- I think that the person didn't understand the nature of a free licence. The first deletion request took place within a week of the edit of the picture. - I have decided to vote Delete on this image. But it should be made clear to the uploader that releasing a file under a free licence is in fact not revocable. What that implies is that if somebody were to decide to use that file anywhere on the Web they would be completely free to do that. If somebody would wish to use it in an article on any Wikimedia project they should open an undeletion request, and such a request should be granted. The file may have been released under a free licence as a mistake, but since this mistake wasn't rectified for such a long time, there's nobody to blame for that besides the copyright holder. Neutral Two first closures were totally legitimate. But I looked at Category:Zahlé and we have quite a lot of panoramic views there, included one valued image. - Keep Checking a few, it looks like while they don't show notable people, they often show notable events (eg Emmy Award ceremonies of the 1980s and 1990s). But not without restrictions of purpose. But there is no proper links in image sources. There is no photos at the page [7] which provided as a source. So there is not proper link.

Although CMG claims to own the rights to the likeness of Bettie Page, which is in itself a questionable claim, the photographer and copyright owner of this image was Art Amsie, who died in 2006. - I have to find evidence with google, I have to read a book. For practical reasons I restricted myself to the book. It only says Amsie made pictures of Page, but it doesn't say Amsie made all Page pictures, or this one in particular. Now you say this picture was made in 1956, again with no sources to support it. It seems like you have a source you don't want to reveal, or you seem to play some sort of a strategic game to have this picture removed. This image has an OTRS-ticket for 3 years. It only says Amsie made pictures of Page, but it doesn't say Amsie made all Page pictures, or this one in particular. Now you say this picture was made in 1956, again with no sources to support it. It seems like you have a source you don't want to reveal, or you seem to play some sort of a strategic game to have this picture removed. This image has an OTRS-ticket for 3 years. The Image is OWNED and PROVIDED by CMG Worldwide as they OWN Bettie Page as a product. They sent me that picture with the permission which was accepted by wikipedia LONG TIME AGO.

- CMG Worldwide manage the commercial use of the name, likeness, or image of dead celebrities (usually for the estate, who actually own those rights). They may claim to own Bettie Page as "a product", but that does not mean that they own the copyright to any particular image. They may have acquired the copyright from Amsie or his estate, but I would be wary of any such claim without significant proof, based on my very limited exposure to these issues. There seems to be a very deliberate effort to conflate the concepts of copyright and commercial use of the image of dead celebrities in cases such as this. - My comments to do some research is directed to no-one in particular. I do apologise that I appear to have hurt your sensitivities; for whatever reason. Now, that link may be pertinent in this DR. I would suggest pinging someone like User:Magog the Ogre and get their input on the copyright renewal status; i.e. was it done in time, and whether it is possible to ascertain if the image is one and the same. If someone, such as Magog, comes back with an opinion that the image is copyrighted, CMG can then be contacted via OTRS with this information, and they can confirm if they are now managing the copyright of the photographs, whatever, etc. This is the way to progress in DR's such as this. russavia (talk) 16:32, 26 December 2012 (UTC)

- I was asked for my input. The OTRS ticket has a document attached which states, verbatim, that CMG is "the sole owner of the exclusive copyright to the attached image portraying Betty Page in a two piece swimsuit and black gloves... [http://commons.wikimedia.org/wiki/File:Bettie_Page.jpg]". As for finding if the publication was renewed, we would have to first establish where and when it was first published. Given that the DR seems to be calling that into doubt, we cannot do that. My sense is that we should probably take CMG at its word; it is quite likely the copyright was transferred to CMG, and we do have an official document from CMG certifying their ownership. All of this unless, of course, the nominator can show there is significant reason to doubt this, which IMO we do not have as of yet because we haven't even established who the author is. - The author is Art Amsie according to the site of one Bettie Page expert. I have no doubt that CMG will claim ownership regardless of who the photographer was. I have doubts about the validity of that claim, but OTRS seems unable to handle more than the most simple case, so my doubts are probably irrelevant. I usually favor keeping alternative versions of fine art images, but this one is quite low res and pretty much identical to the high res version, with the exception of the skin tones being slightly green in this version. - Ich verweise noch einmal auf §5 Abs. 1 UrhG, wo Fahndungsfotos definitiv nicht aufgelistet sind. Es gibt keinen anderen Anhaltspunkt dafür, dass Fahndungsfotos Amtliche Werke sind, z.B. in der Rechtssprechung. Bobo verwechselt §5 mit §45, welcher allerdings keine Gemeinfreiheit begründet. - Es gibt für Veröffentlichungen behördenfremder Werke zum Zwecke der Rechtspflege und der öffentlichen Sicherheit Bildnisse gibt es eine eigene Norm § 45 UrhG. Dieser erlaubt aber eine Veröffentlichung genau zu diesem und nur zu diesen Zwecken und unterliegt dann auch noch dem Veränderungsverbot des § 62 UrhG. As argued in Commons:Deletion requests/RAF fahndungsplakat ±1972, keeping the images would not be in accordance with Commons and Foundation policy.
- First, it clearly cannot be exempted pursuant to section 5 (1) UrhG, acc. to which "Acts, ordinances, official decrees and official notices, as well as decisions and official head notes of decisions do not enjoy copyright protection." Of course this image is not even close to any of the mentioned kinds of work.
- Second, acc. to section 5 (2) UrhG, "The same applies to other official texts published in the official interest for general information purposes, subject to the proviso that the provisions concerning the prohibition of alteration and the indication of sources in Article 62 (1) to (3) and Article 63 (1) and (2) shall apply mutatis mutandis" (http://www.gesetze-im-internet.de/englisch_urhg/englisch_urhg.html#p0027). It follows that, to quote myself, "it is irrelevant if they are covered by § 5 (2) UrhG as this would mean that they are subject to § 62 (1) and thus not freely usable anyway (c.f. [9])." According to section 62 (1) UrhG, "[w]here according to the provisions of this Section the use of a work is permissible, no alterations to the work shall be permissible. Article 39 shall apply mutatis mutandis." (http://www.gesetze-im-internet.de/englisch_urhg/englisch_urhg.html#p0378). As an immediate consequence, the conditions in http://commons.wikimedia.org/wiki/Commons:Licensing#Acceptable_licenses are obviously not met ("In particular, the license must meet the following conditions [...] Publication of derivative work must be allowed").
