The file you added has been deleted. If you have written permission from the copyright holder, please have them send us a free license release via COM:VRT. Wikimedia Commons does not accept fair use content.
We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules. In addition, fair use is not compatible with our aim as a collection of freely distributable media files. Therefore, Commons cannot legally rely on fair use provisions. Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

I recreated it again, thinking that I found the right licensing for it, but I keep being told that I do not have the right licensing. All I want to do is upload an image, which is allowed under Non-free logo usage. After going through all of the forums on here about it, I am still extremely confused how to get this image on the page. I don't really understand what the commons is and why it won't just let me upload this image with the Non-free rationale logo box. — Preceding unsigned comment added by Nek1095 (talk • contribs) 00:02, 29 June 2016 (UTC)
- Hi Nek1095. Wikimedia Commons only allows media files which are either freely licensed or in the public domain to be upload per COM:L; it does not allow non-free content to be uploaded. That is why this file has been deleted every time you've uploaded it to Commons and what is meant by the sentence "Wikimedia Commons does not accept fair use content" in the template posted above this thread. Certain Wikipedia's (for example, English Wikipedia) do allow non-free content to be uploaded and used as long as certain conditions are satisfied as also explained by the sentence "Non-free content that may be used with reference to fair use may be uploaded locally to projects which allow this" in the aforementioned template. Since it appears that you do not hold the copyright on this crest and have provided no evidence that the fraternity has agreed to freely license it, you have a couple of options: (1) Contact the copyright holder (most likely Theta Xi fraternity) and ask them to agree to freely license the crest as explained in COM:OTRS#If you are NOT the copyright holder; (2) Upload the file locally to English Wikipedia using en:Wikipedia:File Upload Wizard as non-free content. Please note that if you choose the latter option, you must make sure that the file's usage satisfies all 10 non-free content criteria listed at en:WP:NFCC.
