Image:NZ_North_Island_Robin-3.jpg

Thank you for uploading an 'enhanced' version of Image:NZ_North_Island_Robin-3.jpg. Unfortunately your version has over-saturated colours and doesn't represent the real bird very well, also it is a more compressed hence inferior copy. I have reverted to my original version. It is normal to not replace someone else's existing image, but rather create a separate upload. It is also inappropriate to replace an image which is a Featured Picture or Quality Image with another version as that version has not been assessed and therefore can not carry over the FP or QI tags. --Tony Wills 12:45, 17 May 2007 (UTC)

Ownership and copyright

Yes, I'm sure. Ownership of the copyright has nothing to do with ownership of the physical object. Of course it is possible for a copyright owner to sell not only the physical object but also the copyrights (i.e., to sell a license, too). But just because someone has a photo in his collection does not mean that he owned the copyright. He only owns the copyright if it has been transferred to him, or he has been granted an exclusive license.

I admit that photographs were a special case in some countries, though. Italy, for instance, once had a rule that the owner of the negatives was also the owner of the copyright. Makes kind of sense. However, IIRC, that's no longer the case in Italy, and AFAIK it isn't the case in most other countries, nor in the international copyright treaties.

Now, your example of someone giving his own camera with his own film to a passerby to take a picture for himself (and typically of himself): strictly speaking, the passerby would own the copyright. But, as you point out, I also don't think that has ever been tested in court. My personal take on that special case is that in this case there is an implicit unwritten licensing agreement by which the passerby agrees to transfer his copyrights to the person on whose behalf the picture is taken. It's never expressed like that, but that's clearly the intent of the whole transaction. I give you my camera to take a picture of me standing in front of the gorgeous panorama of the Grand Tetons. You snap the picture and give me back my camera. Essentially (and with all due respect to your abilities as a photographer :-) you just acted as a human surrogate of a self-timer. I claim that the implicit understanding of both of us in this case would be that I would own all the rights on that picture, not you.

But the case at hand in that deletion request is different. Someone took that photo from a dead German soldier, and somehow it ended up at that Polish museum. There's no implicit or explicit copyright transfer or license grant in that. It is, of course, entirely possible that Polish law would treat that image as PD, but that applies only within Poland itself. (Just like all those German photos at the NARA, which are PD by virtue of special "seized enemy property" regulations, but that only applies within the U.S.) {{Polishpd}} is inapplicable, however, if only because the image was not "published", which implies the consent of the copyright holder.

It's hyper-annoying, especially since we can (in this case) be sure that no copyright holder will ever step forward claiming infringement. It's not just an unpublished anonymous work, it's even an unpublished anonymous orphan work. But orphan works are largely neglected by copyright laws worldwide. Yes, I know about the Orphan Works Act in the U.S. I hope it'll pass. We'll have to think under what conditions the Commons will accept such clear cases beginning in 2010. These unpublished anonymous, possibly even orphan works from WWII will start entering the PD in 70-years p.m.a. countries in that year. Though we should also check the U.S. rules for such works then.
