Why it is clear it was "not intended"?

 Weak keep Nickelodeon is a professional broadcaster. I don’t buy the argument they “accidentally” uploaded dozens of videos under a CC‑By license. No, this was intentional. See the discussions I linked. We shouldn't rely on "gotcha" licensing and given the way these IPs are likely structured, it's not clear that this channel would actually have the legal authorization to release content under a CC license. Elli (talk) 16:00, 8 November 2024 (UTC)[reply]
We shouldn't rely on "gotcha" licensing - seconding this. Per the precautionary principle, if there's substantial doubt over whether the owner of media intended to release it under a free license, or whether that license is valid, we should err on the side of caution and not host it. After reading w:Wikipedia:Requests for comment/Spongebob Squarepants is now freely licensed! I believe we're missing a point: Wikimedia Commons does not say (can't either say) if Spongebob is Public Domain. What we have are some clips from official sites which are properly licensed under a Creative Commons. So, NO, Spongebob is not in Public Domain, and even if it was, the trademark of the character would be registered (so, {{trademarked}}). But Wikimedia Commons is not saying (never did) Spongebob Squarepants or Mickey Mouse are now PD or CC-BY, it says some clips of the series are under free licenses. That means people can use those files as any CC-BY-SA file, but DOES NOT ALLOW THEM TO USE THE TRADEMARK, which is property of Nickelodeon and has not be released under any free license.
