I was under the impression that a photograph of a screen showing a copyrighted image did not qualify as a derivative work, and instead was blatant enough to go through a speedy deletion without much comment. I uploaded this file to Wikiversity under Fair use but was concerned about the screen in front of the image so I sent an email to Dr. Ashley Poust. Here is what I wrote:

"I recently uploaded this image File:Wulong bohaiensis1.jpg under Fair use but I have some concerns about the origin of the image that I hope you can help with.

The image was obtained by someone else and uploaded to our Commons website. The image appears on a website entitled, "File:Wulong bohaiensis.jpg" at https://commons.wikimedia.org/wiki/File:Wulong_bohaiensis.jpg.

The source is https://eurekalert.org/multimedia/pub/221711.php?from=452776 which is the American Association for the Advancement of Science and states "USAGE RESTRICTIONS None". But under Terms & Conditions states: "You may not reprint, reproduce, republish, or otherwise distribute content that appears on EurekAlert! in any way except for your own personal, non-commercial use, without permission from EurekAlert! and AAAS." and includes "all submissions must include an explanatory caption, as well as preferred credit line and information on terms of usage or permission requirements, if any."

This is not the image shown at "San Diego Natural History Museum paleontologist describes a dinosaur that is new to science, offers view into dinosaur-bird evolution" from SDNHM."

May I have permission to use the image here or one without the apparent screen visible, if available. It's currently in a draft lecture "Draft:Paleontology""

Here's his response:

"You're welcome to use the image: just please attribute it to "Ashley Poust". I took the photo and Eurekalert is using it with permission, so I believe that's just pro forma in this case.

I've attached a version in case that helps.

Eurekalert is simply a science news propagator, so it does not own the copyright to images it hosts. And even if it did, that wouldn't be sufficient since Wikipedia images are made available to the public under a commercial license and would not pass their "personal, non-commercial use" clause. It sounds like Ashley Poust is the copyright owner and that they are giving you permission, but I'm not sure. If not, you would have to get direct approval from the journal in which it was first published (online version here[1]), and I doubt the journal would allow that. Since Eurekalert did not provide the image under a free noncommercial license, you need to get approval directly from the copyright owner. You should respond to Ashley, asking whether they are the copyright owner and would be fine with the image being published under one of Wikipedia's creative commons image licenses. These include CCBY-SA 4.0, CCBY-SA 3.0, CCBY 4.0, or CCBY 3.0. If Ashley clearly says yes, I'll consider you off the hook and you'll need to take a few more steps to formalize the permission you received. Actually, I need only pass on Ashley Poust's email. I already have the image on Wikiversity without the screen and permission to use that clean image. If you would like to endeavor to keep the image or have the one without the screen (same image but not controlled by AAAS or Eurekalert) but by Ashley Poust I can upload it here, but the rest is up to you or others here at commons. --Marshallsumter (talk) 03:19, 22 January 2020 (UTC)[reply]

I appreciate your interest, but the site will not be "unlocked" in the foreseeable future. I have no plans to reopen the Paleodocs wiki's editing permissions to other users any time soon (quality control was exceedingly difficult when permissions were open), and new pages are slowly created at my leisure, keeping in mind it takes at least 2-3 hours to write and/or fact check a single new article. Time management is a major concern and the Paleodocs wiki is only one of many duties and commitments. I have neither the time, energy, or desire to expand to other documentary genres, but you're welcome to contribute to other preexisting wikis (of which there are many), or make your own miraheze site. I agree that it would be cool to have better-organized information on relatively obscure programs, that was my main motivation for creating the site back in February. I'll do what I can. Unfortunately I don't have much capability for finding lost media, so I can't help with those versions on my own. I cannot give you a time frame for anything I do related to the site, so I ask that you not anticipate much recent change. Like I said, I can't prioritize the site very often. I would love to make a page for Megafauna: What Killed Australia’s Giants, but unfortunately I've not found an accessible recording. It's also an hour and a half long, which is easily a 4-5 hour time commitment based on my previous experiences. You've messaged me in the early morning hours during finals week, and I'm happy to consider your requests (emphasis on consider), but I have other obligations at the moment. oh and some things. The skull of the oviraptorsaur in White Tip's Journey is acutally a Anzu (according to HodgePodge), marking its debut. Also T-Rex from 2024 has been realsed on Digital and home video, so the page needs cleaning. The footage of the Megalodon from Mega Predators is acutally stock footage from Prehistoric Sharks 1996. Some of the "original" footage of Tyrannosaurus from Dino Gangs, comes from Triumph of the Veterbrates. Ok so i made a wiki the combines all the wikis i mentioned and the paleontology one https://naturedocs.miraheze.org/wiki/Main_Page it will be similar to this one but with a different subject you, Corythoraptor and Roadrunnerfromhell alongside some possible other new users will help me with this. Besides the subject this wiki will have no list since it would be too long and i will decide what page to make. There will 1-2 pages a day (except for categories of course). I will use the same format like the Paleontology wiki with the appearances, people and many more. First off the japanese documentary features Promastodonsaurus and had figures based on it https://www.flickr.com/photos/137381464@N07/40024018794/in/album-72157662474811869 second i dont know how to make all the pages alone and i was inspired with some changes. They wont be any list because it would be too long. It will have a similar format but with a Topic of Emphasis in order to not find among the sea of red links. I decide what page to create plus they will 1-2 pages a day. I should inform you that I still have no desire to contribute to your naturedocs wiki, it is outside of the scope of my interests and you have not demonstrated much respect for my time and personal autonomy. I think you should check the miraheze content policy, specifically the clause that "Wikis with the same or a substantially similar topic to another existing Miraheze wiki are not allowed." At the moment, your wiki's content demonstrates that you have no qualms about plagiarizing text written by me and other former editors on the paleodocs wiki. I may have to bring it up to the miraheze Community Noticeboard or Steward Request system. I have spoken to Corythoraptor and Roadrunnerfromhell in private; neither shows any interest in collaborating with you, and the former in particular is just as frustrated by your actions as I am. You are entirely alone in editing the naturedocs wiki, please try to use your own voice rather than duplicating that of others. Miraheze has better standards for quality control than a competitor like Fandom, and quality control is entirely the reason why I avoided joining any Fandom sites for the sake of my project.
