Keep While you can legitimately complain about the descriptions and categorization of these, I hardly think that photographs taken by a photojournalist notable enough to have an enwiki article (even though not a great one) that has survived for 7 years, documenting various people at an event held by the Dalai Lama, really qualify as 'out of scope personal photos'. •  Keep Strongly agree with Russavia here, this is a very high-quality artistic photograph, and the notability of the photographer is undoubtable. 'Unused personal image' applies to cellphone or instant camera spam by random people, not artistic and technically competent photographs by a noted photojournalist. The 'body of work' by this person is itself notable, and within the scope of Commons. Also, it would have been vastly preferable if the nominator had created a single DR for these images, so they could be discussed as a whole, instead of swamping COM:DR with, by my count, 27 different requests. It is perfectly acceptable to have multiple images of the same person at the same event and allow reusers to themselves choose, instead of deciding (from what I can tell, somewhat randomly) to keep some and attempt to delete others. Files of Flugwerft Schleißheim by Julian Herzog

Photography for purposes of publication is apparently forbidden in this location. I would therefore like to have those deleted, and will then try to get permission for publication.

I might add: Source. — Julian H.✈ (talk/files) 09:28, 20 December 2014 (UTC)[reply]
This isn't about copyright. It's just that I'm breaking the rules set by the museum. I don't want to get in trouble for breach of contract, so I want them removed until I have clarified the matter with the museum. I know Commons isn't obligated to remove those. But I think there's some policy or quasi-policy that images are still removed if the photographer asks for it. — Julian H.✈ (talk/files) 10:44, 20 December 2014 (UTC)[reply]
Within some days, later it gets awkward for all involved parties if the pictures are "in use" (not only the shown WikiMedia uses). Just an explanation, why this is not as simple as you might hope. I'm rather quick with {{Vk}} if I see "in use" (not checked here.) –Be..anyone (talk) 00:08, 21 December 2014 (UTC)[reply]

The user who uploaded this photo was born in 1948, so if the photo is from 1951, it hardly is his own work. Whoever the photographer was, he is definitely not dead for at least 70 years, so the photo is still protected by copyright. Without a proper OTRS permission, the file should be deleted. This photo obviously depicts a statue or sculpture, which most likely is not the uploader's work. Since the person depicted lived 1900-1992, it must be assumed to be recent and possibly still protected by copyright. Without further info about the artist and the place the artwork was photographed, the file should be deleted per the precautionary principle. Rosenzweig τ 14:16, 20 December 2014 (UTC)[reply]

Accd. to Exif data, the photographer is a man named "Woitschützke, Andreas". That is NOT the uploader (check his user pages and the links to his CV there). Without a properly documented permission, the file should be deleted. Rosenzweig τ 14:20, 20 December 2014 (UTC)[reply]

At source, this image is credited "R.S. Naidu/Kamat's Potpourri", and described "Pietro Della Vale Meets Queen Abbakka Illustration by R.S. Naidu based on Italian originals". This would seem to be a modern redrawing of the original Italian print, and the uploader's name has no apparent bearing on "R.S.Naidu" Ellin Beltz (talk) 16:09, 20 December 2014 (UTC)[reply]

Can't possibly be PD because copyright has expired. Buddhist sand mandalas are destroyed several days after they are made - even if not destroyed they don't last long as they are made from small particles without a binder. Also no author, source, date or EXIF and small file. Note File:Kalachakra el paso 2012.jpg which has very similar content but is properly attributed can be used as a replacement. Deleted: No source, date or author specified, and the claim that this is in the public domain must clearly be wrong. Even if the buddhists who made it may not care about their own copyright, we would still need proper permission before being able to host this. While the photograph of this item may be that of the uploader, this is a painting with no information on who created it or when. The description says "Old Glassworks", and there is no additional information to assist in sourcing this image. Putting the nomination to the community for clarification. Ellin Beltz (talk) 16:29, 20 December 2014 (UTC)[reply]

I found another copy. I think, there is no chance to find the author after about 200 years. The author has painted the image about 1810. When his age was 20 years in 1810 and he lived 100 years he died in 1890. 70 years after his death was 1950. So where is the problem? --LoKiLeCh (talk) 21:53, 21 December 2014 (UTC)[reply]
Comment The image needs an author's name, date of creation and the source where the photo was taken; was it in a museum - a private collection - or where? The file doesn't have enough information for proper licensing because if we don't know who painted the picture, how do we know that they've been dead 70 years? It could be a recent student copy of an ancient painting for example. Cheers! Ellin Beltz (talk) 22:42, 21 December 2014 (UTC)[reply]

Deleted: Ellin Beltz is correct. The uploader has claimed to be the author, but is likely to be only the photographer (or the person who took the image from an online source). Without a stated source we know nothing about the original painter, and we certainly can't assume that the painter's copyright has expired. If LoKiLeCh can provide more information on the source it's possible that we might be able to restore this image, but as it stands we can't keep it. Your image is very nice, but it's no longer accurate and needed to be taken down. There is a new building that needed to be added to it, so I did. Can you clarify for me, since I am not an expert: my read on INUSE is that it addresses whether or not a file has educational value. The educational value of this file is not at question. The question is about its licensing. Are educational value and licensing the same thing, since that is what you seem to be suggesting is policy? --Gaff (talk) 21:57, 17 January 2015 (UTC)[reply]
Yes, for the first part. For the 2nd part it's as I wrote, the file was transferred to commons by a bot with a pending review request, and until that happens I assume that they know what GFDL is. I suggest this DR allow for any extra time if the uploader needs it and might resolve the copyright concern, and that someone ferret out a potential replacement that can illustrate 'bots' should it need to go. -- (talk) 12:32, 10 December 2014 (UTC)[reply]

Kept: I searched twenty five pages of google images and don't find a single toy robot that looks anything like this piece. Unless I can find a toy/sculpture/robot of which this is a DW, I have to COM:AGF and say this 2003 image is properly licensed. Ellin Beltz (talk) 17:08, 19 December 2014 (UTC)[reply]

I am the administrator who closed the prior deletion discussion "kept" but after reviewing Commons Category (of 536 images) named Category:Tin toy robots, I find this toy to be a "replica Atomic Robot Man" with the mention of "Schylling", perhaps a toy company? There are 23 images which are similar to this one, some are painted and others are plain, all begin with Schylling in the category. I think I was incorrect in my prior assumption that the robot itself was own work of uploader; and instead nominate this image for deletion because the creator of the robot would hold copyright of the toy for the usual period of time. Ellin Beltz (talk) 05:44, 20 December 2014 (UTC)[reply]

Yes, it's a company with a working search engine: http://www.schylling.com/k/search?q=Atomic+Robot+Man (119 results, your example is not in the first 25). –Be..anyone (talk) 23:37, 20 December 2014 (UTC)[reply]
Sorry for the confusion, I see now that the robot is a Schylling toy, although I'm still unable to find this exact one on their current website. Ellin Beltz (talk) 10:00, 21 December 2014 (UTC)[reply]

This older photograph has no source on file template, no description and no author, yet the tag says the author died more than 70 years ago. The only matching image I could find was http://www.jornalolince.com.br/2014/jun/memoria/5723-museu-da-imigracao-italiana-e-museu-da-agricultura-quiririm-sp here (2nd image in slideshow) and it provides no further information. Nominating this for community input and hopefully valid source/author. Ellin Beltz (talk) 16:40, 20 December 2014 (UTC)[reply]

Some files from the archive of UNESCO

Apparently, per Commons:Deletion requests/Files uploaded by Martinstrandberg several images should be considered as "private images", and are thus not realistically useful for an educational purpose, and out of project scope.

Comment Image 3, 4, 7, 8, 9 and 10 are not used, The other ones have been added to Wikipedia articles. Withdrawing the deletion request on them. Ainali (talk) 23:39, 20 December 2014 (UTC)[reply]
Keep High-quality images of children of various ethnicities. Some of these images are already used as shown above, the others are of comparable quality and could also be very useful. Is this some kind of revenge DR? --Sebari (talk) 18:55, 11 January 2015 (UTC)[reply]
Comment No, it is not. It was simply that I learned about how "private images" are considered in the policy through the linked DR and happen to stumble across these images about the same time. The image sets had similar kinds of images so I believe that is how the policy is meant to be interpreted. Ainali (talk) 20:12, 11 January 2015 (UTC)[reply]
Keep I do not believe that prior DRs create a precedent. I also believe that these images are realistically useful for an educational purpose - specifically for articles such as "Education in X" or "Childhood in Y". These are also not "private photos"; that is, they are not private image collections (private party photos, holiday snapshots) - they are images from the archives of the United Nations Educational, Scientific and Cultural Organization, taken by official photographers as part of a series documenting education around the world. They are certainly Educational, Scientific and Cultural Organization, and I fail to see how images from this organisation are "private"! Chase me ladies, I'm the Cavalry (talk) 21:01, 20 January 2015 (UTC)[reply]
Keep As above, photographed by UNESCO and it's partners, in no way private photos, UNESCO has done due dilligence in obtaining appropriate permissions. Mrjohncummings (talk) 21:08, 20 January 2015 (UTC)[reply]
Speedy  Keep per above comment. Let's not forget that there is a Commons guideline (COM:IDENT) and related WMF policy about this stuff. John Cummings has asserted that UNESCO is diligent about permission in cases like this; that's what our guideline requires. The individual files should be tagged accordingly, which I'll do now. -Pete F (talk) 21:26, 20 January 2015 (UTC)[reply]
✓ Done -Pete F (talk) 21:56, 20 January 2015 (UTC)[reply]
Comment Well, the other photos were not private either, they were uploaded by an employee of w:en:Helsingborg Municipality and part of a project on Swedish Wikipedia (where some of the images were already used) and all photos were especially taken with the upload to Commons in mind. So what is the difference? Ainali (talk) 22:45, 20 January 2015 (UTC)[reply]
In a word, assertion. From COM:IDENT:
  • "The photographer and uploader must satisfy themselves that, when it is required, the consent given is appropriate for uploading to Commons."
  • "Normally it is sufficient that the uploader asserts that appropriate consent was given"
There are precedents in which the reputation of the organization that published it (in this case, UNESCO) is considered sufficient grounds for that assertion. I am not finding them on a quick search, but am happy to dig a little deeper and find some links. I believe these include Pete Souza (official White House photographer), One Laptop Per Child, the Wikimedia Foundation, and various individual professional photographers. In this case, the UNESCO staffer sending the email has the title "Chief, Publications and Branding" (from the OTRS ticket), which does sound to me like somebody whose professional responsibilities would include this kind of thing. Commons policy certainly could be stronger, and perhaps it should be; but at the present time, this kind of assertion is all that is requested.
I'm not an admin here, so I can't see the files from the previous request in order to compare the two. However, nobody in the discussion mentioned anything about the uploader asserting anything about the source; since the uploader's username (Martinstrandberg) is a red link, it is not hard for me to imagine that he did not go out of his way to make such an assertion; and Ellin Beltz is generally quite diligent in her closures. So I am pretty confident that a lack of assertion is probably the difference. -Pete F (talk) 00:19, 21 January 2015 (UTC)[reply]
The images mentioned in the comparative DN were of an obvious family (most likely that of the uploader), kids, female old enough to be kids' mom, etc. They were from the face front of each person, the focus was poor, they were obviously "holiday snaps" or "family album" photos. I kept one because of what it portrayed, it was reasonably in focus and had no personality issues because the person portrayed is not recognizable but the action is educational and recognizable. Cheers. Ellin Beltz (talk) 03:44, 21 January 2015 (UTC)[reply]

I was unable to find any information about the creator of this painting; it's not in any part of the upload template. This is a large photograph of what appears to be an older oil painting, but without a statement of who created it, and a date of October 2006, I am nominating for clarity on this image from the community. It may well be old enough, but the information on the file template is not sufficient. Ellin Beltz (talk) 16:06, 20 December 2014 (UTC)[reply]

DW of published works from 2000, not own work, and not free of copyright, COM:COPYVIO Ellin Beltz (talk) 17:54, 20 December 2014 (UTC)[reply]

This image was not published in the referenced article. The referenced article only reported the 3D structure of this protein complexed with RNA and DNA but provided other depictions of it. Its authors archived the atomic coordinates of this complex at the public repository named Research Collaboratory for Structural Bioinformatics (RCSB) [7]. RCSB has made available a number of Java applets at its Web site where you can visualize these coordinates and select a particular rendering that you like. There are additional rendering programs such as RasMol that can create renderings of molecular structure structures with various options (ball-and-stick, ribbon, various coloring modes, etc). In essence, this process is similar to creating a 2D map from geographical coordinates. The image discussed here is derivative work generated from 3D atomic coordinates. Coordinates are facts and are not copyrightable; Furthermore, RCSB says "Data files contained in the PDB archive (ftp://ftp.wwpdb.org) are free of all copyright restrictions and made fully and freely available for both non-commercial and commercial use." [8]. Only the expression of data is copyrightable. In this case, the derivative work was created by User:Abbondanzieri on the English Wikipedia and he made it PD. I was the one who copied it to Commons from en-wiki. Hope this helps. --InfoCan (talk) 19:49, 24 December 2014 (UTC)[reply]
