These are all sound recordings published after 1922. As far as I can tell based on Commons:Hirtle chart#Sound recordings, this means that they're not public domain in the US. Just as a note, these files all originate from Argentina and are in the public domain there. —CalendulaAsteraceae (talk • contribs) 04:32, 1 May 2023 (UTC)
- Lamentably, Delete. Make sure we add each of these to the category for the year when it may be undeleted, though. - Jmabel ! talk 17:17, 1 May 2023 (UTC)

- @CalendulaAsteraceae: I guess no harm in adding to cats before these (inevitably) get deleted. Since these will mostly each be a different year, we can't just categorize this discussion, and we need to add the individual images to the list on the respective category. In case you don't know, that can't be done by the usual mechanism for adding to a category, because there is no way to find deleted pages in a category, so they have to be added to the category page itself. But, sure, if you want to take on making those additions & indicate when you have done so, that will save a lot of work when this discussion is closed. - Jmabel ! talk 03:35, 2 May 2023 (UTC)

- Keep all. These files are out of copyright. Michalg95 (talk) 09:21, 8 May 2023 (UTC)
- @Michalg95: out of copyright on what basis, in the U.S.? Have you looked at the Hirtle chart for sound recordings? - Jmabel ! talk 15:04, 8 May 2023 (UTC)
- Please leave this open another 24 hours to give User:Michalg95 a chance to respond, but failing that I think we can consider this a "delete all". A simple assertion without rationale that these are PD carries no weight. - Jmabel ! talk 22:42, 8 May 2023 (UTC)
- Why it should be deleted when its public domain in Argentina? United States law is not global imperial law but just one of the laws. These recordings have obviously nothing to do with the United States. ThecentreCZ (talk) 15:52, 17 May 2023 (UTC)
- @ThecentreCZ: because our servers are in the U.S., we have to abide by U.S. copyright law as a matter of law; we abide by country-of-origin copyright law as a matter of courtesy. - Jmabel ! talk
- U.S. law can hardly be enforced when there is another jurisdiction in accordance with international copyright treaties and work is not anyhow subject to copyright protections by the U.S. law. On Commons are many copyright exceptions from copyright from many countries, where law of that country can put files to public domain even when it was created in 2022. The law then puts it into public domain, such as law on privately created files which depicts state symbols which are originally published by the government etc. This works for plenty of files on Commons located in the U.S., when U.S. law respects another law all right. Why then for example this file is completely fine File:Tchaikovsky Swan Lake Op.20 No.2.Waltz.ogg from copyright? While you nominate these for deletion?--ThecentreCZ (talk) 20:29, 17 May 2023 (UTC)
- @ThecentreCZ: As for the Tschaikovky, quite likely it isn't free in the U.S. Feel free to nominate it for deletion.
- For a lot of the rest of what you just wrote, I honestly cannot make out what you are saying. Our policy is that files must be either free-licensed or in the public domain, both in the country of origin and in the U.S. (If anything appears to be an "exception" to that, then probably it should be deleted and just hasn't been noticed.) Sometimes it is tricky to determine the relevant country of origin, but it is never tricky if it is copyrighted and unlicensed in the U.S. - Jmabel ! talk 23:05, 17 May 2023 (UTC)
Discussion linked on COM:AN. - Jmabel ! talk 23:18, 17 May 2023 (UTC)
- Keep all. I don't think that this is sufficent reason for deletion. If this request would be justified, that would mean that about 100 foreign countries public domain exception templates on Commons should be somehow replaced by U.S. copyright templates only. There is maybe hundred of thousands of these kind of files here on Commons, and also these files are here for more than 10 years. Thank you. --ThecentreCZ (talk) 23:50, 17 May 2023 (UTC)
- @Clindberg: I know you are a lot more knowledgeable on copyright law (and Commons copyright policy) than I, and ThecentreCZ and I clearly differ in our interpretation of this. I'd greatly appreciate if you would weigh in. - Jmabel ! talk 03:54, 18 May 2023 (UTC)
- Delete This is a pretty clear delete, and the issue was recently discussed at VP Copyright, with the same conclusion (the nomination might be a consequence of these discussions. NAs far as I see, none of the recordings were free in 1996, the URAA date for Argentina (if I am wrong please remove these from the nomination), and the US has 100 years for recordings. Yes, we delete everything which is still copyrighted in the US, if the URAA transferred the copyright to the US.--Ymblanter (talk) 13:52, 18 May 2023 (UTC)
I'm going to bite the bullet here and close this as delete all. I believe CalendulaAsteraceae has already marked them to be undeleted in the appropriate years. Ymblanter, another very experienced Commons user, seems to read the situation exactly the same way that the CalendulaAsteraceae and I do.
On copyright questions, it can't be a matter of "voting": it has to be a matter of making a clear case based on law and policy. — Preceding unsigned comment added by Jmabel (talk • contribs) , 00:19, 19 May 2023
