  • Keep. The Fernand Michaud photos at the Festival d'Avignon from 1970 to 1986 have been examined in previous discussions. This photographic fonds was acquired by the Bibliothèque nationale de France (BNF) in 1988 [1]. The BNF acquired the copyright on those photographs [2]. (That is different from many other fonds acquired by the BNF from other photographers and for which the copyrights remain the property of the photographers.) Then the BNF published the photos of Fernand Michaud on its Gallica website explicitly as "public domain". They remained tagged public domain for many years, until at least 2019 [3]. They are still explicitly tagged "No copyright" (NoC-OKLR) on the Europeana website [4]. (The OKLR bit refers to possibility of non-copyright restrictions, which Commons does not consider.) At some point, Gallica removed the copyright notices on items in many of its collections and replaced them with the vague expression "conditions spécifiques d'utilisation". That does not necessarily mean that Gallica attempted to revoke the release to the public domain, it could merely refer to the possibility of some non-copyright restriction (as on Europeana). Or if it was an attempt to revoke the release to the public domain, that can't be done anyway. It could not reasonably be claimed to have been a mistake either, given that the photos were labeled as public domain for so many years on Gallica and still are labeled as such on Europeana. On Commons, the CC0 tag placed by the uploading bot on the files is false, as on its other uploads. In the present case, it can be replaced probably with PD-copyright holder or another suitable tag. That template change will have to be done also for the thousand of other files of photos by Fernand Michaud uploaded by the bot and grouped in some 76 categories [5].
