File copyright status

While everyone is welcome to contribute constructively to the project, one or more of your file uploads had missing or false information regarding its source and copyright status. Please note that Wikimedia Commons takes copyright rules and infringement very seriously. Files may only be uploaded and included if their copyright status meets the conditions stated in our licensing policy, and if their provenance is clearly documented. - Other similar images, eg British Passport cover 2010 (non-EU).jpg, has the same copyright tag. 2001:8003:42A2:8001:7442:4A2D:DF6A:3D96 15:57, 8 May 2024 (UTC)
- I'm going to respond to the above IP's post on the assumption that the IP is ZElsb. The fact that someone else uploaded a similar file under the same license doesn7t automatically mean either (1) these files can also be uploaded under the same license or (2) the other person's file is using the correct license. The dates in this particular license seem to imply that it only can be used for works created before 1974 or photos taken before 1 June 1957. Perhaps the crest imagery on the passpot cover does satisfy these criteria, but I'm not sure the same can be said of the photo taken of the passport's inner page or identity cards. If it can't, then a more appropriate justification may need to be provided for the files or they may need to be deleted. Since Commons COM:EVID states it's the responsibility of the uploader to demonstrate the license they choose to use is correct and applicable, it will be helpful if you can further clarify why you think these files should be kept in some way other than someone else did roughtly the same thing. -- Marchjuly (talk) 00:52, 9 May 2024 (UTC)

- Why do you think it would be OK to relicense these files as {{CC-by-sa-4.0}}? Are they your COM:Own work (i.e. you own the copyright on them)? If not, then you can't relicense them as such without the copyright holder's COM:CONSENT as explained in COM:NETCOPYVIO. -- Marchjuly (talk) 04:39, 9 May 2024 (UTC)

- The problem is with the copyright licensing you used for the files, not the categorization of the files; so, not sure what re-categorizing them will resolve unless you mean "re-license them". For reference, one of the files you mentioned above, en:File:British Passport Series C Data Page (Gibraltar).jpg, was uploaded locally to English Wikipedia as non-free content. Commons doesn't accept non-free content of any type per COM:FAIR; so, you won't be able to re-license the ID care files as non-free and expect Commmons to host them. You probably could upload them locally to English Wikipedia as non-free content as long as their respective uses satisfy Wikipedia's non-free content use policy. If that's what you mean by "re-categorize", the Commons ID card files will need to be deleted either by tagging them for speedy deletion per COM:CSD or by nominating them for deletion per COM:DR. -- Marchjuly (talk) 10:05, 14 May 2024 (UTC)
