Previously nominated twice. The first time it was kept because the nominator only mentioned the statues, which are de minimis. The second time, it was nominated for deletion because the image contains a building, which is not de minimis, but the nomination was speedily kept because the sculptures are de minimis, without considering the claims in the nomination. The building is still not de minimis and the photo still violates the copyright of the architect. The building is the whole purpose of the image, so it is impossibly de minimis. The image is copyrighted, and the site's photo usage terms and conditions indicate that it is to be used on condition that it is "used in non-advertising materials only" (contrary to the requirement of the Commons that all images uploaded here "can be used by anyone, anytime, for any purpose"). Deleted. All architecture is copyrighted -- it does not have to be "special", only original. Unless this is a close copy of something in the public domain, it has a copyright of its own. Since this style of building was not used until after WWII (around 1949), even if it is an exact copy, it is a derivative work of a structure also built after 1940, so either way, this infringes.

- Keep as uploader - For reasons given at Commons:Deletion requests/File:Burj Al Arab from Le Royal Méridien Beach Resort and Spa in Dubai 2.jpg. Although this image was taken at night, the subject (the bay and the marina) is the same, and copyrighted buildings which are not the subject again come under Commons:De minimis. - Comment - I'm considering re-naming most of my uploads on the Dubai Marina to more accurate names, per COM:RENAME, to make the intention of the images more clear, even if I am sceptical of the relationship between copyright issues and file names. Unfortunately, unlike images it is not easy to fix the file, it should be re-recorded. - Keep I have little doubt that this image was from the Nasa site, it appears to be composite image rather than an actual photo of the eclipse. One component of this image can be seen in this image from their site [3]. My only problem would be with the description of this image, but that has nothing to do with whether we keep the image. It does raise the question about our processes for validating sources, we need something like the flickr bot system where we have a tag placed by a bot or trusted editor that says the image was licensed as described on the date it was uploaded, otherwise every image that references a source website will expire once the image is moved or the site closes. --Tony Wills (talk) 03:10, 21 February 2011 (UTC)
