Buildings and structures uploaded by David Wadie Fisher-Freberg (2)

[edit]

Continuing from the previous DR: why leave out these files? Are you guys thinking that I couldn't possibly got sued under Indonesian law because of these? Please delete. --dwf² 05:05, 18 March 2021 (UTC)[reply]

  •  Keep I closed the previous DR. These have no FOP problems. For example, how can File:Simpang Haru railway station.JPG be a matter of concern? My understanding is that the nominator is angry with the FOP rule and is trying to get "all" of his files deleted to illustrate a point. He himself confesses in Commons:Deletion requests/Files in Category:An-Nur Great Mosque that nobody cares about FOP in Indonesia, but he constantly says that he is afraid of being sued! This is gaming the system. 4nn1l2 (talk) 05:17, 18 March 2021 (UTC)[reply]
    • Well, no, nothing like that. I have offered an alternative interpretation of FoP rule in Indonesia (which says that FoP is OK), but was rejected by the community. So the status quo interpretation, which says FoP is not okay, stands. Maybe nobody cares about FoP in Indonesia, but obviously Commons editors do, which is why you approved my first DR. By standing with the status quo interpretation, Commons has put itself in the position in which the continued existence majority of my files (not all, as you claimed) would run contrary to it; therefore, a violation of the Indonesian copyright law (a consensus reached by Commons editors but I do not personally agree with, nor I believe would be enforceable by any Indonesian court worth their salt), which would open myself as contributor to the possibility of lawsuit (again, according to Commons consensus but not me personally). The community put themselves in this position, so now please have at least the decency to enforce it. Thanks. dwf² 05:25, 18 March 2021 (UTC)[reply]
  •  Comment About @4nn1l2: 's example on stations, due to Commons:Deletion requests/File:Telkom Indonesia.svg, I'm not sure if the old PT Kereta Api logo can really be CC BY-SA licensed, in short: Are there informations about Indonesian TOO situations? --Liuxinyu970226 (talk) 08:14, 18 March 2021 (UTC)[reply]
That KEREPTA API logo is covered by COM:DM. It can be blurred without any damage to the whole picture. 4nn1l2 (talk) 08:19, 18 March 2021 (UTC)[reply]
KAI is a State-Owned Enterprise. Under Art 43 (b) of UUHC it should be PD-IDGov. However, there has been a precedent here to reject works done by branches of the Indonesian government. I think that KAI should be regarded as part of the Indonesian government, but Green Giant said it's not last time---maybe they has a better understanding of Indonesian constitutional system? dwf² 08:24, 18 March 2021 (UTC)[reply]
Also per this request by RaFaDa20631, all Indonesian logos should be problematic, because there has been real-life precedent of lawsuit involving it. dwf² 08:31, 18 March 2021 (UTC)[reply]
@David Wadie Fisher-Freberg: Before 2014 Indonesian Copyright Act has been enacted, it was possible to register all logos - even it is "simple design" - to Directorate General of IP via pdki-indonesia.dgip.go.id. Kereta Api Indonesia 2011 logo, which initially a non-free logo, is now PD-USonly because it resembles Amtrak logo according to people at Kaskus and Semboyan35.com. It was registered as copyright C00201203049 on 22 June 2012. However, all logos registered after the enaction are always rejected by DGIP, without any ToO testing. According to Art. 1 (which may be a hint to a ToO concept), all works eligible to copyright must be unique (khas dan pribadi) to be protected. RaFaDa20631 (talk) 09:33, 18 March 2021 (UTC)[reply]
Add: The logo itself was uploaded by Emirmonti (talk · contribs). He is an employee at the KAI headquarters in Bandung. RaFaDa20631 (talk) 09:36, 18 March 2021 (UTC)[reply]

@Liuxinyu970226: @4nn1l2: would there be a consensus to resolve this DR? Thank you. dwf² 21:23, 25 April 2021 (UTC)[reply]
