Same as with Commons:Deletion requests/Image:Alain fournier.jpg. No proof that this image is anonymous, no proof that any recherche was done to find out the real author and if he is dead 70 years yet. Just taking a image from a website where the author is not named is not recherche. (Sourcelink is dead anyway and never showed to more than a start-page) Cecil (talk) 16:13, 22 June 2009 (UTC)

Is there any way to save this photo?

If so, there are no other free alternatives of this image, even if I create one. What shall we do to this photo? I mean, we can't just remove the photo because it is not allowed for commercial purposes since Wikipedia is not a commercial project.
What about the Republic Act 8293 Chapter 4, Sec. 176.1? Doesn't it apply to this logo? This logo can be found in many places in the city and also to the public documents issued by the city including demolition permits, sanitary permits and building permits which are issued and displayed to the public? - I'll discuss this point by point.
- (a) Under the project scope of Wikimedia Commons, only free images are allowed. The image license must allow commercial use since content re-users might distribute content commercially. If commercial use is not allowed, the image will be deleted.
- (b) Wikimedia is a non-profit organization but the content of Wikipedia and Wikimedia Commons can be distributed commercially by re-users.
- (c) Republic Act 8293 Chapter 4, Sec. 176.1 says Philippine government work is public domain but the conflict there is that it does not allow commercial use unless permission is sought from the government. Because of this Wikipedia and Wikimedia Commons consider their works non-free.
- (d) The use of the logo throughout the city is in a way have an implicit permission because they are actually works of the government.
- (e) The English (and Tagalog) Wikipedia can accept non-free works provided that they are tagged correctly ({{non-free seal}} with {{non-free Philippines government}}) and follow the non-free criteria. You can upload these images there.
