The file I wanted to use was already in wikipedia. It was in the Bavarian section of the net. According to what the person there said, the file I wanted to use did not qualify for copyright, because it did not meet the protection standards. It was void of originality, therefore it could be used. Hence, there is no copyright violation.
This person is to be found in bar.wikipedia.org under the URL

and he goes by the name "André".

- Ich glaube die Unterhaltung kann auf Deutsch geführt werden. Die Anforderungen in den Projekten sind unterschiedlich, einige Wikipedia-Versionen (de, bar) basieren auf deutschem Urheberrecht welches sehr hohe Anforderungen bezüglich Schöpfungshöhe, also wie kreativ muss ein Werk/Logo sein um urheberrechtlichen Schutz zu geniessen, hat. Commons hingegen basiert auf US-amerikanischem Recht und dem Urheberrecht des Ursprungslandes, hier vermutlich Frankreich. Zumindest in den USA ist die Schöpfungshöhe (Threshold of originality) deutlich niedriger. Folglich wird das Logo COM:L#Simple_design nicht erfüllen und folgerichtig wird es in der en.wikipedia als fair use geführt (en:File:AFP logo.svg). --Martin H. (talk) 14:27, 2 January 2011 (UTC)
Lieber Martin,
vielen Dank für die freundliche Geste. Ich habe das Logo über wikiversity getan, dessen Sitz in Deutschland und Frankreich zugleich ist. Aber gut, daß Sie mich auf diesen Unterschied aufmerksam machen. Der Löscher kam m.E. aus dem frankophonen Kanada, wenigstens so meine Vermutung. Das Logo habe ich unmittelbar über de.wikiversity.org wieder hochgeladen.

Hello, I think that this logo is too original for {{PD-textlogo}}. You can ask for undeletion here: Commons:Undeletion requests/Current requests, but I doubt it will be restored. Regards, Yann (talk) 16:19, 2 January 2011 (UTC)
The logo has been in bar.wikipedia.org since 2008. Nobody has ever questioned its validity. Why do you think the logo is "too orginal"? You never were able to tell me why. it doesn't matter any more whether you restore it or not.
