"Own work"

You've uploaded photographs of Zoe Longfield that are about seventy years old, and photographs of paintings by her, saying that all are your "own work".

She died before you uploaded them: you can't be her. The paintings therefore are not your own work.

As for the photographs, the photographer(s), if still alive, would probably be in their nineties or older. My guess is that you are not the photographer.

Do you nevertheless somehow possess the copyright of these paintings and photographs? -- Hoary (talk) 08:31, 18 January 2021 (UTC)[reply]

In response to your question:

You say that "The paintings were done by Zoe Longfield in the 1940s/50s but they are currently in my possession and the photographs were taken by me." I'm pretty sure that you mean that the photos of those paintings were taken by you. I'll assume for now that this is so. According to my understanding of the Wikimedia Foundation's understanding of US copyright law (which applies here), the creator, no matter how experienced and skillful, of straightforward photographic reproduction of a two-dimensional work has no copyright claim over it. (See Bridgeman Art Library v. Corel Corp.) The copyright of the paintings and the reproductions thereof would presumably belong to Longfield's estate. If you're administering the estate or for some other reason (which I can't imagine, but I have no relevant expertise) have the right to decide copyright matters, please use "OTRS" to explain, and mention at Deletion requests/Files related to Zoe Longfield that you have done so. Also, say there that no, these paintings are not your "own work".

Did you take the photographs of Longfield? If you did, you surprise me, but congratulations! If you didn't take the photographs, who did, and where and when were they first published? Make the matter clear at Deletion requests/Files related to Zoe Longfield.

Presumably you didn't design Metart's handbill and don't possess its copyright. Please decide whether its design passes the "threshold of originality". If you believe that it does not, remove your claim that it's your "own work" and add the template "PD-text". If not you believe that it does, agree that it should be removed. Susieall2012, thank you for writing on Commons talk:Deletion requests/Files related to Zoe Longfield; however:

  • You're claiming there that you have the copyright of File:Handbill for the Metart Galleries, 1949.jpg, but there you say that it's in the public domain which if true means that there's no copyright for anyone to own.
  • Copyright of the photographs of ZL (I mean, the photographs showing her) presumably belong to the photographers, who presumably weren't ZL. (Yes, there may be loopholes -- they could for example be self-portraits using a timer -- but you'd have to explain.)
  • Actually I believe you when you say that you own the copyright for the paintings. However, this personal belief means squat on this (arguably Kafkaesque) website. I'm no expert in Wikimedia Commons matters, but what I think you should do is contact Commons' (not Wikipedia's) "OTRS" (of which I am not a member). Do it quickly; be patient.
  • "I will revise the text. . . . I will submit for review. . . ." (And you've already done both, I'm happy to say.) Those are Wikipedia matters, not matters you need bring up here in Wikimedia Commons.
  • The vast set of pages "Commons talk:Deletion requests/whatever" are rarely used or looked at.

I suggest that you first contact OTRS and then, without waiting for the response, post an interim comment at Commons:Deletion requests/Files related to Zoe Longfield (NB no "talk" within that), saying what you know, and promising to say more as soon as you can.
