circa 1938 = cannot be PD-old -- Prince Kassad (talk) 17:44, 15 June 2008 (UTC)[reply]

  •  Delete Its copyright expired in 1964 - was reapplied by the European Union in 1995, thus copyrighted in Germany, and since it meets the U.S. critical date, copyrighted even in the U.S. WilliamH (talk) 18:05, 15 June 2008 (UTC)[reply]
  •  Keep That is incorrect. This is the first time this image was uploaded. The other image was deleted consecutively three times in a row. This is a different image. The information is incorrectly labeled since I uploaded the image to the pretext of the last one. It is circa 1930's, but I am unaware of its actual date. Also, the original author is not copyrighted in the first place. Many of the photographs taken during that era do not hold a copyright. Zarbon (talk) 14:43, 16 June 2008 (UTC)[reply]
    • but I am unaware of its actual datethe original author is not copyrighted in the first placeMany of the photographs taken during that era do not hold a copyright - You don't seem to properly understand copyright. 1. All pictures from that era are copyrighted, 2. we need a date, 3. we need an author (even if it's anonymous). -- Prince Kassad (talk) 19:57, 16 June 2008 (UTC)[reply]
  •  Comment. It's not incorrect, per this. In a nutshell, it's not suitable for commons. WilliamH (talk) 21:13, 16 June 2008 (UTC)[reply]
  • Alright, well then it may be incorrectly tagged. Therefore, the author is unknown and furthermore, needs more clarification of date and who took the photo. But that doesn't mean that the image MUST be deleted just because there isn't sufficient information to know the picture's background. If anything, the image can be from 1932 or even 1934...why delete images that can be maintained without having to determine their actual source...regardless, if anything, if the photographer is located, which I myself have not been able to find, it would be between 1930 to 1938. The image should not be deleted because there are numerous, dozens of photos that do not specify the actual person, etc. and are listed as anonymous. What we can do is tag the image as PD-unknown until further clarification of the author is made. But lets not delete it because there is no sufficient evidence that helps correspond deletion as well, there is no definitive consensus that the author is after 1938. •  Delete According to the USHMM, it's from 1943 and is rights managed by "DIZ Muenchen GMBH, Sueddeutscher Verlag Bilderdienst". Lupo 06:10, 17 June 2008 (UTC)[reply]
  • "Incorrectly tagged" is not really the point: per the European Union and Federal German and American law, this image is still copyrighted. Author ambiguity and other incorrectly tagged images sadly do not excuse this. Secondly, I can guarantee that this image is not from the 30s - the oak leaves and two pips on his collar indicate that he is an Obergruppenführer. Kaltenbrunner was not promoted to this rank until 1942. WilliamH (talk) 11:39, 18 June 2008 (UTC)[reply]

Deleted. Under copyright in Germany (source country) and in the EU. Lupo 14:12, 18 June 2008 (UTC)[reply]
