[edit]Photos are NOT currently public domain in either Russia or the US. The photo was published with a clear attribution to P. Otsup (Pyotr Otsup, [1883 – 1963]) in Журнал «Огонёк» №2 от 1940 год. Will not be public domain until 2038 (74 PMA). Frankly I'm surprised this photo was able to become a featured photo despite the clear lack of publication information previously available until I found the 1940 magazine that showed authorship status incompatible with PD status. I hope our filtering process for featured photos is now more rigorous.

- Isn't this fair use in the US because it was published before 1925. Everything published before 1925 is in the public domain in the US irregardless of when the author time of death. Also nobody cared before this, why did you do this, it's used on so many pages. Vallee01 (talk) 15:26, 23 November 2020 (UTC)
- @Vallee01: A couple of things:
- When you say "fair use", I think you mean copyright free. Fair use images are not allowed on Commons.
- It looks like you're trying to apply {{PD-US-expired}}, but the 1925 cutoff only applies to images created in the U.S. or images that are already in public domain in the country of origin. Per COM:Russia, all works created before 1917 are copyright free. All others are copyright until 70 years after the death of the photographer. Ytoyoda (talk) 18:33, 24 November 2020 (UTC)
- Not just created before 1917 - must be PUBLISHED before 1917 in order for that to apply. Because this is not a US work, we have to wait until it is PD-Russia-expired. Either way, PDRusEmpire cant apply because they could not possibly have been published before it was created in 1919.--PlanespotterA320 (talk) 23:00, 24 November 2020 (UTC)

Deleted: per nomination and discussion. Fair use is not appliccable on Commons, and according Commons:Copyright_rules_by_territory/Russia the copyright of the photographer will expire 74 years after his death. Elly (talk) 17:29, 26 July 2021 (UTC)
