In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Ukraine.

The monument is in the middle of the photo, the title (Монумент визволителям Донбасу от Adda82, Monument to the liberators of Donbas by Adda82) also indicated that the monument is the purpose of taking this photo, I think it is prominent enough that fails de minimis. --A1Cafel (talk) 04:06, 4 July 2023 (UTC)[reply]
Also, its a bit unclear as to what law applies here. Russia sees the Donbas as it's own territory now, and Russia does have FOP for buildings. So maybe wait until we know what law will apply in future to this region? --PaterMcFly (talk) 10:57, 3 July 2023 (UTC)[reply]

Unfortunately, buildings are not covered by Ukrainian FOP. IMO the star is a distinctive feature and it is complex enough to be copyrighted. --A1Cafel (talk) 03:12, 5 July 2023 (UTC)[reply]
