- Keep Might be useful to illustrate a typical new year's greeting card. Besides, we've always allowed the upload of files for user pages or other on-Wiki related business (within limits, but this one clearly falls within those). BTW, it's derived from File:Bonne année 2008.jpg or File:Bonne année 2007.jpg. Unfortunately, the French 2009 version is full of compression artefacts... There's also File:Happy New Year 2009.jpg, which doesn't have these artefacts. Maybe you'd like to redo the French 2009 version, PRA? Lupo 10:03, 6 January 2009 (UTC)

- I'm handling the OTRS ticket (Ticket:2008123110000431) relating to this, and have requested some clarification on the licensing. Leaving that aside, I don't think that this is sufficiently similar to Star Wars to be considered a derivative work. The only element that's been directly copied is the light saber, and I doubt that is a sufficiently original idea to attract copyright — Nintendo apparently agrees with me based on the use of the Beam Sword in the Super Smash Bros. series. I'm afraid this picture is delictuous in France, where it's been (very probably) made and uploaded. It is a couterfeit of a protected logo, which is against article L335-2 of the Code of Intellectual Property (at least this is how I understand it, I am not a lawyer). - From what I understand (again, I'm not a specialist -- french article on the subject), dessins et modèles are (in France and in the pre-2001 status) protected by both the droit d'auteur (which is copyright, I think) and industrial property. Both make counterfeits delictuous in France (again, as far as I understand the problem). And I think that on Commons, an image must be legal both in US and in the source country. This is a picture of a Maldivian National artefact, which is in public display. And also the source website is a government owned site. Additionally a different source can be found. FaranjiPyrard (talk) 23:14, 3 January 2009 (UTC)
- The fact that the artefact was in public display is irrelevant I think, it does not prevent the photographer from gaining rights over his picture (it wouldn't have been the same with a 2D artefact and a colour photograph). As for the government owned site, it is not incompatible with copyright (Malaysian governmental organisations hold copyright over their work).
