Hi,

I have seen that you have uploaded several images which seem to be from the Instagram page of @milkycoffee1. Are you the same person as this Instagram user? If so, could you prove this somehow? For example, you could post something like "Wikimedia user Sueding" in your Instagram profile. If you are not @milkycoffee, I fear that your uploads are a copyright violation and would have to be deleted from Wikimedia Commons. Spike (talk) 14:47, 28 June 2020 (UTC)[reply]

You should then get in touch with Milkycoffee1 on Instagram to establish the same. Rather than accusing me of violating copyrights belonging to somebody else? and nominating it for removal? Please take a look at Commons:Licensing which contains an explanation about the laws and the rules on this website regarding licensing and copyright. I will try to give a short summary: When someone uploads a photo here on Wikimedia Commons they must either be the creator of the photo or they must have proof that the creator of the photo has released that photo under a "free license". I assume that you are not @milkycoffee1 and I also assume that @milkycoffee1 was the creator of the photos that you have uploaded here. That means that you were only allowed to upload the photos here if @milkycoffee1 had released those photos under a free license. But from looking at their Instagram page, I cannot see that @milkycoffee has given such a license for their photos. That would mean that you did not have the right to upload the photos here.
Regarding your request that I should get in touch with @milkycoffee1: It is the person who uploads photos here on Wikimedia that is responsible for ensuring that they have the right to upload those photos. And since it was you who uploaded the photos, it was your job to get in touch with @milkycoffee1 to get him to release the photos under a free license. If you already did that, you must provide some proof. One possible way would be to get @milkycoffee1 to write on his Instagram bio something like "I have released all images uploaded by Sueding on Wikimedia Commons under the Creative Commons Attribution-Share Alike 4.0 International license". One more thing I just noticed: I was not the one who nominated your image File:NC500- Glencoe2.jpg for removal. That was another Commons user. I had nominated it for renaming and then I took a closer look at your uploads. I then decided to talk to you instead of nominating your uploads for deletion right away. Milkycoffee1 gave me the original image and has given me licence/ permission to use it for this purpose. I am a lawyer by profession, would I knowingly breach another person’s copyright? Also, how can I possibly convince another person I have licence to use it if you already have doubt i do in the first instance. I just don’t get this draconian nomination to delete because I am allegedly in breach of copyright. How do I even proof Milky has given me permission? I am not Milkycoffee1 but he has given me the licence for me to use his photos here. In fact he was the one that provided me with the right resolution photos so it would appear good on Wikipedia.

I genuinely don’t know how can one extract whether or not he has given me permission to use his photos just by looking at his Instagram. It is such an absurd observation and to then accused me of breaching a copyright because one cannot see the link between the IG account and here. Again it is unreasonable to expect Milkycoffee1 to state on his account that he’s allowed me to use his photos. Milkycoffee1 has given me licence to use the photos I’ve uploaded here. I'm sorry but I gave you incorrect advice when I talked about @milkycoffee1 changing his Instagram page. You can find the correct advice at Commons:OTRS. It basically says that @milkycoffee1 has to send an email to permissions-commons@wikimedia.org and in that email they have to say that they have released the photos under a free license. I don’t know how to respond to the nomination to be honest... and it’s really unfair that people would nominate for it to be deleted before they even find out if I breached any copyright.... that’s just wrong.
