We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules. In addition, fair use is not compatible with our aim as a collection of freely distributable media files. Therefore, Commons cannot legally rely on fair use provisions. Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

Image license
[edit]Dear Elias, It was I who persuaded Dan to change the flickr license of the Trebula Mutusca inscription by flickrmail. The image initially failed flickr review. Only images licensed 'Attribution Creative Commons' like this: [1] or 'Attribution-ShareAlike Creative Commons' like this: [2] (please look at the license) on flickr are permitted/permitido on WikiCommons.
- This other image by Dan of another Latin inscription: [3] is Not OK on Commons because it is licensed as 'Attribution-NonCommercial-ShareAlike Creative Commons.' Next time you contact someone on flickr, ask them to change the license to 'Attribution Creative Commons' or 'Attributions-ShareAlike Creative Commons.'
- Images with a 'Non-Commercial' or 'No-Derivatives' restriction will fail flickr review and be deleted on Commons.

- You're welcome Elias. Some people don't change flickr image licenses while other do. Everyone is different. I have contacted many people to change the image licenses on flickr; some ignore me while others like Dan or Hans are open to this suggestion to use them in Wikipedia. But whatever you decide, always wait and see if the flickr owner changes the license before placing it on Commons. Here are a few images I placed on Commons. They are licensed here as: "Attribution-ShareAlike Creative Commons".
This is one image which is licensed as "Attribution Creative Commons" on flickr:
- I had to send flickr mail to the account holders (containing the web link of their pictures) to see if they would change the license...and they did! So, I could place the images on Commons. Thank You, --Leoboudv (talk) 21:11, 8 February 2009 (UTC)
- Thank you Elias for your compliment! By the way, when I send flickr mail, I always include a link to both the flickr picture and also the article on Wikipedia where it would be used. So, I might say:
- "Dear Hans, would you be willing to change the license of your image here: http://www.flickr.com/photos/menesje/1118397470/in/set-72157600520032668/ to either 'Attribution Creative Commons' or 'Attribution-ShareAlike Creative Commons' so that I can use it in this Wikipedia article on Thutmose III's foreign wives: http://en.wikipedia.org/wiki/Menhet,_Menwi_and_Merti It would be very useful for this Wikipedia article."
- Here, the flickr owner knows where you want to use the article...and they may be more willing to change the license to make it copyright free. This is 1 final picture I uploaded which is now licensed as 'Attribution Creative Commons" on flickr (the flickr owner changed the license so it can be used for Wikipedia's article on pharaoh Senusret II):

[edit]This person on flickr (J. Dwyer) licenses all her images as 'Attribution-ShareAlike Creative Commons.' And she has taken some in Mexico. So, you can just upload them on Commons without any problems or asking her permission! I don't know about Monterrey...but her pictures elsewhere are quite good. - Lo que pasa es que el Talamentes no conoce o no quiere saber los usos de wikipedia (NPOV etc.). Escribe sin referencias y como tiene gana con su punto de vista. Lo que me parece raro es que dice que es Mexicano pero no tiene una cuenta sobre la wikipedia en espanol. Y cuando intentas de dialogar con el te sale une acumulaciones de frases sin real argumentacion construita o sin relacion con el sujeto. Alfonso Reyes statue

Elias, I don't know the particular statue, nor do I particularly know Mexican law, so I have no idea what its legal status is. It would be a combination of when the statue was made, how Mexican copyright law works for statues of that period and (if the statue would still be under copyright) what are the Mexican laws on freedom of panorama to photograph public works of art. You should probably see if someone else (ideally an admin) who has uploaded similar images from Mexico would know the answers to these questions. - 70.251.70.238 22:14, 13 March 2009 (UTC)
Ah, looks like you are fine. Mexican law specifically allows "Reproduccion, comunicacion, y distribucion por medio de dibujos, pinturas, fotografias, y procedimientos audiovisuales de las obras que sean visibles desde lugares publicos." Tip: Categorizing images

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.
Here's how:
1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:
2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.
[[Category:Category name]]
For example, if you are uploading a diagram showing the orbits of comets, you add the following code:
[[Category:Astronomical diagrams]]
[[Category:Comets]]
This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".
When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").
