- Ja, genau. Das Konzept des "Fair use" gibt es im deutschen Recht nicht. Daher können z. B. auf der englischen Wikipedia viele Bilder quasi als "Zitat" verwendet werden, die eigentlich urheberrechtlich geschützt sind, nicht aber auf de.wikipedia. Das hängt immer damit zusammen, in welchem Land die jeweiligen Dateiserver stehen. Die Server der englischen WP stehen in den USA, also gilt für diese Wikipedia amerikanisches Recht. Die Commons-Server sind auch dort beheimatet, aber weil Commons ein globales Archiv ist, gilt hier als spezielle Vorschrift die Regel, dass alle Bilder usw. auch im Ursprungsland frei verfügbar sein müssen, und "Fair use" ist auf Commons auch nicht erlaubt.
