.Nomination from User:Andrejj -- DieBuche (talk) 23:42, 25 September 2010 (UTC)
What is wrong with the licences for all these pictures for http://sl.wikipedia.org/wiki/Volovja_reber article? All photos are either my work except one (given for public use), all intended to be put into public domain. These pictures are also included on my site www.volovjareber.si (which I own, and to which other authors gave me rights to use pictures in public domain - conservation use). Maybe there is just some technical detail? All pictures have "Source=Own work". Which tag I need to add? -- Alesjagodnik 12:20, 26 September 2010
- Comment This could have been copied from http://www.volovjareber.si/zveri/pic/ris3.jpg and needs evidence of permission by COM:OTRS. /Pieter Kuiper (talk) 12:14, 26 September 2010 (UTC)
- Well, copyright on www.volovjareber.si says:
- Besedila in fotografije na spletnih straneh so lastnina zgoraj navedenih avtorjev in se lahko uporabljajo izključno za predstavitev na spletnih straneh www.volovjareber.si. Uporaba za druge namene je mogoča le s soglasjem avtorja.
- And tehnical: whos own work? Oršanič or Jagodnik? --Andrejj (talk) 12:15, 26 September 2010 (UTC)
- As this is credited to Oršanič, it needs evidence of permission by Oršanič. /Pieter Kuiper (talk) 12:19, 26 September 2010 (UTC)
- Mr. Oršanič and others gave photos to me for conservation purposes (web pages, mails etc.) - we used them for site www.volovjareber.si (which I mainly created and wrote the same copyright text you mention - which means other people can't take photos from that site and use it as they want for their own purposes). With some of these same photos we also created wiki entry (with their consent). Photos were given as such to be used for conservation purposes and people who created these photos (me - Ales Jagodnik, Tomaž Jančar, Hrvoje Oršanič and others) don't mind at all usage of these photos for such purposes. Every picture also has author mentioned and besides also my wiki username, because other authors don't all have wikipedia account. Feel free to contact all of them (me: ales.jagodnik@gmail.com, info@volovjareber.si, tomaz.jancar@dopps-drustvo.si, hrvoje.orsanic@zgs.gov.si).
- I really don't understand what "Wrong licence" means? Please correct licence and other data so that it matches photo's and article's author intent as I mentioned above. Maybe I could just change Source to www.volovjareber.si ? Alesjagodnik 17:33, 26 September 2010
- It does not work that way. If you want to keep these images, it is your job to ask the photographers to send a free permission to COM:OTRS. /Pieter Kuiper (talk) 15:45, 26 September 2010 (UTC)
- What about changing source of pictures to "www.volovjareber.si", keeping authors names and change to corresponding licence (which one don't know then)? Alesjagodnik 17:55, 26 September 2010
- There seems to be a problem with permissions -> Delete. /Pieter Kuiper (talk) 15:57, 26 September 2010 (UTC)

An OTRS ticket ended the previous deletion discussion, but as Eleassar pointed out at Commons:OTRS/Noticeboard#File:Volovjareber-zveri.jpg, the permission in the ticket is insufficient for Commons, being essentially a "for Wikipedia" permission. – Philosopher Let us reason together. 12:42, 5 January 2013 (UTC)
- At current state I support deletion, but one could reopen the OTRS ticket and as the copyright holder for clearification. --Krd 13:02, 5 January 2013 (UTC)
- Comment: I'm not sure what is permissible here anymore. For example, these two files ([7], [8]) have been recognised as ok. --Eleassar (t/p) 13:52, 5 January 2013 (UTC)
- I think the problem with the two discussions you cite is that the images were made especially for Wikipedia (ie made so that they would be useful to Wikipedia), but there's nothing to suggest they were made exclusively for Wikipedia (ie not intended to be used by third parties). In this case, permission was given "for Wikipedia" in the OTRS ticket, but the client didn't specify a license or say anything about reuse by third parties. I suggest re-opening the OTRS ticket and asking the client to be more specific, but if they don't respond within a reasonable timeframe then I don't think we have much choice but to reluctantly Delete.
