- Keep These works are undisputably covered under Indian Copyright Law. See for eg. File:Annaflag03.jpg and the licence text "For these and/or other purposes and motivations, and without any expectation of additional consideration or compensation, the person associating CC0 with a Work (the "Affirmer"), to the extent that he or she is an owner of Copyright and Related Rights in the Work, voluntarily elects to apply CC0 to the Work and publicly distribute the Work under its terms, with knowledge of his or her Copyright and Related Rights in the Work and the meaning and intended legal effect of CC0 on those rights". My PD1.0 licence corresponds exactly to the letter and spirit of this Licence text.
- However, for any legally sound CC-BY-SA licence or PDR valid under Indian Copyright law, you should be really asking for all of the following permissions a) Permission from author b) Permission from copyright holder/s c) Permission/release/consent from all personality rights covered persons and/or as applicable d) A copy of the gazette notification issued under section 21 of Copyright Act 1957, etc.; ie if the Work is not copyrightable or excluded etc. Indiaresists (talk) 08:44, 2 January 2015 (UTC)
- The issue is not the license, but the permission. This is needed for every recent picture uploaded to Commons by other people than the photographer or the copyright owner, or if the picture was published elsewhere before. - Red herring. Please read the text of the licence which I have extracted and emphasised. I have fully complied and the PD-1.0 dedication is in terms of the subsequent text of that licence with liability on the reusers. Such images from the official website/s of the organisation, of which Mr. Malik is the Chairman, which also contains a relevant board resolution of the meeting chaired by Veeresh Malik leaves no doubt that this image is usable here under a PD-1.0, in the same way you are uploading images for Ekta Parishad.
- My impugned images are uploaded considering the amended Copyright Act w.e.f 8 June 2012. Whereas for eg. your earlier OTRS ticket #2010090510001865 can you link to any gazette notification under section 21 for images owned by Ekta Parishad who are unquestionably the legal copyright owners of your uploaded photographic works ? Request: This discussion is solely about applicable copyright law/s, so lets stick to that Vasudhaiva Kutumbakam Indiaresists (talk) 10:42, 2 January 2015 (UTC)

@Yann, update, per COM:REUSE I have contacted the IAC website owners. They inform me they are in receipt of an email sent to OTRS "permissions" on 01 January 2015 from Mr. Kejriwal's erstwhile IAC office covering these kind of images on Wikimedia generated during IAC campaign between "2010 till 25 November 2012" by various authors / uploaders. Because 6 of these 7 images contain Mr.Hazare's image, and because IAC veteran Mr.Hazare has publicly requested Mr.Kejirwal's team to stop using his likeness wef Sept 2012, if you give the OTRS ticket number of their email I shall move the courtesy speedy delete request for all these kind of controversial images of Mr. Hazare, without us going into copyright law/s. - OK, thanks for that. Hopefully it will be OK. I think you can add a {{OTRS pending}} template to each image description. However you confuse several things: COM:REUSE isn't the issue here. UPDATE Delete This diff refers to the lengthy email to OTRS concerning permissions to use media + content sent from "IAC Secretariat". Although I certainly have rights in these 7 images previously published on IAC's websites and with clear copyright waiver notices permitting republication by the public, in view of the aforesaid email sent to OTRS the copy of which is now with me also, I am requesting Commons community that all these images specified by Yann be DELETED as a courtesy to the personalities depicted and with a request that an OTRS ticket number for this email be generated for future reference. - Yeah, it is a long-winded email (ticket:2015010110001298), that doesn't answer the simple question: did the photographer license the photo? The reason I didn't link the ticket straightaway is because I am trying to work out whether it needs a response or referral to another email address. There was no mention of the images listed above. As far as I can understand it, this is all a continuation of shenanigans taking place at English Wikipedia, which are being ably handled by users like Sitush. The files noted above should be deleted due to uncertain provenance and Indiaresists, despite their turn-around in this discussion, should be blocked as a part of the India Against Corruption sock/meatfarm, other accounts relating to which have already been blocked here on Commons. They're playing good hand/bad hand on this occasion but all the signs are that this account is yet another that is being operated by a single person. - Sitush (talk) 12:15, 5 January 2015 (UTC)
- The email is verifiably from the email account publicly used by Mr. Arvind Kejriwal's IAC campaign for their official press releases and public notices in 2012. Because I had noticed a copy of the Kejriwal team's email was also sent to legal@wikimedia.org and as 6 of these 7 images are also covered by their email, I have altered my decision here as a courtesy to all participants in IAC and to safeguard the Commons. - Delete. The email I've read at OTRS mentions only the Shamim Arvind file but there is no mention of the files listed here. If there is a second different email to Legal, it does not concern us until and unless a legal adviser chimes in here. Green Giant (talk) 15:33, 5 January 2015 (UTC)
- Some extracts from the OTRS email CC'ed to legal, "Hence, in the interim, we proforma DENY permission to Wikipedia to use or licence this image or its variants and adaptations, or any other media or works related to IAC campaigns created anytime between 2010 and 26 November 2012.", ... "2. That no media or content relating to public personalities, past or present or future, of India Against Corruption movement or IAC Jan Lokpal Bill movement be used / licenced if objected to by these movements from email ID ....". - Delete No evidence of credible permission from the photographer and the urls from which the images were sourced do not display compatible licenses. The issue is very simple. The ideological and pseudo-legal waffle emanating from the latest IAC sock can be disregarded as entirely irrelevant to this case. WMF legal are well acquainted with these people. As Sitush says, "they" are highly likely to be a single person. They have been attempting unsuccessfully to have legitimately licensed images removed which do not support their version of history using various spurious arguments in the past, including "forgery", "copyright violation" (of images to which they clearly do not own the copyright and despite the fact that they simultaneously claim that the images are forgeries), and most recently "personality rights". - The problem with telling fibs is that you have to keep track of them. IAC have told lots and they have gotten themselves into a convoluted mess of self-contradiction. There is, however, something that the IAC people cannot hide. I'm not prepared to say what it is here in public but any admin is welcome to email me. Keep OTRS pending. Author had licenced these works for public in 2012 and has confirmed the same and sent his registered letter to your copyright agent in San Francisco USA. Piplilive2020 (talk) 13:02, 7 January 2015 (UTC)
