Author is Дмитрий Павлович Бухарцев (at the end of the post). Shot in 1937. Rehabilitated in 1960 [1], [2], [3]. According to the Russian law (p. 4), the period is calculated after the rehabilitated. 70 years have not yet passed.— Redboston 05:40, 29 January 2022 (UTC)
- I would like to mention, that it is (according to Russian law) - legally published service work ("легально обнародованное служебное произведение") p. 4 st. 1295 - free using of this kind of works (including citation from newspaper and journal) is legal according to pp.1 p.1 st. 1274. - According to st. 6 of law 231-fz (implementation of part 4 of Civil Codex), period of 70 years applies to the object, created before 01.01.2006 only in cases if 50 years from the moment of death have not passed (have not passed to the moment: 01.01.1993 - please see text on the link above). If author was shot in 1937, 50 years have ended in 1987. As I can see, law 231-fz has no special options for prolonging in cases of rehabelitation (law nowadays does, but it applies only to object created only after embedding - st.5 of 231-fz). - Since the file was nominated for deletion on the basis of court decisions (and not on the text of the law itself), would you be so kind to provide specific details (examples) of such court decisions (court desicions, that has extended the period especially for persons, that had been repressed, and where period was calculated since the rehabilitation date, and non since the death date)?
