I have a ticket number for this image. It is Ticket #2013080610009236. I am assisting the owner of the image in uploading the file. The owner of the image is also about to respond to Yusuke Matsubara at <permissions-commons@wikimedia.org> who made a request for more information. Could we please have a little more time to dot all the i's and cross all the t's.

This process is extremely confusing. We are doing our best to get it right.Foobarnix (talk) 21:08, 22 August 2013 (UTC)[reply]

This file was initially tagged by Botaurus as Speedy (Speedy) and the most recent rationale was: copyright infringement, the death date (1920) from the source Sotherbys is false. Death year is 1945. Please compare Arcadia auctions results. There are two artists with this name. One died in 1920, the other 1945. But the sign it is always the same and also the motives. It is therefore likely that errors are present here (happens quite often in the auction „world“). --Botaurus (talk) 21:57, 22 August 2013 (UTC)[reply]

This looks more than a scanned newpaper than a information table visible in public space or similar. The file description does not clearify this. {{FoP-Germany}} is doutfull. JuTa 12:09, 22 August 2013 (UTC)[reply]

This applies to File:Donaueschingen ehemaliges Finanzamt Info.png and File:Donaueschingen ehemaliges Solbad info.png as well. --JuTa 12:11, 22 August 2013 (UTC)[reply]
I took pictures of those info boards and reduced them to black and white. I will try to find the original pictures after the weekend. Maybe looking at File:Donaueschingen ehemaliger Adler.jpg where I marked the location of the info board also helps in the meantime? --Flominator (talk) 19:52, 22 August 2013 (UTC)[reply]
Hi, when ou have the original fotos including "some surounding", you could upload them and revert to the current version. This would make the case clear. Thx. --JuTa 20:01, 22 August 2013 (UTC)[reply]
Is File:Original info boards from Donaueschingen.jpeg sufficient? If yes, please delete it. --Flominator (talk) 19:06, 23 August 2013 (UTC)[reply]
Hmm, ich meinte das zwar anders aber ich denke es ist nun glaubhaft genug um die Bilder zu behalten. Gruß --JuTa 19:56, 23 August 2013 (UTC)[reply]

And those:

Different files -> not speedy. This file was initially tagged by Steinbeisser as Speedy (speedy) and the most recent rationale was: replaced by File:87RI Dillon1791.png Dschwen (talk) 19:18, 22 August 2013 (UTC)[reply]

All theese files has been replaced by drawings that are certainly diffrent because simply better. I already did so with the most of the files in that category, what is the problem? (by the way, the helmet in this file File:87RI - Dillon - 1791.png wasn't issued before 1792 - sowith the image is wrong anyway --Steinbeisser (talk) 05:58, 23 August 2013 (UTC)[reply]

That is great, Steinbeisser. And we will happily delete the files if nobody raises a significant complaint. There is no problem, apart from the fact that this deletion does not fall under the speedy criteria. --Dschwen (talk) 15:18, 23 August 2013 (UTC)[reply]
About 200 or so replaced drawings ar already deleted by speedy. Why should I have a lot of more work and each single image give an formal deletion request. (If you would have the kindness to throw an eye on that what's still to do - for a better understanding or so!) -- Steinbeisser (talk) 15:37, 23 August 2013 (UTC)[reply]
Those should have been deleted in a mass DR. That is not much more work. The Speedy criteria are quite clear and quite limited. Apart from copyright issues there is only Exact or scaled-down duplicate. These are neither duplicates, nor are they exact. They are new and different images. We simply have no speedy deletion criteria for removing wrong images, or images for which we now have better images. I suggest you start an RfC if you want to amend the speedy deletion criteria. This is not the place to discuss this. --Dschwen (talk) 15:45, 23 August 2013 (UTC)[reply]

Considering this info and per exif-history, the following files are most likely not "own work" of Et-cs (who noted also "Perspective Dimona" as author) and need permissions from their respective copyright owners. After today identifying around 20 uploads as copyvio (grabbed from different Panoramio-/Flickr-/Facebook-accounts, blogs etc.) it´s difficult to believe that these remaining files would be own work: IMHO untrusted user uploading a bunch of copyrighted material (small/inconsistent resolutions, missing/inconsistent exif) so these ones (per COM:PRP) can't be believed either.

  •  Keep: in scope. Good quality photo (even if tilted) portraining two generations — visible not only in facial features but also in clothing style, something for which there’s widespread use, both iconic and documental. No authenticity doubts (intact EXIF). No privacy qualms — for (almost) once, a photo of “local” women taken by a tourist that doens’t look like they were caught against their will: not looking sullen nor annoyed; on the other hand it is not one of those campy “elegant poses” women routinely assume for camera in this part of the world (I should know — I married one!). A fair use image of the same design, taken from the Bureau of Motor Vehicles’ website, has been available at w:File:2010 OH passenger plate.png and should be used at w:Vehicle registration plates of Ohio instead. 1. This image is using an entirly incorrect License. {{PD-Art}} is used exclusively for 2d "Art" items, such as painting, not for photographs.
  2. The Author information is totally missing. {{PD-Art}} requires the death year of the artist.
  3. The image is taken from a copyrighted Journal. Unless the uploader can show that the image was PD prior to it's use in Number 3, 2005, the image is copyrighted.
  4. If the "Widtsoe Collection" is same as the John A. Widtsoe Collection, which I can't seem to prove one way or the other, but is likly, then the Author died in 1952, making these image no where near PD as the author died only 61 years ago.

I find a claim of PD highly questionable, so much I was almost temped to tag it as simply a copyvio, as it is clear that the image was taken from a copyrighted journal.--ARTEST4ECHO talk 18:08, 22 August 2013 (UTC)[reply]

As the issues regarding the file whose Commons deletion request this file was supposed to support seem to have been resolved through OTRS, I think the XCF version is no longer needed on Commons as nobody will likely want to edit it anymore, and the JPEG suffices in the context where it is used in a discussion. (This is not a courtesy deletion request, please do not consider my opinion any more than those of anybody else. It may e.g. be useful to check if it is educationally useful to illustrate the terrible rendering of XCF files by MediaWiki, but only if we have no better files to illustrate that.) darkweasel94 23:27, 22 August 2013 (UTC)[reply]

Uploader requested. I was the original creator on Wikipedia, and an SVG exists here on Commons. Fry1989 eh? 01:19, 22 August 2013 (UTC)[reply]

They're the same thing! I made this at a time before I knew how to work with vector graphics. This PNG has no use and nobody will every use it again. Fry1989 eh? 18:00, 22 August 2013 (UTC)[reply]
  •  Keep We have no limitation of disk space, and we can host both file versions. Part of the scope of Commons is a complete host of images, and external sites may prefer PNG rather than SVG. This battle to force SVG purity is a silly pursuit.  — billinghurst sDrewth 11:52, 24 August 2013 (UTC)[reply]

I NEVER said this was a SVG purity battle, or a matter of disc space, but as the original creator do I not have the right to at least request it be deleted? I made this, and yes I know we do not own our images here, but you have to understand why I made this. I made this because at the time, there was an SVG of both the Suriname coat of arms and the flag, but I did not have knowledge of how to work with vector graphics, so I did it in PNG instead. I then put it in a graphic lab request so someone could make an SVG. It's essentially now a scaled down duplicate, and it will never be used. Make an argument for why it should stay when it will never be used and there is an SVG. It's foolish to keep it when there is absolutely no need for it. I do not accept the notion that some outside websites may prefer SVG, because all our SVG images are rendered in PNG anyways and can be selected in essentially any size you want, instead of this PNG file which has a set permanent resolution. Fry1989 eh? 18:04, 24 August 2013 (UTC)[reply]

According to the uploader, copyright has been released on this corporate logo, but on their website it is clearly marked as a registered trademark and the site has the standard copyright notice one would expect at the bottom, so I'm thinking the uploader did not really have permission to just give away the rights to this and it is not a free image at all. There's no FOP in Argentina for sculptures. According to the plaque, this monument was created in 1991, so it is not in the PD. BrightRaven (talk) 07:54, 22 August 2013 (UTC)[reply]

Esto es un monumento publico de un prócer. No es una obra de arte que con un autor claro sino una estatua construida por el municipio para homenajear al comodoro Rivadavia, quien le da su nombre a la ciudad, pero no es cosa de un artista...es un simple monumento público. --Gonce (talk) 16:22, 24 August 2013 (UTC)[reply]

Keep I can confirm that the blogspot post referred to dates from 6 months after the date of upload of this file to Wikimedia Commons. Also, it is in very considerably lower resolution in blogspot than in the Wikimedia Commons file, so the blogspot copy cannot possibly be the source of the Commons one. The picture is used in that blogspot post as part of a video which clearly shows text taken from an English Wikipedia article in which the image is used, so it is eviden that the picture was copied from Wikipedia to blogspot, not vice versa. •  Delete I see two problems: performances are protected in Japan for 50 years since they took place (and for some other period of time in the United States), and we don't know the copyright status of the music. file title, description and close up of date indicate that this newspaper dates from 1927, so I would assume the page itself is out of copyright. This file was initially tagged by Botaurus as Speedy (Speedy) and the most recent rationale was: copyright infringement, the death date (1920) from the source Düsseldorfer Auktionshaus is false. Death year is 1945. Please compare Arcadia auctions results. There are two artists with this name. One died in 1920, the other 1945. But the sign it is always the same and also the motives. It is therefore likely that errors are present here (happens quite often in the auction „world“). --Botaurus (talk) 21:58, 22 August 2013 (UTC)[reply]

It seems that this was first published in 1926. Unless it was published before 1926, it is protected by copyright in the United States for 95 years since publication, per {{Not-PD-US-URAA}}. Stefan4 (talk) 22:52, 22 August 2013 (UTC)[reply]

It seems that before 1994 the maximum protection term in Sweden was 50 years [4] (linked from [5]), i.e. that this image is URAA compliant. Materialscientist (talk) 00:35, 23 August 2013 (UTC)[reply]
The translation is missing a lot of transnational rules for older works. You can find them here. As far as I can tell, the relevant transitional rule is this one (from 1 January 1996): "2. De nya bestämmelserna tillämpas även på verk som har kommit till före ikraftträdandet." = "2. The new rules also apply to works which were created before the law went in force." That is, the copyright to this work was restored in Sweden on 1 January 1996. As it was copyrighted in Sweden on 1 January 1996, the copyright was restored by the URAA. There is a rule which says that anyone who was already using the work at that time was allowed to continue using it until the end of 1999, but this shouldn't help us. --Stefan4 (talk) 11:51, 24 August 2013 (UTC)[reply]

Why is this in the public domain? This is a photograph of a 3D object and in Spain, works do not enter into the public domain until 80 year pma (at least at the time the work was created) Stromare (talk) 23:19, 22 August 2013 (UTC)[reply]

The pin was made in 1931 for the election. The PRRS did not run in 1933, so it's the only time the work could be done. Hence, it's in the public domain. --Fer1997 (talk) 12:42, 25 August 2013 (UTC)[reply]
