No CC-Zero indication on Nederlands Instituut voor Militaire Historie.

Hi A1Cafel, the files meet the "GENERAL TERMS AND CONDITIONS FOR THE USE OF (AUDIO-)VISUAL MATERIAL ADMINISTERED BY THE NETHERLANDS INSTITUTE OF MILITARY HISTORY (NIMH)" as stated here: https://nimh-beeldbank.defensie.nl/gebruiksvoorwaarden. I see that other files from NIMH have the CC-BY-SA-4.0 licence, I assume that would be the correct licence for all other files from this source? I doubt however that the category "Media donated by Nederlands Instituut voor Militaire Historie" is correct, as it is not "donated". Poppo154 (talk) 07:29, 30 March 2020 (UTC)[reply]

 Delete There is no explicit license at the cited page. To be sure, there is an implicit license, but there are two conditions that probably make it too restrictive for Commons:

It is forbidden to use the material in manners contradictory to public order or common decency.
It is forbidden to distributre the material to third-parties without enforcement of these general terms and conditions. In case of distribution, one is responsible for upholding the terms and conditions.

The second of these requires that these conditions be enforced with respect to third parties. Commons has no interest in enforcement and no ability to do so. Therefore I think we cannot keep these. .     Jim . . . (Jameslwoodward) (talk to me) 21:14, 14 May 2020 (UTC)[reply]

 Keep The implicit license meant above, and at the website of the Dutch Ministry of Defence is CC-BY-(SA)-4.0, indicated by the MoD under Conditions of Use #1, as follows: The NIMH highly appreciates the following citation as form of acknowledgement when (audio-)visual material is reproduced or used: "Collection Netherlands Institute of Military History". Condition #2 is not compulsory, condition #3 (if copyright from 3rd parties) is met by not taking these pictures in; condition #4 is judgemental. Condition #5 is met by license CC-BY-SA-4.0. However, these files should only be kept under two conditions, (1) Change of license from CC-0 to CC-BY-(SA)-4.0.
