Probably has a false copyright tag and is not the uploaders "own work". It is obviously a part of a painting and appears to be a 19th-century one. The uploader has placed a number of drawn or painted artworks on commons, all of them different in their artistic style and period, making it impossible that they are painted by the uploader. This photograph was taken prior to 1944 , this can be inferred because other soldiers in his unit who died before 1944 had their pictures taken also in the same gallery using the same camera. Thus this photograph can be assumed to be older than 70 years. That being said, this picture was compiled along with hundreds of others on a website which appears to have not stated anything on whether or not these images are copyrighted. @Ireas: I think its safe to say that the photographer is either a.) dead, or b.) a member of the Wehrmacht which is a branch of the Nazi German regime which is not defunct, but it is obliterated. So this, and all other pictures added to the website that are of German soldiers should be free for public use. As I don't believe that any German soldier who might I add would be approx 90 based off of the average age of German soldiers at the time, would be capable of filing a lawsuit based off of a copyright that does not exists. — Abattoir666 (talk) 09:09, 28 July 2014 (UTC)
- @Abattoir666: I agree that the photographer is probably dead. But he must be dead for more than 70 years – and that’s possible, but not certain. Regarding the Wehrmacht: In Germany, the ‘copyright’ belongs to the author. It is not relevant whether he was a member of the army. The author is always the copyright owner. @Ireas: That is a good point to cite the precautionary principle, but it is safe to say that in all probability no lawsuit will result from posting this picture, as German copyright law states that copyright protection extends 70 years, so in theory all photos from before 1944 should not be protected by copyright laws. There's also the fact that when Nazi Germany was erased from the map, U.S. and U.K. forces took possession of vast numbers of photographs and what not, and it basically claims that all copyrights for seized photos are basically null. Now I will admit, that in basically any other part of the world excluding the U.K. and U.S. of course, these copyright laws would still apply, but these photographs lie in the U.S., so its basically fair play. Also, there's not really substantial doubt, this photograph was lying on a repository that has basically been unchanged for about a decade, its most likely fair play. — Abattoir666 (talk) 09:30, 29 July 2014 (UTC)

- Is that just your opinion or do you have credible evidence for your claim? The image has been published on PLoS ONE under the Creative Commons Attribution 2.5 Generic license. PLoS ONE is a credible and well-known scientific publishing website, therefore the license applies in my opinion and I don't see any reason for its deletion. - Perhaps it is a male answer. In the subject image, I see an interesting woman. In the other two, I see a movie star, much less interesting. Movie stars are a dime a dozen, interesting women are not. That is beside the point, though. - Keep From a Wikipedia point of view I think it is reasonable to request that we use a different photo in articles. However, I don't see a valid reason for deleting the image from Commons other than as a courtesy, but this is not really an unflattering photo.On the contrary I think Jim is right when he says this is an honest view of her. Weak oppose I don't see this as unflattering photo: just natural, non posed. On an individual case it really does not matter, but as a matter of general principle of not letting individuals control their image on WP or Commons I think care is needed. If as has been mentioned other natural photos are added (and they are actually natural looking rather than just posed-natural) then I'd be less concerned. - I seem to have created a slight misunderstanding. That guideline is mainly about rights. I do not claim a right for myself, having explicitly surrendered the relevant rights upon upload. I also do not claim rights on behalf of the subject who, far as I see, implicitly surrendered the relevant rights by voluntarily parading around in a public place in a costume calculated to attract attention. I am, rather, asking for deletion under Commons:Photographs of identifiable people#Removal requests as a courtesy often extended to people who have second thoughts. My belated interview with the subject (who declined to give a name) gave me the impression of a naive young woman who didn't entirely understand the implications of her action. I'm not saying such a failure of understanding gives her a right to suppress the picture, but to me it seems courteous to comply with her request to "take it out" as she put it. As it happens, I live nearby and have seen many similar displays this summer, and hope to replace the photo with a similar one after asking the subject. Cindy Fox, the "Naked Cowgirl of Times Square" explicitly encouraged me to publish photos of her, in part because they help in her business of paid appearances elsewhere, and I don't expect her to be the only one. Let me ask, have you seen her again in Times Square after she made the request to you, and was she got up in the same way? If so, then there's absolutely no reason for the image to be withdrawn. The only circumstances under which I might agree that deletion was an acceptable pathway was if she had decided to make a drastic change in her behavior, and now regretted her previous actions, but if she just doesn't want Mom and Dad to know what she's up to in New York City, then it's really not our problem. Her choice is not to do what she's doing, or to take the chance that people will see it, one or the other. - Your argument would be stronger if the picture were shown to be immediately useful, rather than its value resting on a vaguely possible future educational usage. I intend on the contrary to weaken it by snapping a pic of a similar street performer after properly asking, thus free from qualms. Our brief discussion was on Sunday. It's mostly a warm weekend afternoon thing; on weekdays few painted boobies are to be seen. Today I was busy elsewhere; tomorrow I intend to visit the area briefly once or perhaps twice. Saturday I shall be very busy but Sunday afternoon I intend pretty much to hang out, seeking opportunities. I wanted to re-scan the photo from the mentioned source to upload it to deWP (as PD-100, possible there), but the photo is not from the book as mentioned. I have removed the source statement. It is defensively not a poster. Posters usually printed as advertisements on walls. It is picture of people participated in a conference. I'm at this picture because I participated. This conference was organised by my Institute of Strength Physics and Material Science. This picture was made by Institute of Strength Physics and Material Science. And it is used for wiki page about Institute of Strength Physics and Material Science. It was distributed for free for every conference participant. Text at the bottom is place and date of conference and cannot be subject for copyright (only lyrics or citations or similar can be copyrighted like a book or magazine article). The Principle of Public Access (offentlighetsprincipen) provides no exemption from Swedish copyright law as stipulated here. The exception granted in Article 26 in the Act on Copyright in Literary and Artistic works[7] only applies to "oral and written statements". The Riksdag doesn't seem to have released these images under any free license either.[8]
