Files uploaded by Dvornicsek

[edit]

The uploader has provided seemingly contradictory statements regarding the source, authorship and copyright status of several uploads and claims to be the author of photos taken taken with a range of different cameras which are swapped out in a rather unlikely way over time.

  • For File:PLATONOV 1.JPG, the source is stated as "Own work by uploader", while the author is stated to be "Victoria Wallace" (changed from initially stating Dvornicsek as the author). Dvornicsek claims to be the copyright holder.
  • For File:Three.sisters 007.jpg (taken with a Canon PowerShot A75 on 29 August 2007), the source is stated as "Own work by uploader", while the author is stated to be "Lorenzo Savoini" (changed from initially stating Dvornicsek as the author). Dvornicsek claims to be the copyright holder.
  • For File:Three.sisters 008.jpg (taken with a Canon PowerShot A75 on 29 August 2007), the source is stated as "Own work by uploader", while the author is stated to be "Lorenzo Savoini" (changed from initially stating Dvornicsek as the author). Dvornicsek claims to be the copyright holder.
  • For File:The Wild Duck.2.JPG (taken with a Fujifilm FinePixS2Pro on 18 July 2005), the source is stated as "Own work by uploader", while the author is stated to be "Guntar Kravis". Dvornicsek claims to be the copyright holder.
  • For File:TheWildDuck4.JPG (taken with a Fujifilm FinePixS2Pro on 18 July 2005), the source is stated as "Own work by uploader", while the author is stated to be "Guntar Kravis" (changed from initially stating Dvornicsek as the author). Dvornicsek claims to be the copyright holder. (otrs:2009082510036278 received; unconfirmed)
  • For File:Vanya.1.JPG, the source is stated as "Own work by uploader", while the author is stated as "Michael Levine" (changed from initially stating Dvornicsek as the author). Dvornicsek claims to be the copyright holder. otrs:3571431

Hi LX. The uploader is a new editor so hopefully we can get this all straightened out and give her the information she needs to not make any mistakes in the future. Am I reading it correctly that you only dispute the first 11 images uploaded or are you concerned bout all of them? I have requested that Dvornicsek not edit the subject's Wikipeida page due to a conflict of interest so I am under the impression that she has access to some images that would not be expected. If she did not take any of the above images I assume it is a learning curve error (I should have made it more clear) and she'll not put up any fight on the removal. If she did take the image I hope we can figure out the discrepancy.Cptnono (talk) 01:57, 25 August 2009 (UTC)[reply]
Thanks for your participation in this matter! To directly address your question, with the information currently at hand, I am concerned about all the images. Here's why:
For the first group of photos listed above, the user claims that they are the "uploader's own work", meaning the photographs were supposedly created by the Dvornicsek. At the same time, the authors of the photos are claimed to be Guntar Kravis, Victoria Wallace and Michael Levine. Unless Guntar Kravis, Lorenzo Savoini, Victoria Wallace, Michael Levine and Dvornicsek are the same person (and presumably they're not), at least one statement provided by the uploader is patently false. Dvornicsek also claims to be the copyright holder of works created by these other authors, which is improbable enough that it requires some explanation. (Were the photos created as works for hire? Did the authors sign a declaration to reassign copyright?)
The information provided for the second group of photos listed above is more consistent, but still not credible. Firstly, it seems odd, for example, that Dvornicsek would be the author of File:Wildduck1.JPG, File:Wildduck3.JPG and File:Wildduck5.JPG while Guntar Kravis is the author of File:The Wild Duck.2.JPG and File:TheWildDuck4.JPG, especially given that they were taken on the same day with the same camera. Secondly, the erratic progression of cameras (Olympus compact zoom, Canon professional DSLR, Canon entry-level DSLR, Fuji professional DSLR, Minolta compact zoom, Canon point and shoot, in that order) indicates that the photos were not taken by a single person. A person might change cameras over the course of 4½ years, but I don't know anyone who would make those changes in that order.
The truthfulness of the information provided for the third group of photos listed above is questionable for the simple reason that the information provided by the uploader for the first two groups is, as I have demonstrated, probably false. In the second group, the uploader's claims were consistent but contradicted by the metadata. In this group, there is no metadata to contradict the uploader's claims, but when seen in context, that hardly makes the claims more credible. Also, the naming of some of these files indicate that they are taken from the same series as photos from the first two groups. LX (talk, contribs) 18:36, 25 August 2009 (UTC)[reply]
She told me that some were not hers and some were. I'll give her a quick reminder so she can say which ones are hers and we can go from there. I don't know if it was a case of assuming she had permission since they were used in a book she wrote or id she assumed that it would be easy enough to game the system. We don't need that many anyways so hopefully the ones she did take are easy enough to identify.24.17.194.115 21:24, 26 August 2009 (UTC)[reply]
I stroke out a few files for which a valid OTRS permission was received, and noted the few others for which permission was received but is still unconfirmed. As for the rest of the files, it is still unclear which ones are really own work and which ones are not. Absent a clear statement from Dvornicsek I think we should  delete all the files that don't have an OTRS ticket. –Tryphon 11:33, 5 September 2009 (UTC)[reply]

Deleted, except those with OTRS permission, per LX. Kameraad Pjotr 19:05, 6 January 2010 (UTC)[reply]
