[edit]User is stealing from facebook. I found one of his uploads in the facebook profile of the depicted TV actor. The 720px size of some other uploads shows that this isnt the only photo that Doubledutch781 took from facebook, 720px isnt a usual format for any software or camera, its the facebook default thumbnail size. I have doubt that this user ever made a photo of a notable person.

This photo belongs to Mackinac Island State Historic Parks (Phil Porter, Director; Kelsey Schnell, Assistant). They have posted it in the Mission Point historical museum. Initially, I myself uploaded it as non-free because it did not belong to me. Phil Porter had given me permission to do this.
Because Wikipedia objected to this upload, I contacted Phil and Kelsey on March 21 and asked them to upload their photo so that it would be 'free', which Kelsey did. They chose to use the Description that I previously used.
In my Mission Point (Mackinac Island) article, I then deleted MY non-free upload and pasted in Phil and Kelsey's free upload. Therefore, the 'nomination for deletion' no longer applies to this photo.

Claim that these World War II photos licensed by uploader Silar with {{PD-Polish}} were published in Poland without a clear copyright notice before the law was changed on May 23, 1994 is not supported. Grabbed from "Ebay", "Internet" or other random sources. I doubt if uploader really has bothered to find out the author, considering User talk:Silar. Most likely NOT Polish works. Note that {{PD-Polish}} explicitly indicates: "Please provide where and when the image was first published.", which is not given. May be in PD by other means, but relevant info must be provided.

- Keep The picture shows a horse in costume looking like a skeletal horse. The picture has metadata and is part of a series of pictures of a ceremony. I didn't find very many photos of horses in costumes and I don't see any quality reasons for taking this one out. It's of large size and it has camera metadata. I was notified because of File:Game of Thrones pedicab.jpg, and I think that it is not copyrighted as a derivative work because it mainly depicts an utilitarian object, while copyrighted content is de minimis. - Mostly agree with Sandstein, too many and too disparate, need separate nominations. That said, though, I looked at half a dozen and in most the copyrighted content is de minimis, or not at all. For example, * File:Matt Groening drawing Popeye (5979821247).jpg - what is the copyrighted content even supposed to be? A rough, poorly done (sorry MG), sketch of Popeye? We've got a whole Category:Popeye of Popeye images, they're not necessarily copyright infringements, and this one certainly isn't. Another example, * File:The Playboy Club at Comic-Con 2011 - photo op.jpg - what's the copyrighted content - two tiny rabbits on a huge wall? [edit]These images should be evaluated; utilitarian non-artistic objects are not copyrighted but models or nonfunctional replicas of utilitarian objects (which is likely to include many movie props) can be copyrighted, from what one understands. In addition, some of the images include photos of scenes from the "Back to the Future" movie.
(As a side note, the "Back to the Future" movie came out in 1985; works first published in the US without a copyright notice (and no copyright registration within 5 years of publication) on a substantial number of copies prior to March 1, 1989 are out of copyright in the US. Though the movie itself is undoubtedly properly copyrighted, there might be an issue with certain artistic items that for copyright purposes were effectively published without a copyright notice; however, it is not clear that the inclusion of an item in a movie constitutes publication and the rules for unpublished works are different.)

We have obvious redundancy between File:Jupiter.Aurora.HST.UV.jpg, File:Satellite Footprints Seen in Jupiter Aurora.jpg, and File:Hubble Jupiter Aurora (NASA) (420376085).jpg. Now my suggestion is to delete the latter two, because as I said, they are obviously upscaled by a factor of 4. Obvious squares of 4*4 pixels show that. So the resolution of the first mentioned file is actually higher than that of the other two. (2842×1617 pixels after crop, divided by 4 equals 710.5×404,25, which is lower than 752×417.) The first mentioned is also the original file NASA released here: http://hubblesite.org/newscenter/archive/releases/2000/38/image/a/, where they give it out as "The best resolution available". The encoding we have here is encoded at -quality 98 with no chroma subsampling. So there is little possibility of significant quality loss. File:Hubble Jupiter Aurora (NASA) (420376085).jpg has the same content and resolution as File:Satellite Footprints Seen in Jupiter Aurora.jpg when we strip captions and borders - which I believe we want to do because we don't want hardcoded borders in the file and for the caption information we have metadata in file descriptions and image annotations. G. Wodehouse sitcom. The Coster image, even reduced 0.1 MP, is streets ahead of this total train wreck shit image we now have to put up with just because it's 'free', and it's the more galling when you consider that there is an excellent 1942 Elliott & Fry image that is PD in the UK but can't be used because of the US URAA technicality. I'm not sure there wasn't a deliberate deception here. The date is 1946, not 1945 as uploaded see the BFI database here. It follows it doesn't satisy the US URAA technicality. It's irrelevant that HMSO says Crown Copyright expiration acts worlwide. In US copyright law this work was till in copyright the URAA date and thus is not in PD. I've templated accordingly. - There was no deception intended. I used the 1945 date given a Vimeo, but if it was 1946, that does not substantial change the facts. Why is it irrelevant if HMSO declares it out of copyright? If the UK government considers material it produces to be out of copyright and freely reproducible after fifty years ([5]), for whose benefit would copyright protection be enforced? The Greenpark Productions website linked above does not list the film and the search tool does not appear to be working, nevertheless, if the company vigorously defends its copyrights, it seems strange that this film has been on Youtube, Vimeo and the Internet Archive since 2011 unchallenged.

Sollte man dieses Bild nicht doch löschen? Da es wegen des großen TIF-Formats Anzeigeprobleme gegeben hat, habe ich gleich darauf dasselbe Bild als JPG hochgeladen. Es ist somit jetzt zweifach vorhanden.
- Category:TIFF als Archivformat ist völlig in Ordnung, der MediaWiki-Fehler wird irgendwann mal repariert. See en:Wikipedia:Possibly unfree files/2012 October 16#Photographs by Nikola Gruev. A user found the terms of this template dubious and thinks that the template may be unfree. The statements at bg:Уикипедия:Разрешения за ползване на материали/Никола Груев#English do indeed look dubious:
- "Only pictures we include in Wikipedia articles fall under the GFDL. If you wish to use other pictures for another purpose, please contact the author for permission." Does it mean that the images in fact aren't covered by the GFDL but that they are covered by some non-free variant? Is permission only for Wikipedia and not for Commons? Is it a revocable version of GFDL so that the images only are available under GFDL as long as they are in use on Wikipedia?
- "Don't take everything. In the articles, one ot two pictures maximum." This is clearly incompatible with GFDL: if something is licensed under GFDL, it is possible to use any number of pictures on a page.

- Mr Nikola Gruev was very kind to let us use his large collection of digtal(ized) photos from Bulgaria at the very beginning of bg.Wikipedia, at a time when few people had a digital photo camera (even fewer in Bulgaria) and when almost all Bulgarian wikipedians were out of Bulgaria (few Bulgarians had internet). Today, when most editors are inside Bulgaria and have cameras, the pictures of Mr Gruev can easily be retaken if the community decides. Stopping our use of these pictures wouldn't do much harm to Wikipedia. But before deciding, let me reply to your questions.
- The pictures uploaded to Wikimedia Commons and used in articles in Wikipedia or other projects of WMF are irrevocably covered by the GFDL and any reuse (anywhere else) must respect this license, especially the "attribution" part and the "remind the license" part.
- Our agreement is that we can take from Mr Gruev's galleries any picture we (wikipedians) like to illustrate our articles. Once it is on Commons, it is GFDL and can be reused. Mr Gruev doesn't want to "free" all his pictures (publish them under an irrevocable free license like CC ot GFDL), but only those which we need for articles. To simplify things, instead of asking him for permission for individual pictures, we already have the permission.
- The "one or two pictures maximum" was in my initial letter to Mr Gruev to request permission. Clearly, Mr Gruev has reasons to not select a free license for all his galleries and we should respect this. We really don't need more than 2 of his pictures in an article: either the place is accessible and well known and there are many free pictures (or people who can take such), or the place is not well known and the article wouldn't be huge so it wouldn't need a ton of pictures (and if it did, we place a link to Mr Gruev's gallery page so any reader can see all pictures if s/he likes).
- Mr Gruev is aware that once the picture is in a Wikipedia/Wikimedia article, it is irrevocably freed and can be reused elsewhere under certain conditions (GFDL).
- Mr Gruev has agreed after my first message in his public guestbook on 02-Nov-2004 (search for "GFDL"), then we had a longer communication by e-mail to reexplain the free/GFDL part, then several years later he took part in the discussions here on Commons and on bg.wiki [6] [7] [8] [9] [10] [11] to confirm that he had understood the terms and that our agreement stands.
- For these reasons, I would vote to Keep the template and the pictures, and I invite others to do so. --5ko 05:47, 24 October 2012 (UTC)
- Delete This template makes me uneasy. The terms of the agreement suggest that if an image is taken out of WP:BG that it is then no longer covered by the agreement and we apparently do not have OTRS permission in any case. Since 5ko believes that we do not need more images from NGruev, I suggest that we get a clear CC-BY-SA license using [[Commons:OTRS}} for the ones we are using. - Keep (Erh, sincere apologies for not coming to share my view earlier, despite of being tipped on my talk page: too much off-wiki business.) Raised personal concerns in the past were the reason for having the initially given permission double-checked, re-requested and - not surprisingly - re-confirmed. So far, I know not of a case when Gruev's images, as published in Wikipedia, have raised the copyright holder's concerns if used elsewhere. And I'm sure that having been in personal contact with him, I'd be among the first to hear. :) I declare that all specifics of the free licenses have been explained to Mr. Gruev in details and meticulously by both my colleague Petko Yotov, 5ko, and me. So, do we really need to ask for that permission for the third time? In the eyes of an elderly non-Wikipedian who is not necessarily as copyright paranoid as we are here :) this may really look fishy now. And I have certain experience with Bulgarian artists whose permission has been requested in order to have photos of their works here. These people usually give permission readily, though less formally, simply as a natural answer to emails that have been sent to them. In general, I firmly believe that especially people who are more elderly or more technically challenged or not know English themselves should not be forced to provide their permission with the exact articulation of COM:OTRS, as long as they have been well explained and have agreed to release a work freely. Different countries also have their specifics and Bulgaria is still a place where people are in general not freaky about their copyrights and are more generous and ready to release, thus increasing the visibility and positive publicity of their works. This has been nominated for deletion previously: Commons:Deletion_requests/Template:NGruev with a rather non-commital close. The closing administrator User:JuTa left no predjudice to reopening the discussion. According to the linked website, the images cannot be used for commercial means. The "requirements" that the author lists at [12]include limits to how the images can be used. Due to the limits and the restriction of non-commerical, these files copyright status is in dispute. The author gives permission for use on Wikipedia, but the conditions do not make a free license. This is a bad template, that promotes the use of images that do not actually have a full free license. In addition, all images that use this template should be deleted, unless other evidence of copyright is provided.
TL;DR The author of the images does not truly release the images under a free license (or at least he doesn't want to) yet this template incorrectly parades it like it does. -- TLSuda (talk) 21:09, 22 March 2014 (UTC)

As a practical matter the requirements of GFDL make it impossible to use such images in any print medium and difficult for many web sites. - However in this case we are told, that part of the arrangement is "Don't take everything. In the articles, one ot two pictures maximum" -- that is not a free license. A free license allows the user to take as many images as he wishes and use them for whatever purpose he wishes. - Maybe you think something but don't understand completely, and it is my fault because I am obviously unable to clearly transmit the information. (Sorry, English is my third language.) I will kindly hope that you can find a way to read the page Template talk:NGruev and/or Commons:Разговори/2007 or find a translator or use an automatic translation for the sections in Bulgarian language. Mr Gruev was asked and re-asked more than 6 times and every time he confirmed that he understood the conditions (GFDL) and that he agrees to them. The comment from Commons Admin User:Spiritia from 10:13, 26 August 2007 (UTC) has the "commercial usage" emphasized in bold and italics, and he again re-confirmed this. He doesn't want to change the sign on his website, but we have documented and re-documented his agreement to (re)use his photos under the GFDL, including for commercial usage, here or elsewhere. In the last 10+ years, Mr Gruev has been aware that his pictures are on Wikipedia, we never had any copyvio request or any other problem with his pictures. I really don't see how and why this bothers people here. OTOH, in 2003 he was a retiree, now 11 years later how comfortable is this person with computers and internet? Should we once again harass him to once again ask him to once again re-confirm he understands the GFDL and his agreement? What happens if an author has given permission in the past but for any reason cannot or does not confirm it later? Here on Commons there are Administrators or trusted users who confirm the licenses on the pictures on external websites like Flickr. Can we apply this here? - I've read through all of the discussion over and over, and I've had the discussions translated for me. Gruev gives way too many conditions for the file to be free. You cannot say that it is free here, but not free there. More importantly, you cannot say "1-2 images are free but the rest are not" without identifying which ones are free. Based on what you are saying, he has given someone permission to use 1-2 images on free articles, but does not release certain images, therefore we don't know that he as released images. -- TLSuda (talk) 18:04, 31 March 2014 (UTC)

- Why a deletion request just against my pictures and not against the thousands of this category? Category:Masks_by_country. Copyright law is relevant if there is a threshold of originality. I don't see this here because (a) some mask are so old (historic, over 100 years) (b) the masks are variation of stereotype so that we have not threshold of originality and so no infringement of a copyright. --Wladyslaw (talk) 19:46, 22 March 2014 (UTC)
- Beside of this: masks are IMO similar to clothing. Clothing is protected by trademark law. The copyright gear towards the imitation of other clothing manufacturing. It's not forbidden to make photographs of enrobed persons. And same here with the masks. Masks major feature is to costume and to present them in public places. Wer sich öffentlich macht, und das ist ja gerade der Sinn eines Umzuges, der will ja gerade Aufmerksamkeit auf sich ziehen und wahrgenommen und fotografiert/gefilmt werden. Wenn schon hier das allgemeine Persönlichkeitsrecht nicht greift - was wohl unstrittig sein dürfte - dann gilt das Urheberpersönlichkeitsrecht erst recht nicht. - Content of file talk page: This diagram is a straight copy of Figure 1-1, from page 17 or my book, "The Linux Programming Interface", copyright by myself, and published in 2010 by No Starch press (San Francisco). It is not freely licensed for re-use. (MichaelKerrisk)
- Image was generated using graphviz (i.e. it was not copied verbatim) on the basis of relationship data from the diagram in that book which can be seen here. It was my understanding that that does not constitute coypvio, i.e. it is the same as e.g. coloring regions in new maps on the basis of existing, copyrighted images of maps. - To say "generated using graphviz (i.e. it was not copied verbatim) on the basis of relationship data" is obfuscation, I'm sorry. This image was copied. The only difference between this diagram and the one in my book is that some boxes have been moved around. Otherwise, the following are exactly the same: the text in each box (even down to the line breaks); the lines used to indicate actual relationships between the boxes (standards), the use of dashed lines between some boxes versus solid lines for others to indicate different types of relationship between the stndards (the use of the two line types is a 1:1 match with my diagram). By your argument, if I took someone's text, which they had written in, say, LibreOffice, copied it into LaTeX, and reordered the paragraphs, then I would not be violating the copyright, because the copying is not "verbatim". To claim this as "your own work" without any mention of its source is disappointing to say the least -- MichaelKerrisk
- The image was generated by Graphviz from a textual script written in DOT language. Graph elements (nodes and edges) were intentionally styled to mimick the one in the book. The layout of the nodes (i.e. what you perceive as box rearrangements) was determined automatically by Graphviz's layout algorithm, and I had not control over it, including the line breaks in node labels. Since the textual format of the DOT script is a creative work by itself, and the generated image is merely a compiled SVG version of the same script, I fail to see how I am not the owner. The text in the boxes is composed of isolated phrases and words that cannot be subject to author copyright. --Ivan Štambuk (talk) 08:38, 23 March 2014 (UTC)

- Comment: interesting case. The relationships themselves seem to be purely factual information, thus not subject to copyright. The line breaks for all boxes except possibly "POSIX.1d" and "POSIX.1j" seem self-evident (i.e.: Name of standard <br> (Year [, Org]) <br> component). For POSIX.1d and 1j, the line breaks seem self-evident because both "Additional real-" and "Advanced real-" take up very nearly the same amount of space as "time extensions". Also, a couple of boxes differ: "XPG4v2" and "SUSv2". I'd say our version looks better laid out and has some arrows that seem to be missing in the original, but the question really is: does the original have enough creative (i.e. non-purely-factual) content that passes the threshold of originality such that our version needs to go? Personally, I don't think so, but perhaps the source should read something like "based on information contained in The Linux Programming Interface by Michael Kerrisk, with a link, and the license changed to {{PD-ineligible}}. My gut says "weak keep", but this is not my area of expertise, so I'm leaving this as just a comment and not a {{Vk}}. Storkk (talk) 10:02, 4 April 2014 (UTC)
