This file was initially tagged by PlanespotterA320 as Speedy (SD) and the most recent rationale was: Credited to Ozersky in Журнал «Фронтовая иллюстрация» № 12, 1942 г.. Converting to DR: previously restored by user request. —‍Mdaniels5757 (talk • contribs) 17:06, 5 February 2023 (UTC)[reply]

@PlanespotterA320: could you please explain what you said in [2] not apply? —‍Mdaniels5757 (talk • contribs) 17:07, 5 February 2023 (UTC)[reply]
  • Ozersky Israel Abramovich staff member of TASS, according to the current legislation, military images of TASS 1941-1945 in the public domain. The current template is misleading, there must be a different license--Трифонов Андрей (talk) 18:44, 5 February 2023 (UTC)[reply]
If its existence in https://commons.wikimedia.org/ is deemed impossible, upload it to ru.wiki under license {{PD-Russia-1996}} Трифонов Андрей (talk) 19:07, 5 February 2023 (UTC)[reply]
I mistakenly beleived that the author (Ozersky) did not become known as the author until the 21st century (meaning it would have expired 50 years after the 1942 publication). But I saw in the front illustrated magazine that Ozersky was credited, meaning that it will not be PD until 74 years after Ozersky died (2046). I am not aware of any Russian statute that says TASS photos are public domain, there is no release statement of any kind on the TASS website. So this work need to go, sadly. Photos are NOT informational messages, and so they are not exempt under current legislation.--PlanespotterA320 (talk) 19:58, 5 February 2023 (UTC)[reply]
The statute you posted only refers to INFORMATIONAL MESSAGES, NOT photos. So don't insult me, I understood what you said - that doesn't mean it was relevant here. I will write in English here because this is Commons and most admins here speak English. I reiterate, I have asked you to provide a statute or release statement that says that Tass PHOTOS published with credit authors to authors who died less than 70 years ago are public domain. You have yet to demonstrate a rule that tass PHOTOS (not informational statements) are exempt from the 70 pma rule. Also, my indef block on ruwiki has NOTHING to do with copyright issues, but the use of the word "chauvanist" to describe colleagues who made some very nasty statements. I am permitted to edit on Commons and continue my research trying to find public domain photos (and sometimes I find out that a photo thought to be public domain actually isn't). Frankly Russian editors like you should be grateful I have dedicated so many hours to looking for PD-Russia photos for Commons and setting up so many Russian photos to be undeleted in their year of copyright expiration, especially considering how many orphaned works Russia has. Show me a little respect, I am trying my best here!--PlanespotterA320 (talk) 13:28, 6 February 2023 (UTC)[reply]

Kept: Per Commons:Copyright rules by territory/Russia photos are in PD when “The work is an information report (including photo report), which was created by an employee of TASS, ROSTA, or KarelfinTAG as part of that person’s official duties between July 10, 1925 and January 1, 1953, provided that it was first released in the stated period or was not released until August 3, 1993.” It is not disputed that Ozersky Israel Abramovich was a staff member/employee of TASS on the moment he made the photo. The photo was first published in 1942, so in the mentioned period. Concluding, based on our guideline text of Commons:Copyright rules by territory/Russia, the image Is in PD and can be maintained on Commons. --Ellywa (talk) 13:47, 18 August 2023 (UTC)[reply]
