COA

Hi ! Can some admin replace the image Image:Russia coa.png by Image:Russia coa.svg in this template. Regards, EDUCA33E 13:22, 16 December 2006 (UTC)

No, there is still debate about the SVG image. User:Zscout370 (Return fire) 20:19, 16 December 2006 (UTC)

i think the discussion came to the conlcusion that the .svg file is PD therefore the template could now be changed... Senegrom 20:32, 21 January 2007 (UTC)

As far as I understand point 22 of the decision no.15/2006 by the Supreme Court of the Russian Federation, dated June 19, 2006 (in Russian), the non-copyrightability of state symbols extends also to official symbols of local or municipal authorities. Lupo 11:17, 30 January 2007 (UTC)

Proposal for 2007 (Law) and 2008 (New Code)

I have just prepared new version of tag with two important comments and one impotant warning. See Template:PD-RU-exempt/proposal.

I have just also prepared the version of tag, which is agreed with new Civil Code of Rus.Fed. (It will take effect at Jan 1, 2008). See Template:PD-RU-exempt/2008 Alex Spade 17:41, 3 May 2007 (UTC)

I suggest to include Russian text of the law in this template with addition of point 5:

5. Авторские права не распространяются на идеи, концепции, принципы, методы, процессы, системы, способы, решения технических, организационных или иных задач, открытия, факты, языки программирования.

I think, point 5 is also very important for us. MaxiMaxiMax 00:58, 4 May 2007 (UTC)
OK Done Alex Spade 17:00, 4 May 2007 (UTC)

News reports on events and facts

Quoted from the new template, does that mean that news reports are free from copyright? So how does that work? Any screenshot of a news Russian report is free of copyright? --Kuban kazak 22:06, 3 May 2007 (UTC)

No. According to current law-enforcement practice this paragraph is applied only to textual information. The audio/video news reports are still copyrighted. In case of audio/video news report you can freely use only textual decoding decoded facts of audio-tarck of report. Alex Spade 06:07, 4 May 2007 (UTC)
I think it's about fact-like text. Facts is not protected by copyrights. Something like "Moscow time is ...", "Weather in X is Y, portly cloudy, wind is Z", etc. Please note similar television programs, transport schedules and the like. Entire news report will be covered by copyrights. Same as article in newspaper. --EugeneZelenko 14:15, 4 May 2007 (UTC)
I agree. In my answer I had just made amplification of non-freedom of image/audio/video news reports. Articles and full decoding are copyrighted. Alex Spade 16:05, 4 May 2007 (UTC)

Items of expeception

Would this include military insignia and the state anthem? User:Zscout370 (Return fire) 04:20, 4 May 2007 (UTC)

  1. Yes, according to Commentary for old Law and new Code. All state and municipal signs (including, military insignia, road signs, etc.) via paragraph Official documents and notice and the like. The text or graphic description of these signs are released as enclosures to respective official docs or as special official docs. Those of them, that have heraldic elements, are to be gradually to include in the Heraldic Register of the Rus.Fed.
  2. Anthems, according to Rus.Law, are integral parts of the triumvirates of state or municipal symbolism.
Alex Spade 05:34, 4 May 2007 (UTC)

Category

With foregoing changes, I think, that Official symbols of Russia isn't suitable for images with PD-RU-exempt tag. What name of category is more suitable? Alex Spade 17:00, 4 May 2007 (UTC)

I think we are to create Category:PD-RU-exempt which should be included into Category:Public domain and Category:Russia-specific copyright templates. VanHelsing.16 17:59, 5 May 2007 (UTC)
Done. User:Zscout370 (Return fire) 04:26, 6 May 2007 (UTC) (on vacation)

I'm sure it's not very difficult to create a Russian version of this template VanHelsing.16 16:12, 10 May 2007 (UTC)

Ok. I will have done. Alex Spade 17:30, 10 May 2007 (UTC)
Once it is finished, how will we be able to add the Russian text to it? User:Zscout370 (Return fire) 03:35, 11 May 2007 (UTC)
No problem. I have made the new version of Template:PD-RU-exempt/proposal, where Template:PD-RU-exempt/lang is added. Alex Spade 05:16, 11 May 2007 (UTC)
Ok, added. User:Zscout370 (Return fire) 08:13, 11 May 2007 (UTC)

Stamps

Are postage stamps in fact "state symbols and signs"? The English text does not mention them, and personally I wouldn't just automatically assume that, but we have a whole lot of stamp images tagged with this - Category:Stamps of the Soviet Union. --Davepape 14:38, 25 October 2007 (UTC)

Pushkin Museum tickets

Do Pushkin Museum tickets such as File:Входной-билет.jpg (a scan of a modern ticket) fall under {{PD-RU-exempt}}? In other words, (1) is the Pushkin Museum a Russian "State" agency in the sense of "state government agencies and local government agencies of municipal formations"? and (2) is a ticket an "official document" or one of the "state symbols and signs" of such an agency? I would say maybe to (1) but no to (2). What do the experts think? -84user (talk) 23:21, 16 October 2010 (UTC)

Dear Andros64. Don't mix Template:PD-Russia and Template:PD-RU-exempt. Plz, try to read the templates first and try to analize the changes. 2008-law doesn't change much in exempt section of law. Moreover, the 2008-law is more freely and more accurate in exemp section. Moreover, these changes for this template was dissused earlier. Alex Spade 18:28, 10 January 2008 (UTC)
I think I got it. User:Zscout370 (Return fire) 06:58, 11 January 2008 (UTC)

Current link is for old edition of document, and also may be not available for some browsers. It would be good to make link for full text http://www.consultant.ru/popular/gkrf4/ or even s:ru:Гражданский кодекс РФ. I think that advertising of Consultant isn't good, there is also http://base.garant.ru/10164072/69/#40000 in Garant, so using of wikisource is better.

  • Wikisource is not good source. The many official docs on Wikisource are outdated and we cann't be sure about accuracy. The WIPO site is better, if you don't want to advertise Consultant or other commercial project. Alex Spade (talk) 11:41, 1 April 2012 (UTC)

A recent deletion request seemed to indicate that works that qualify for the PD-RU-exempt tag can incorporate existing copyrighted material such that the work as a whole can be treated as out of copyright but at the same time, extracting and reproducing specific parts from the work would be considered copyright infringement. In particular, a Russian stamp was found to qualify as PD-RU-exempt even though the 2014 Winter Olympics mascots shown on the stamp would be subject to copyright restrictions (from what one can tell) if extracted from the stamp image or if the stamp image was cropped to focus on one of the mascots, for example. As such, it might be useful to add a note to the PD-RU-exempt template that mentions this aspect. --Gazebo (talk) 08:43, 24 February 2014 (UTC)

Yes, you are right. I will have proposed comment about such cases both in Russia and English ASAP. Alex Spade (talk) 09:37, 28 February 2014 (UTC)
The following markup produces a modified version of the template and may be of interest (viewing the wiki markup for this talk page section should show the proper formatting):

From what one can tell, the existing PD-RU-exempt/layout template has a three column table of sorts with a "public domain" icon, the main text, and then the Russian Federation coat of arms. In this modified version, the existing table is followed by another row with three columns with a warning icon, the "preexisting works copyright" warning text, and then a blank row for formatting consistency. --Gazebo (talk) 11:06, 16 March 2014 (UTC)
I think, the next statement after 1st comment is enough:

Comment - The Russian official document, state symbol or sign (postage stamps, coins and banknotes mainly) may incorporate one or more works that can be copyrightable if separated from this document, symbol or sign. In such a case, this work is not object of copyright if reused in its entirety but, at the same time, extracting specific portions from this work could constitute copyright infringement. For example, denomination and country name must be preserved on postage stamps.

  • "preexisting" is incorrect requirement - many drawings were first published on stamps, but they are still copyrightable if separated from stamps;
  • statements "it is Public Domain" and "it is not object of copyright" is enough different for Ru-law (author's name is important for first one and unimportant for second one). Alex Spade (talk) 19:38, 16 May 2014 (UTC)

Postcards

Hi there! How are postcards like File:Иркутск. Старый дом. 1980-е.jpg + File:Иркутск. Торговый комплекс. 1980 год.jpg + File:Иркутск. Площадь им. С.М. Кирова.1986.jpg + File:Иркутск. Вечный огонь. 1982 год..jpg + File:Иркутск. Дворец спорта. 1988 год..jpg etc.etc.etc. treated per {{PD-RU-exempt}}. Official documents? Works of folk art? Gunnex (talk) 20:41, 23 September 2015 (UTC)

The most recent/new discussion of the Russian wikipedians (both members of "Project:Philately and post" and sysops, specializing in image and copyright policies were represented) about such cases can be found on ru:Википедия:Форум/Архив/Авторское_право/2013/08#Лицензирование почтовых конвертов.
TL;DR (in English):
  1. Postal card (маркированный конверт/карточка, МК or marked envelope/card) (not to be confused with postcard) is sign/mark of postal payment and so {{PD-RU-exempt}} (according to Order of MinSvyaz N 115, 26.05.1994).
  2. For МК postal card with postal stamp must issued as single unit by typographic way (stamp must be printed or putted on envelope/card by typographic machine, not by sender or postal employee). See File:Valio PSE Russia 2006.jpg (envelop) or File:Mikhail Kalatozov PSE Russia 2003.jpg (card) as examples.
So, if you do not see stamp printed or putted on envelope/card by typographic machine - this is not {{PD-RU-exempt}}.
Also, please note that the Russian postal card may incorporate one or more works that can be copyrightable if separated from this card (see File:Valio PSE Russia 2006.jpg). In such a case, this card is not an object of copyright if reused in its entirety but, at the same time, extracting specific portions from this card could constitute copyright infringement. Alex Spade (talk) 17:29, 25 September 2015 (UTC)
Thx @Alex Spade: for your reply. So, if I understand correctly, the examples which I have quoted above may be in public domain by other reasons, but NOT via {{PD-RU-exempt}}, right?
All mentioned examples are modern postcard (created after 1980), so they can not be in PD. Old Russian postcards cab be in PD via {{PD-old-70}}, {{PD-Russia}}, or {{PD-RusEmpire}}. Alex Spade (talk) 08:24, 26 September 2015 (UTC)
Thank you very much. Gunnex (talk) 09:02, 26 September 2015 (UTC)

Too long

This is an awfully long template. Would it be possible to shorten the template somehow, or maybe split it up on multiple templates? If a copyright tag is too long, users might be discouraged from using files which have been tagged with the template as there is too much legal information to read. --Stefan2 (talk) 23:27, 4 November 2015 (UTC)

  • I disagree, that template is too long. Could you present no-assumption, but real causes then users were/are discouraged? The template in this form exist 8 years, the respective files are used widely.
Nevertheless: (a) the paragraph 5 can be cut out - this is worldwide principle of copyright, and (b) fontsize for bottom of the template can be <small>ed. Alex Spade (talk) 07:46, 5 November 2015 (UTC)

Works made by government agencies

"Document" is a bit vague - does this mean photos from employees of Russian state agencies and uploaded on official websites are free from copyright? Wikimandia (talk) 09:01, 8 November 2015 (UTC)

Add anthems and medals

The copyright status of government anthem in Russia, is one of the issues touched upon in the recent First National Anthem Of Ingushetia undelete discussion I am proposing that "anthem - notes and lyrics" be added to the state symbols and signs list. This is based on text from:

The "Public Domain. Textbook." by Sudarikov S.A.
"In the Russian Federation in the first category of un-copyrightable objects are ... state symbols and signs (flag, emblem, anthem, awards, banknotes and other signs)"
Untranslated text - "Aвторские Права. Учебник. Судариков С.А.":
"В российской федерации к первой категории неохраняемых авторсим правом обьектов относятся ... государственные символы и знаки (флаг, герб, гимн, ордена, денежные и иные знаки)"
LINK
I also I think we should also add "medals" to the list, as "medal" is a better translation of "орден" than "order". Rybkovich (talk) 18:48, 5 July 2016 (UTC)
  • The text of template is quotation of text of the code. So, such additions will disturb quotation.
Nevertheless - anthems, medals, stamps, and many-many other types of official signs are PD-RU-exempt of course. Alex Spade (talk) 19:23, 5 July 2016 (UTC)
I see. You don't think that the орден to order translation is ambiguous in this context? Add a note on the bottom? I am fine if others don't find it to be an issue. I think a note re anthems should be added as there are arguments over whether notes and lyrics are copyrightable, when in regards to the the notes and lyrics it is 99% clear that those are not copyrightable. Re more context see https://commons.wikimedia.org/wiki/Commons:Undeletion_requests/Archive#First_National_Anthem_Of_Ingushetia.ogg Rybkovich (talk) 00:32, 6 July 2016 (UTC)
