- Just a point that I thought I should mention. This is the third time these logos have been uploaded by this user. The previous two times there were speedy deleted as {{Logo}}. - Ok und wenn ich den Quelltext bezüglich der Quelle und Author anpasse, inkl. Lizenz?? Denn das ist schon ein riesen Aufwand mir jetzt von jedem unterklassigen Verein die Genehmigung zu holen. Zumal viele unterklassige Vereine hier ihre Logos hochgeladen haben mit der Angabe das der Author unbekannt ist. Diese Logos werden auch nicht gelöscht. Das ist halt immer meine Frage warum das bei denen durch geht und bei mir nicht. Du scheinst dich ja genau auszukennen. Wie ist denn der genau Werdegang beim Hochladen eines Logos von einem unterklassigen Fußballverein wenn der Author nicht bekannt ist und die Quelle, wie in den meisten Fällen, DS-Wappen.de ist??--Conne982 (talk) 06:30, 17 September 2016 (UTC)

- Not all are copyvios. I tagged a bunch as DW-no source. Uploader needs to do some sorting. @Conne982: Hallo! Zu Deiner Frage: Viele der Logos ueberschreiten bei weitem die Schoepfungshoehe und sind damiot urheberrechtlich geschuetzt. Ich habe ein paar Deiner Uploads als abgeleitetes werk gekennzeichnet. Was Du jetzt schnellstens erledigen musst ist: Herkunft der Vorlage (vermutlich Webseite des Vereins?) nachtragen, als Autor den Verein nennen, falls kein Autor bekannt. - I got an archive from the source portaloficial.net which looks like a mirror of en:Teziutlán's official site http://www.teziutlan.gob.mx/ (also down/404, archive). Considering also part of the source url "teziutlan/propuesta1" ("proposal") it might be that the photos were originally hosted at official site and only mirrored by portaloficial.net to (now guessing) "propose" a new website layout (or whatever). portaloficial.net itself was (checking archives like this ("Copyright 2010 rhema.com.mx - All rights reserved") or this) some kind of a news portal for that Mexican region. Hello. I'm Emerson Marcus, State Historian for the Nevada National Guard. The following photos were obtained through several sources, many being the Nevada National Guard itself. Kept: mostly, but deleted those files that are obviously post 1923. Emersonmarcus, these are all subject to deletion unless you add useful descriptions and categories. I have done File:Joseph Poujade.jpg for you as an example of a minimum.
You must at least tell us who the person was, put the file in at least one category, change the source line to show the archive from which you got the image (none of them are "own work"), change the author line to "unknown", and add an appropriate permission line. The license cannot be CC-BY-SA because you are not the copyright holder. If the image was published before 1923, it can be {{PD-old}}. If not published until 1923 or later, it may be {{PD-US-no notice}} or {{PD-US-no renewal}} if either is applicable, but determining that will not be easy for a beginner.
Note that the owner of a paper copy of a photograph is not necessarily the owner of the copyright. In the case of the Nevada National Guard, if the photographer was a member of the National Guard whose duties were as a photographer while on active duty, then the Nevada National Guard owns the copyright and may license it by sending a free license to OTRS. If the photographer is any other person, then we will need a free license from him or his heirs.

Biagio Bellotti, the artist who painted this ceiling, died in 1789, so all of his work has been in the public domain for more than 100 years. - Und ob das ein Grund ist: Ja, denn einfache geometrische Figuren, wie in der Lizenz behauptet wird, bedeutet, dass keine Struktur dargestellt, symbolisiert wäre. Das ist hier nicht der Fall. - Notice that the Threshold of originality in the US is very low as the German one. This logo is bellow the TOO according to the US Copyright Law, but only the German one applies. Delete the image is found here: https://research.archives.gov/id/559074. The page provides no indication of its copyright status nor whether the photo was even published. There is no attribution and no date of creation. A 3D photo must be freely licenced by both the photographer and while the artist who died in 1931 but the photograph has no details, so the precautionary principle applies unless we get more detail which the National Archives does not appear to have. - @Josve05a: These are all marked as having been uploaded by someone under contract for the WMF, there are significantly more photos from her too (not just uploaded by Gayle) since she, for example, also does a lot of our staff photos. Every one of them is, in my mind, marked entirely appropriately given that the photographer (like the vast majority, possibly all, staff and contractors for the WMF) signed a contract releasing the rights not only to CC-BY-SA but also giving a joint assignment to the WMF (as marked) so that we can adjust that release as necessary. - I am inclined to delete these as not useful. They have non-useful file names, no useful description, and only one category. None of the people in them are identified.
- There are 471 of them. Given the lack of information about the images, I can see no use for them and certainly not all 471. Perhaps we might keep and use a dozen as a record of the event, but almost 500?
- They were taken in a non-public or quasi-public place and there is no evidence of permission from the subjects. I'll guess that I have deleted several hundred images from people attending similar WMF events who did not want their photos on the Web.
- The permission block links to a page with a clear and explicit copyright notice. These are images uploaded by a person who is not the copyright holder. Commons policy requires that in that case, the license be confirmed by an OTRS message from the copyright holder. Although I agree it is unlikely that someone is spoofing your username here, is it too much to ask for WMF to follow its own rules?

IMO and from random sampling, these candid unposed unaware images were taken in a private workplace by a professional photographer who is either the owner or co-owner of the works. They contain private images of former WMF staffers who have expressed (on wikimedia servers) dissatisfaction with discriminatory NDAs they were made to sign.I question the scope (COM:PS) of images like "File:Wiki-ah-thu- MG 7851-0016.jpg" to be hosted on Commons. I doubt that OTRS permission from WMF is adequate to retain them,and I suggest that all these be deleted speedily. It may be perfectly acceptable for WMF to hire a professional photographer to create a private record for themselves, but such mass uploads into public domain need explicit staff / subject consent in addition to prevent more "Pricasso" repeats. The site parlament.ch has very clear Terms and Conditions which require permission for any reuse. The OTRS message cited here deals specifically with use on WP. There is no general license, no mention of commercial use, and no statement that the license is irrevocable.
The site's Terms and Conditions at https://www.parlament.ch/en/services/terms-and-conditions say, in part:
- "The websites of the Parliamentary Services contain information that is available to the general public. The downloading or copying of texts, images, photos or other data does not in any way entail the transfer of rights over the content.

Info The arguments presented by Jim establish that we do not have an appropriate licence for this template, and unless we can obtain one it will need to be deleted. I am inclined to close this DR as "Delete" soon unless anyone can establish that efforts to obtain a licence are likely to be successful in the very near future. This DR has already been open for two and half months, and there is still no indication that anyone within Parlament.ch is even starting to think about the issue. In the absence of a valid licence this template does no more than improperly 'authorise' Commons to host copyright infringing material, which means that we have an obligation not to allow this to drag on. It would be a shame if we need to actually delete the template in order to focus people's minds on our rule that all material we host must be free or properly licensed, but if it comes to it that is what we will need to do. Keep I am the person who originally obtained the permission from the Parliament (thanks Jim for the notification about this discussion... and sorry I missed it earlier). I can understand that people want to clarify apparent conflicting statements from the Parliament services. But one thing for sure: the original licence does not "deal specifically with use on WP", and there is no lack of "mention of commercial use" as Jim indicated.
In the exchange, I specifically asked them to confirm that the images can be reused (my translation from French) "without any restriction; including non only reproduction and transfer, but also modification and reuse, commercially or not". Our contact person confirmed that we could indeed use the images without any restriction (except the indication of the source), hence the licence chosen for the template.
As always, we could improve the way things are handled (and thanks to my Swiss colleagues for taking care of this), e.g. force them to use a standard text or (as we've done in some other cases) get them to sign an actual document, who knows. But to say that the current licence is invalid or that commercial use is not mentioned seems exaggerated. Schutz (talk) 18:13, 9 May 2016 (UTC)
Keep Yesterday the responsible person of parlament.ch has sent a email to permissions-de@wikimedia.org confirming that all pictures can be used according the conditions of WM Commons.
