Keep Die Aufnahme wurde in Einklang mit den Grundsätzen der in Deutschland geltenden Panoramfreiheit erstellt. Die Aufnahme erfolgte vor dem Burgtor, durch den Torbau der Burg Heimhof hindurch, zu dem ein dauerhaft öffentlich zugänglicher Weg (Burggasse) hinführt. Es wurden weder Zäune noch Türen, Tore oder sonstige Einfriedungen durchschritten (deutlich bessere Aufnahmen wären durch Durchschreiten des Burgtores möglich, was sich vielleicht beim Betrachten des Bildes erschließt). Die Aufnahme wurde durch unbefugtes Eindringen in unsere Privatsphäre erstellt. Da Sie durch das geschlossene Tor aus der Froschperspektive unten durch den Torflügel hindurch fotografiert haben, sind Sie in unseren privaten Bereich eingedrungen. Die Rechtsprechung sieht das bereits als Hausfriedensbruch. Ein deutlicher Hinweis "Betreten verboten" ist deutlich an der Außenseite des Toreingangs angebracht. Unser Privatgrund beginnt bereits einige Meter vor dem Tor. Das sieht die Polizei und die Staatsanwaltschaft übrigens ebenso wie unser Anwalt. Sie werden aufgefordert die unzulässige Aufnahme zu entfernen und Ihre Identität offen zu legen. Es darf darauf hingewiesen warden, dass außerdem das Kennzeichen meines PKW ersichtlich ist. Dies stellt einen weiteren Verstoß gegen unsere Rechte dar. Wir werden den Fall weiter verfolgen und bis zur Löschung der Aufnahme weiter gegen Sie vorgehen. gez. Die Eigentümer der Burganlage.

According to the photographers panoramio page the author and source is of course not "unknown" and the file is copyrighted (http://www.panoramio.com/photo/46655284, All Rights Reserved). This file was initially tagged by Anupmehra as Copyvio (copyvio) and the most recent rationale was: Picture is uploaded by the subject itself. Subject says, he took his image himself from his mobile phone. It definitely is a plain lie and violates copyright (see his hands in the image). Krd 14:37, 26 July 2014 (UTC)
- Yes, his both hands as clearly visible in the image. It may be possible that the image was taken by his some companion from his mobile camera phone. But again, the man in picture does not own the copyright but the one who clicked it.
- It is now not a candidate of speedy deletion because it is presumed that one who uploaded the picture is not the same person in the image? Well, the other information section says, earthan kundan nath yadav kundan nath yadav- founder person of earthan a web place to spread humanity and peace for all. The man in picture is named, "Kundannathyadav" and uploader username is "Earthan kundan".
- Another rationale beside copyvio, may be, delete it because the "image is out of the project aspect" and "not realistically useful for an educational purpose". - David Horvitz has for years disrupted the English Wikipedia and the Wikimedia Commons by uploading photos in which at least part of his body was visible (in this case his hand) or in other cases where it was his full body in frame when intended to to be used on the subject of the photo other than himself, usually a location. In this case, his hand is intentionally in frame because it is his goal to have his photos and himself on this website so his body is freely distributed as it was when he made a crap self portrait of himself feigning crying which was then used on every single website on depression. We don't need his work on the Commons, particularly when because of his sockpuppetry we canot even be sure that this is the original photographer who is David Horvitz (not that I think taking a photo of this plaque and having his hand in frame at the same time is possible). Since the publisher is of Hungarian nationality, Hungarian copyright applies, per the Berne convention rules about country of origin. Per article 32 of Copyright Act LXXVI/1999 (see Commons:Copyright_rules_by_territory#Hungary) when a work is first published more than 70 years after creation, economic rights pass to the person who publishes the work. The publisher placed it under a free license. This clearly isn't the own work of Albert.montrouge, it's a portrait by the Government of Canada, as can be seen here. - The habit of link provided to dead link is a common way used by some people to incorporate material into Commons which really has no source. I don't see why this image should be treated differently than the dozens of images that are removed daily for claiming to come from a source which does not exist - or on which the image is not found. There can't be two sets of rules here, it's a recent upload with a description which implies a source which does not exist. It was uploaded July 23, 2014 and the link was dead at that time, the obvious assumption is that the uploader did not provide a functional source and the image is candidate to delete. The one you linked to on the California website is larger than this image. If you'd care to upload a new version giving the California website as source, I'll happily withdraw this nomination. So that's why it should receive protection under the deleted link argument. - The source you provided is to the "Heraldry and Insignia of the California State Military Forces -- 223rd Military Intelligence Battalion", the license on the image claims it's from the U.S. Army Heraldry site. - Comment: This is is not a organization logo, is a JPEG version of the Coat of arms of General Pueyrredon Partido, very similar to the Coat of arms of Mar del Plata (because General Pueyrredon Partido is part of Mar del Plata.
