Files uploaded by User:Alexxxos

User:Alexxxos has uploaded a lot of images of Valparaíso. Some are obvious public domain, but the user claims to be the author. Files may need to be checked one by one, there are some that are post 1960 and I requested their deletion as copyright violations, but there may be more. --küñall (nütramyen) 15:39, 16 May 2014 (UTC)[reply]

 Keep. If they're in public domain, then they just simply need to be fixed. Also, küñall please review every file before tag it like this. For example, File:La Cuestión Económica - Folleto de Actualidad - por Agustín Ross - Valparaíso, Octubre de 1885.pdf has the right license tag, so it is evident that you are not checking all the files. Ralgis, I made a preemptive nomination for deletion of all of his files. I have checked some and they are indeed not copyvios, but it is Alexxxos' job to point out which are not copyvios. He uploaded the 1189 pictures and should also correct their copyright information when it is incorrect. Commons' policy is very strict in copyright issues, that's why I took this preemptive step. küñall (nütramyen) 16:58, 17 May 2014 (UTC)[reply]
 Keep The most images (if not all of them) are on public domain, including the old pictures, that as the user Ralgis said, just need to be fixed, and other files were made by me, and i've uploaded them to Commons, so obviously are my own work and they don't need any special permission to be used in Commons.--Alexxxos (talk) 21:07, 17 May 2014 (UTC)[reply]
 Comment @küñall: I don't think this is useful. There may be some problem with some files, but nominating all files uploaded by a user is a bit abusive. Yann, I'll respond here your message on my talk page (which is the same posted here). I will remove from this nomination some of this user's obvious own work. However, all old pictures (which I agree, and have always agreed) that are public domain but do not provide correct copyright information will remain nominated until the user puts correct information on them (or at least asserts that there is no known author. Since they are so old, that would still be valid, but he has to take the step forward, not me). küñall (nütramyen) 01:21, 18 May 2014 (UTC)[reply]
@küñall: Even assuming that all old images are not good, which is certainly not the case (there is no doubt that File:Submarino diseñado y construido por karl flach en valparaíso en 1866..jpg is in the public domain and useful), nominating recent images and old ones with the same rationale is inappropriate. Additional, you put the burden of the closing admin to sort out which ones are OK, and which ones are not. So unless you cleaning the list, I will close this as kept. @Alexxxos: Old images can be in the public domain under some precise conditions: the author really needs to be unknown, not just you don't know. You need to add as much information as possible, i.e. the date when it was published or created, the source of the images, and a proper license. For example, File:Vista General de Valparaíso.jpg is certainly not "own work", the date is wrong, and you are not the author. Could you please fix that?   •  Keep: Older or newer pictures, most of them applies FOP in Chile and therefore are in the Public Domain, according the Chilean copyright law 17336, regardless the "own work" text in the file description/licensing; therefore, Various of these files were deleted! Also, the (much valuable) files was uploaded various years ago and currently are in use in several pages, so not valid reason for opening a huge mass DR. The right solution is simply editing the description, not deleting the files obviously in Public Domain. I agree than this DR is a bit abuse of the patrolling rights. Taking a picture outside in the streets does not make the picture itself free of copyright. The person who took the pictures still retains the copyright of the picture, disregarding the copyright status of the items depicted. Some of the photos were deleted because they were obviously not taken by the uploader and are not so old to be in the public domain. Besides most of the so called public domain pictures of the user have no clear source to check if they are truly copyright free, because inheriting copyright of works is something protected by law in Chile, so even though they may be over 100 years, they may still be copyrighted here, and so they cannot be on Commons. Recent pictures taken by the user are not to be considered for deletion, even though I nominated them. I said that above. There's no abuse of patrolling rights whatsoever here, because I have not used any other right than anybody can use to nominate files for deletion. --küñall (nütramyen) 05:06, 19 May 2014 (UTC)[reply]
