Two images are violation of CC-BY-SA 3.0 licence agreement. One image (Ngurah Rai Airport) is my own work uploaded with CC-BY-SA 3.0 licence at Panoramio under BxHxTxCx user name, and one image is a Tropenmuseum picture, all claimed as his own work. Two more images (both Mandala Tiger aircraft picture) are possibly copyright violation (illegally taken from Skyscrapercity forum) and 5 more is non-free logo.

After today identifying around 80 uploads as copyvio (grabbed from different Panoramio-/Flickr-accounts, planespotters.net, airliners.net, skyscrapercity.com, blogs etc., details at User talk:Baskoro F19) it´s difficult to believe that these remaining files would be own work: IMHO untrusted user (already blocked in 08.2013 for 1 week) uploading a bunch of copyrighted material (small/inconsistent resolutions, missing exif) so these ones (per COM:PRP) can't be believed either. Usually the uploader cropped the files to hide existing watermarks of the real photographers and/or removed the watermarks by photoshopping. All uploads mostly related to planes of Garuda Indonesia and other airlines in Asia.

 Keep If anything, the just-created claimed alternative is deficient (as well as being redunant) vs the nom'ed original...it has more whitespace between the images and the compound-numbers (useless use of screen real-estate) and the variable-substituent (R') on the aromatic ring is in a different position from 1 to 2. Chemists know this is just a variable (exactly where it's drawn doesn't imply anything about which ring position(s) are bonded), but it's an example of a visual change that non-scientists might think is chemically relevant rather than artist's choice rather than drawing "same thing the same way" (previous image has it opposite the O/vinyl side both times). The image is a near-duplicate to File:Proterorhinus marmoratus 8.jpg. I made two very similar shots and uploaded both to wikimedia commons. There are no reason to save them both. Nice find! That Flickr account looks a little suspicious to me, however. It has three photos, which look quite different to each other, and none of which have EXIF information. The photo of Fran Allo is a cropped version of a photo from Fran Allo's site. Can we assume that Flickr user Fotoartista is the copyright holder? gl:Ficheiro:Fran_Allo.jpg‎ may need to be discussed on glWiki, but I will leave that to a Galician speaker who is familiar with glWiki's policies. The image is sourced as being from the Florida Department of Agriculture, even though the image includes the Univeristy of Georgia's cataloging code, but there is no evidence that they have released this umage under the CC-by-SA-3.0 license. Additionally, the image lists bugwood.org as a source. Clicking their insect image resource, you get to http://www.insectimages.org/about/imageusage.cfm which sometimes allows free images, but there is no evidence of where this is from. Lastly, the orignal uploader included the line: "You may not use this work for commercial purposes unless permission is granted by the photographer or copyright owner." I want to know why this would be nominated for deletion. I took this picture myself and I am only uploading it to wikipedia for the purpose of getting extra credit in one of my classes. I do not believe I have violated anything according to wikipedia commons instructions.

Everything is said on the nomination page. This sculpture is a work of art and as such copyrighted and likely still in copyright as it looks quite recent. By making a photography of it, you violate the sculptor's copyright.  Delete Now that the Spanish Wikipedia article has been deleted, I think it becomes a legitimate question whether to keep this here on Commons. I note this comment from that deletion discussion (linked above), by machine translation: "Explains a political party formed a few months ago, with no impact on the Spanish political life and has not participated in any elections nor have legislative representatives." The threshold for inclusion on Commons is lower than that of Wikipedia, but this sounds to me like something ephemeral and not worthy of inclusion here. 1) According to Danish copyright law the primary issue of violating copyright is in terms of commercial exploitation. Due to the fact that neither Wikimedia nor me as the creator of the image is gaining profit from the image it's hard to see how my image is basically violating the copyright of EBU's logo/advertising.
2) The logo is already present in the entire city of Copenhagen and thus visible to the public - the mere nature of this advertising is to be public. The advertising as well as the logo has not been altered in any way. The image shows it just the way it is presented by the EBU.
3) My image is named 'street advertising'. However, depending on how you define things the street advertising is just part of the whole image. The EBU logo is actually less than 10-15% of the entire image. The building in the background counts for around 20% and all of the surroundings for around 2/3's of the entire image. 1) The CC-BY SA license on the photo states that anyone is free "to share – to copy, distribute and transmit the work". That includes printing and selling the photo. That would be a copyright violation, since it is a photo of a poster that is copyrighted.
2) It doesn't matter if it is visible to the public. It is a copyrighted poster.
3) It is a photo of a copyrighted poster. You cannot upload copyrighted material to Wikimedia Commons, and you also cannot claim "source: Own work".

This file was initially tagged by ANGELUS as no permission (No permission since)... this is one of hundreds (perhaps thousands) of images transferred from Wikipedia which now sit in a folder of "no license since" perhaps due to a mistake in the transfer process. For this specific image, the source now 404 errors to nothing and it is impossible to tell the license status from the template information. After today identifying around +10 uploads as copyvio (grabbed from Flickr, blogs, skyscrapercity.com etc., details at User talk:AndrePramadhana) it´s difficult to believe that these remaining files would be own work: IMHO untrusted user uploading a bunch of copyrighted material (small/inconsistent resolutions, missing exif) so these ones (per COM:PRP) can't be believed either. Usually, the user cropped the files to hide watermarks.

This map very clearly violates the NPOV principle of Wikipedia which makes it unsuitable for use on official projects. While Commons has no such direct policy, I do believe we have a right to intervene when this violation is being ignored elsewhere. This is currently being used on the Armenian-language Wikipedia on official projects. I have attempted to explain to the Armenian users several times that NPOV is a policy on all versions of Wikipedia, but they claim they have a consensus to ignore the policy. I do not believe such a consensus can exist, as this is very clear obvious push of personal and nationalistic POV of a situation which does not exists. For that reason, this map should be deleted. The policy that Commons is allowed to delete abusive images? That should be rather obvious, we do it every day.
  • Self-promotion or vandalism/attack would apply in this case as this is not an official map (historical or present) or official symbol, and is uploaded purely for a purpose which ignores and violates Wikipedia NPOV policy and is therefore purely for the purpose of vandalism.
  • Neutral point of view also applies, because this file is not being used in good faith and therefore can not be considered "useful" or "in scope".

Well, the same policies that you point show that your statements are wrong:
1 - The NPOV policy says "Commons is not Wikipedia, and files uploaded here do not necessarily need to comply with the Neutral point of view and No original research requirements imposed by many of the Wikipedia sites. Commons acts amongst other things as a common media file resource for all Wikimedia projects, and we stand apart from the rules that may be imposed locally by each of those individual projects.", so there isnt any NPOV obligation on Commons and the use of the files is left to the consideration of each and every one of the projects without Commons editorializing said projects, by telling what files to use.
2 - The Self-promotion or vandalism/attack states that "Pre-existing designs and symbols that are or have been associated with nationalistic, religious or racist causes are not out of scope solely because they may cause offence. Provided they are legal to host and otherwise fall within Commons scope (e.g. if they could for example be used to illustrate a Wikipedia article on a hate group) they should be kept" and this two files are being heavly used in the armenian wikipedia and could also be used to illustrate the Greater Armenia that has articles in 14 wikipedias (العربية, Català, Deutsch, English, Español, Esperanto, Հայերեն, Hrvatski, Lietuvių, Português, Simple English, Suomi, Türkçe, 中文). I can read it just fine, but you're glossing over a few important points.
  • The NPOV policy states that "files uploaded here do not necessarily need to comply..." which means there is not an absolute exception, and there can be instances where it does require a file to be deleted.
  • The Vandalism/Attack policy indeed states images "are not out of scope solely because they may cause offence" and I am not nominating this image on that basis, but rather because this image is deliberately being used on official projects in direct violation of NPOV on that project. The policy states "A file that is in good faith use on another Wikimedia project is, by that very fact, considered useful for an educational purpose", and this file is not being used in good faith which means it's use does not automatically grant it "scope".
This file is not being used in good faith on ANY personal user pages or articles pertaining to a "Greater Armenia". It is deliberately being used on official wikipedia pages and templates an the Armenian-language Wikipedia to show Armenia with nationalistic and anachronistic borders. I´am repeting this for the last time. Commons doesnt have an NPOV as said in "Commons is not Wikipedia (...) Neutral point of view and No original research requirements imposed by many of the Wikipedia sites" as in Commons does not have an NPOV policy to the contrary of the Wikipedia sites and "It is not the role of Commons to adjudicate on subject-matter disputes nor to force local projects to use one version of a file in preference to another. Provided that a file falls within Commons scope, and can be legally hosted, we make it available. Whether and under what conditions it is actually used is a matter for the local communities of the individual projects to decide" as stated in Neutral point of view and in Project scope it says "A media file that is in use on one of the other projects of the Wikimedia Foundation is considered automatically to be useful for an educational purpose, as is a file in use for some operational reason such as within a template or the like. Such a file is not liable to deletion simply because it may be of poor quality: if it is in use, that is enough". if you want to change the use of this files trying changing it in the armenian wikipedia, not by the backdoor (Commons). Repeating something that I have already said myself isn't going to change my opinion. In fact, if you were as intent of reading what I actually say, you would notice I said this in my original nomination paragraph where I stated "While Commons has no such direct policy...". I'm not stupid and treating me like I am is not helping. Commons does not have a direct NPOV policy, I get that ok!!!!!!?!?! But I also understand that Commons has certain requirements of scope and reserves the right to delete images that are abusive in nature. I believe this image is abusive and does not meet the requirements for scope. Now, unless you can refute my DR on that basis, instead of just whining "Commons doesn't have an NPOV policy" like I don't already know that, perhaps you should just step back and be quiet. And yet despite your initial statement that Commons doesnt have an NPOV policy you quoted it, first when i asked in what policies here based your initial DR request (in "Neutral point of view also applies") and a second time in your second reply so decide what your saying and stick to it instead of changing from day to day and i´am not whining but instead refuting the wrong assumption that is the basis to this DR by quoting relevant parts of the policies. Actually it is you who is misreading things, or else you would not have accused me of believing Commons has a NPOV policy like Wikipedia, certainly not to the extend that you felt you needed to repeat it "for the last time". I made it quite clear I'm aware of that, but I have also quoted Commons policies which are relevant. The most important being that a file is not "in scope" merely because it is being used, but rather it must be used in good faith and for an educational purpose. This file has neither. Secondly, the Commons version of the NPOV policy is that files do not necessarily need to meet the NPOV policy of Wikipedia, not that they "don't have to at all, ever" as you are under the impression. There are always circumstances which influence a situation and I clearly believe there are circumstances around this file which require it's deletion. Now, I have told you what you should do, I won't say it in stronger terms although I would like to, but at least have the "education" you think I so dearly need and apply it yourself by properly reading what I say. Kept: Except for copyright, it is firmly against policy to delete an image that is in use on any WMF project. It is up to the individual WPs to enforce any NPOV policy they have. In the case of a Japanese photograph, the photograph published after 1957 retains the copyright in a restoration date of URAA(January 1, 1996) in Japan. Therefore, this file does not have public domain in the United States. Then we have the same situation here as for many other {{PD-US-1989}}-tagged images, such as File:Geneviève Bujold - 1979.jpg. That is, we are reasonably sure that they were first published in the US between 1978 and 1989 without the requisite copyright notice, but they were probably produced in another country, and we cannot rule out a parallel but copyrighted publication there. So perhaps every {{PD-US-1989}}-tagged file not produced in the US should be deleted, though before that happens it would be good to attract some further contributions to this discussion to make sure we've considered all possible arguments. —Psychonaut (talk) 12:42, 1 May 2014 (UTC)[reply]
Yes, many images have similar problems, especially those from Wikiwatcher 1 and his alter ego Light show. In this case it looks like a movie made in the UK and produced/published by a US company. Not easy to determine, that's actually something I'd treat as no source/permission because information is insufficient to determine the validity of the copyright tag.--Denniss (talk) 12:52, 1 May 2014 (UTC)[reply]

Just saw this discussion now. I agree with Denniss' comments about the uploads from WW1/Ls. Many of them have listed authorship as "press photo", "movie studio", and the like. There's often nothing there to indicate that the respective film studio, TV network, etc., was really the author of the photo. What happens many times is this turns out to be a copy someone else has made and a genuine copy is found later that has copyright information on it, so it has to come up for DR. Using post-1963 wire service photos can be a real problem also. US Library of Congress tried determining the copyright status of the photos from wire services in their holdings. AP UPI :

  • "In an attempt to determine if [agency] registered any copyrights and if those copyrights were renewed, Specialists in the Prints and Photographs Division of the Library of Congress searched the Copyright Office files. It was found that only a few images were registered for copyright and those copyrights were not renewed. However, the Library’s legal office has advised the Division that photographs published with proper copyright notices between 1923-1963 may be protected if properly renewed, while works published after 1963 and unpublished photographs in the collection may be protected even if they were not registered with the Copyright Office. Additionally, researchers should be advised that determining the copyright status of photographs can be problematic because of the lack of pertinent information, and researchers often have to make calculated risk decisions concerning the appropriate use of an image when its copyright status is unknown or ambiguous."

In these cases, doing a copyright check at the US copyright website may not determine the photo's copyright status. It's true re: the comments re: registration and renewal, as I've uploaded some historic photos that either weren't registered or renewed, but I've been able to check that through the UPenn website and they're all from before 1963.     • Well, this case is a bit different from the previous ones you mention in that we have a very high degree of confidence that the rights holder, at time of publication, was either the Embassy of the Union of Soviet Socialist Republics to the United States of America, or Novosti Press Agency, since those are the only two publishing entities named in the magazine from which the photo is taken. Likewise we know that much of the magazine is completely original material that was never published in the country of origin, but only in the United States (and then without a copyright notice). The problem is that Novosti, as a news agency which was active both internationally and domestically, is credited as contributing some of the material, so it is possible that this material was previously published in the country of origin. Unfortunately, the magazine does not indicate which photos are from Novosti, or at least which photos (regardless of source) were produced specifically for this magazine. —Psychonaut (talk) 12:43, 9 May 2014 (UTC)[reply]
