Two-dimensional artwork is not covered by FOP in New Zealand. That said, this obviously has a small third dimension to it. I shall leave it to others to decide whether that makes it three-dimensional art (which is covered by FOP). Schwede66 02:12, 15 July 2021 (UTC)[reply]

A snapshot of a public art installation, in its context, breaches copyright? Seems excessive. How would that differ from, say, this photo of commercial logos which are themselves covered by copyright and trademark? Somej (talk) 20:40, 15 July 2021 (UTC)[reply]

  • Don't delete - Given the fact that this mural has a three dimensional element, I would consider this a sculptural mural rather than a painting on clay tiles and therefore is covered under the copyright exception of clause 73 of the New Zealand Copyright Act. Hi - thanks for your comments re: the photo of the public mural at the Dunedin Hospital, for which I am the photographer. I believe the work is exempt under NZ copyright law Section 73: Representation of certain artistic works on public display. This section applies to the following works: (b) works (being sculptures, models for buildings, or works of artistic craftsmanship) that are permanently situated in a public place or in premises open to the public. and (2) Copyright in a work to which this section applies is not infringed by— (c) communicating to the public a visual image of the work. Note that there's a keep comment on the talk page from the person who would probably be one of the most knowledgeable people in New Zealand in this area (she works in copyright for her job).
