No FoP in Ukraine - modern monuments, plaques, memorials, sculptures, statues, etc

  • A horrible mess where nothing can actually be found. I don't know if anyone is really able to check all these 152 images, but on the first sight I have found at least one Russian (File:Meeting with Ukrainians in Karelia 59.JPG), one Moldovan (File:Tiraspol 16.jpg) and one Macedonian photo (File:Majka Tereza memorial house 10.jpg), possibly there are more as user seems to be travelling quite a lot. I have no idea how one can discuss a mix of so different images (as objects are even mixed across countries, with obviously different copyright laws in each of them), and it would be very unfortunate if they will be deleted just because someone nominated them without any adequate review. In my view, the only solution is to speedy close this discussion and nominate on a case by case basis, perhaps per sculpture or memorial depicted, in order to allow a reasonable review. 152 images from at least 4 countries is way too much for a single nomination — NickK (talk) 01:37, 11 October 2014 (UTC)[reply]

    • The list does not seem to be exhaustive. File:Aleksandr Shabalin ship 2.JPG is a stand about a Russian navy officer, and I have serious doubts such stand could have existed in Ukraine or any other country. Most likely there are more, but I can't check all 150 images as it's beyond human capacities and requires a bot or something simillar — NickK (talk) 01:48, 11 October 2014 (UTC)[reply]
    • I see no difference between Russia and Ukraine concerning FoP in this case. Unless one can point works of architecture, of urban development, and of garden and landscape design among those from Russia. However, those from Moldova seem to be suitable for {{FoP-Moldova}}, so I agree to remove them from this DR. Ankry (talk) 05:26, 11 October 2014 (UTC)[reply]
      File:Petrozavodsk 68.JPG is a work of architecture. Probably there are others.
      Another problem is that some of these sculptures might have been installed as early as in 1920s, but does anyone can really imagine that a human is able to check these 150 images that are presumably not covered by FOP, with no additional information (construction date, author) provided? I can consider this nomination as a certain I'll nominate everything that seems suspicious, anyway no one will check, so they will delete everythingNickK (talk) 12:02, 11 October 2014 (UTC)[reply]
  • Something has to be done with this nomination anyway. Looking through monument lists I have spotted File:Druzhne (Kalynivskyi) 6.jpg. Although it had no template (it was removed when this nomination was closed, which was later reverted by nominator), it was in fact a part of this nomination. However, this monument is {{PD-Ukraine}} as it was erected in 1950 (thus before 1951) by Kyiv Art Fund (Київський художній фонд, a special institution in charge of mass production of monuments for the whole region). As institutions do not have a date of death (although anyway it does not exist anymore) and such monuments have no individual author (even if they did they would have transfered it to Kyiv Art Fund as their employer), thus judging on publishing date of 1950 this monument is {{PD-Ukraine}}
    UPD: same for File:Kozyntsi (Lypovetskyi) 08.jpg, also installed in 1950 by the same art fund, same for File:Myrolyubivka (Pishchanskyi Raion) 16.JPG (installed in 1946 by the same art fund), probably others are in the same situation — NickK (talk) 14:09, 11 October 2014 (UTC)[reply]
  • Please note that this does not mean that I have checked all these files: I just looked through the lists and spotted this one. This shows that nominator checked neither locations (how one can mix Macedonia with Ukraine after reading descriptions) nor dates and authors (as at least one monument is in PD due to its age) — NickK (talk) 12:45, 11 October 2014 (UTC)[reply]


A bit strange that you are nominating these files as a FOP violation. Ukrainian law prohibits publication of photos of copyrighted three-dimensional works. Here we have photos of works, three-dimensional component of which is near the end to zero or trivial. For example microrelief of letters engraved on granite boards, or trivial forms of boards. For everybody who wants to delete my works please mention that many of this and previous nominations have mistakes. For example in previous nomination were pictures from Belarus. Here there are picures from Russia (for example Kosa Chushka), but written by nominator that it is Ukraine. Also there are some road signs, sculptures in the wall, governmenal works which are under free license. Please be attentive. The Flickr contributor might have created the lower half of the image, but not the upper half, as far as I can see; it is probably a scan of a magazine page or a leaflet. Very childish. It is OK if its artist is a child, but if the artist is an adult, then it will be extremely absurd to make childish drawings. Neither image shows any reason to believe own work of uploader. One is scanned or from television, the other so blurry and recopied as to be essentially useless. Probable COM:COPYVIOs.

The photo was commissioned by Ernest de Ganay, and the photographer is unknown! The fact that he owned glass plates (given to me from a person that hat obtained them from Ernest de Ganay) showes that he acquired the copyright too.

    • 17 U.S.C. §102 classifies "works of authorship" into eight classes, including "pictorial, graphic, and sculptural works" and "architectual works." 17 U.S.C. §101 states:

An "architectural work" is the design of a building as embodied in any tangible medium of expression, including a building, architectural plans, or drawings. The work includes the overall form as well as the arrangement and composition of spaces and elements in the design, but does not include individual standard features. ... "Pictorial, graphic, and sculptural works" include two-dimensional and three-dimensional works of fine, graphic, and applied art, photographs, prints and art reproductions, maps, globes, charts, diagrams, models, and technical drawings, including architectural plans. Such works shall include works of artistic craftsmanship insofar as their form but not their mechanical or utilitarian aspects are concerned; the design of a useful article, as defined in this section, shall be considered a pictorial, graphic, or sculptural work only if, and only to the extent that, such design incorporates pictorial, graphic, or sculptural features that can be identified separately from, and are capable of existing independently of, the utilitarian aspects of the article. ... A "useful article" is an article having an intrinsic utilitarian function that is not merely to portray the appearance of the article or to convey information. An article that is normally a part of a useful article is considered a "useful article".

The hat is a sculptural work (as is the hand that is also pictured). It is not a useful article because it does not have "an intrinsic utilitarian function that is not merely to portray the appearance of the article or to convey information." Additionally, even if the hat were a useful article, the arrangement of the stars and the crescent moon on the outside is separable from any utilitarian aspects of the hat.
My opinion is that because the hat is a sculptural work, 17 U.S.C. §120(a) (taking pictures of an architectural work from a public is not prohibited by a copyright in the architectural work) does not apply, even if it is also an architectural work. But the hat is not an architectural work. 37 C.F.R. 202.11 clarifies that

The term building means humanly habitable structures that are intended to be both permanent and stationary, such as houses and office buildings, and other permanent and stationary structures designed for human occupancy, including but not limited to churches, museums, gazebos, and garden pavilions.

ADDENDUM It may be helpful to compare other structures at Walt Disney World:
The Cinderella Castle is designed to be occupied by humans. It has no creative elements that are separated from utilitarian elements of the building.
Spaceship Earth is occupied by humans, so it is a building. Moreover, it is a geometric structure, so it is doubtful whether it has sufficient creativity to be copyrighted.

Deleted: The hat itself is clearly a building -- in fact its function is very similar to that of a gazebo or a pavilion, both of which are specifically mentioned by the USCO -- it keeps off the rain. You can think of it as a fancy roof. So the hat is covered by US FOP. However, prominent in this image we have the hand, a variety of things under the hat, and the donut behind it, all of which are sculpture and are not covered by FOP. .     Jim . . . . Reopened per discussion on my talk page. I have deleted my reference to the spiral behind the building, as it appears to be part of the support of the hat -- the roof of the building. However, the hand in particular and the various objects under the hat qualify as sculpture and are not de minimis.

Note, by the way, that RJaguar3's comments about Cinderella's Castle and Epcot Spaceship Earth are incorrect -- they both are completely eligible for copyright -- all architecture in the USA has a copyright after its creation. .     Jim . . . . No indication that this image from the 1970s was really taken by uploader who claims own work. User's other uploads included a COM:COPYVIO certificate and another image cribbed from a 2009 report. I have original photo with the embedded information like camara-model, aperture, exposure time etc. It seems, that islam-muenchen.de uses my photo without the neccessary reference. I understand if these need to be moved to English Wikipedia to be used under the fair use policy. However, I do not know how to transfer them. Are the two bike sculpture images appropriate for Commons? The work of art is stacked bikes on a pole. They are used for regularly occurring events and, then re-stacked around the pole. Read People's Bike Library of Portland for more info. Natomiast obowiązkiem osoby zamieszczającej zdjęcia na określonej licencji jest upewnienie się, że dysponuje odpowiednimi prawami, aby to uczynić. Ponieważ serwis Wikimedia Commons bazuje na prawie USA, gdzie w większości przypadków czas ochrony prawnoautorskiej biegnie od chwili publikacji zdjęcia, trzeba wskazać czas i miejsce jego pierwszej publikacji lub uzyskać pisemną zgodę na publikację od posiadacza praw autorskich.
