This screenshot of a public domain software contains an unidentified picture at the left from unknown source. Furthermore, the public domain license is only indicated at the top of source code files, not on the application README, so software author don't claim this picture is his or concerned by the public domain release. The music in the audio part of the video must be available under a free licence. No declaration of the audio source in the file description. Pristurus (talk) 23:23, 12 March 2012 (UTC)
The audio in this clip has significant original and trans-formative audio content(ie the speech at the beginning which gives context) and is not a direct copy of any music track. I believe it would constitute "fair use" regardless of the source. A copyright violation would occur if the upload was a direct copy and uploaded as such (ie any example of Arabic music). By the nominator's reckoning, for example a video containing an incidental view of an artwork or any audible music in the background would be a copyright violation. Wikipedia clearly fits within the "fair use" sub-categories of teaching, scholarship and library archiving. The clip is of no commercial value and exists only to enhance the Belly Dance topic here. - Hi Hullwarren, I am not happy with this legal issue. In other similar cases it was possible to remove or change the audio parts. Deleted: Videos is indeed a clear DW of the music (a permission from the relevant musicians/copyright holders would be needed to keep it). Fair use is not allowed at Commons. If I'm reading it correctly, this was recorded in 2011, and is therefore not eligible for PD, despite the age of the original piece. The given source doesn't seem to clearly release the recordings as PD, unless that's what "enregistrements devant public" means, instead of my machine-assisted translation of "recordings before an audience". - Hmm... The Kosova Times article postdates the Commons image by two years, so it looks more likely that the writer simply looked up Gjylbegu on Wikipedia and took the photo from there. There's an uncropped version from 2 years back on this fan site, with a copyright notice claiming "Elvis Spada" as the author. According to the metadata of Adelina Ismajli KM2009.jpg that is same person as Piasoft, the uploader of the image. Also compare [3] and [4] -- note how the latter image has smaller resolution and has been slightly cropped to remove the "(c) Elvis Spada" notice on the right. Bonjour, J’ai voulu mettre en ligne cette photographie qui me semblait porteuse d’un message d’une résonance complexe et tragique. Cette photo m’interroge et j’espère qu’elle vous interrogera aussi, non sans une certaine ambivalence: elle me situe pour ma part entre empathie et réprimande (la mendicité est interdite dans les transports publics et même à Genève), entre éthique et politique (les technocrates de Bruxelles et de Suisse travaillent-t-il vraiment concrètement à l’inclusion sociale de cette minorité persécutée?), entre solidarité et impuissance. Donner de l’argent pour sa bonne conscience, pour avoir la paix, donner de l’argent pour finalement renvoyer l’autre à son destin de mendiant, ne participe t-il pas à perpétuer le cercle vicieux de la stigmatisation, en lieu et place d’un possible avenir d’intégration et d’appartenance des Roms? Défi réalisable et de notre temps de donner enfin au Peuple Rom les moyens de s’autodéterminer avec les nations? Avant de publier mon image, j’ai tenu à flouter au mieux (modèle Google Street) les personnes reconnaissables de ma photo afin qu’elles ne puissent pas être facilement identifiées, et non pas comme par exemple:

Official EMT company logo. Unused and out of scope. The fact that the logo was re-constructed from PD elements is immaterial to the copyright of the logo: the copyright is applied to the "artistic idea," which is the arrangement of the arch, snake, and blue cross elements. One cannot avoid copyright by reverse engineering it. That would be like hearing a song and re-recording it and without securing a license from the original copyright owner. - Keep Good user, most of his uploads are completely non-controversial, except 3 low resolution ones. Google and Tineye do not know anything bad about these pictures. Giving that "small resolution, missing EXIF" is only evidence against user (and giving that it's not really an evidence at all), I believe him. - Bon j'ai résolu le problème, il s'agit en fait de Pascal Orsini, mauvaise lecture de ma part et je te prie de m'en excuser, ma vue baisse. Ce photographe a été actif à Calvi du milieu des années 1900 jusqu'aux années 1920. Après plus rien. La retraite des vieux travailleurs n'existant pas en France à cette époque, sa cessation d'activité correspont donc à peu de temps près à son décès. Cf.
